As was outlined in a letter from Mr. John C. Grey of Black and Veatch (engineering consultant for the site), this aforementioned water line project includes the proposed 8-inch water line from S.R. 2384 (North Carolina Zoological Park) to Seagrove, located adjacent to South Prong Richland Creek, Reed Creek, Kings Creek, Fork Creek, and Bear Creek, south of Asheboro, Randolph County, North Carolina. Reference is also made to the site visit conducted on July 19, 1991, by Mr. John Thomas of my staff at the site of the proposed water line projects. Also in attendance at the site visit was Mr. William Bizzell of Black & Veatch. The purpose of the site visit was to review plans for the aforementioned water line project, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The site visit revealed and the plans/profiles for the aforementioned project (plans received from John Grey on April 13, 1992) showed that you propose construction for the proposed 8-inch water line from S.R. 2384 (North Carolina Zoological Park) to Seagrove below natural grade within a 40-foot construction easement adjacent to the aforementioned creeks. Also your plans and profiles show other sections of proposed water line located on high ground (mostly road right-away) without discharge of fill into regulated areas. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the.Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. i r -2- Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. Please be aware that this authorization does not relieve you of the responsibility to obtain any other required or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-5083, to obtain the necessary Section 401, Water Quality Certification prior to starting work. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP authorization, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Please be reminded that no excavated or fill materials may be placed in any waters or wetland areas without prior Federal permit authorization. As was reviewed on the site visit of July 19, 1991, the aforementioned authorized water line project is only the first contract/phase of the proposed water improvement projects for the Seagrove/Ulah Metropolitan Water District. Please contact this office for any future proposed impacts in any water or wetland areas subject to Department of the Army permitting authority. Thank you for your time and cooperation. A review of the topographic map submitted shows that the water line will follow existing roads. The only wetlands affected will be at stream crossings. WSRO has no concerns with the proposed project since less than once acre of wetlands will be affected. Therefore, a site visit was not performed.
