Dear Mr. Parker:
Reference the application of NCBF, Incorporated, represented by Mr. Josh
Nobles, for a modification to State/Department of the Army permits which
authorized construction of a ten-slip community marina facility on Brown
Creek, near Merritt, in Pamlico County, North Carolina. This modification is
to authorize construction of a concrete boatramp with adjacent courtesy docks
and jetties.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the modification
of State authorization:
a. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable. waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
b. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
c. -The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less are not considered significant.

9. NARRATIVE DESCRIPTION: The applicant's property, known as
Water's Edge Subdivision, is located off SR1321, on Brown's
Creek, near the community of Pamlico, in Pamlico County.
CAMA Major Permit #1-90 was issued January 3, 1990 for
construction of a ten (10) slip dock which has been
completed.
This application is for the construction of a 16' x 35'
concrete boat ramp adjacent to the existing community dock.
Approximately 12 cu. yds. will be placed below NWL for
construction of the ramp. The applicant proposes a 36' x 3'
courtesy dock with an attached groin down each side of the
boat ramp. The applicant is proposing a 390' x 10' gravel
access road leading from the cul-de-sac down to the ramp.
Parking for the existing dock and the proposed ramp will be
in an area designated outside of the 75' Estuarine Shoreline
AEC.
10. ANTICIPATED IMPACTS: There is an approximate 2' fringe of
Juncus roemerianus along Brown's Creek at the location of
the proposed boat ramp. The proposed ramp will require the
excavation of approximately 35 sq. ft. of.Juncus
roemerianus. The proposed ramp will disturb approximately
320 sq. ft. of shallow estuarine bottom and the access road
will disturb approximately 39,000 sq. ft. of highground.
The waters of Brown's Creek are designated as a Primary
Nursery Area by the Division of Marine Fisheries, open to
shellfishing by the Division of Environmental Health and the
Division of Marine Fisheries, and are classified as 'SA' by
the Division of Environmental Management.

affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the

U.S. Army Corps of Engineers regarding drat agency's

9. NARRATIVE DESCRIPTION: The applicant's property, known as
Water's Edge Subdivision, is located off SR1321,, on Brown's
Creek, near the community of Pamlico, in Pamlico County.
CAMA Major Permit *1-90 was issued January 3, 1990 for
construction of a ten (10) slip dock which has been
completed.
This application is for the construction of a 16' x 35'
concrete boat ramp adjacent to the existing community dock.
Approximately 12 cu. yds. will be placed below NWL for
construction of the ram;. The applicant proposes a 36' x 3'
courtesy dock with an attached groin down each side of the
>oat ramp. The applicant is proposing a 390' x 10' gravel
access road leading from the cul-de-sac down to the ramp.
Parking for the existing dock and the proposed ramp will be
in an area designated outside of the 75' Estuarine Shoreline
AEC.
10. ANTICIPATED IMPACTS: There is an approximate 2' fringe of
Juncu.s roemerianus along Brown's Creek at the location of
the proposed boat :;ramp. The proposed ramp will, require the
exQa.vat:ion of approximately 35 sq. ft. of Juncus
roone.rianus. The proposed ramp will disturb approximately
32C sq. ft. of shallow estuarine bottom and the access road
will disturb approximately 39,000 sq. ft. of highgroun.d.
The waters of Brown's Creek are designated as a Primary
Nursery Area by the Division of Marine Fisheries, open to
she.llfishing by the Division of Environmental Health and the
Division of Marine Fisheries, and are classified as 'SA' by
the Division of Environmental Management.

Gentlemen:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of the modification of your State permit which
authorized you to construct community marina facilities on Brown Creek, near
Merritt, in Pamlico County, North Carolina. This modification provides for
construction of a boatramp with adjacent courtesy docks and jetties.
Your revised proposal has been reviewed and found to be consistent with
the provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
modified State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any further change In your work is required because of unforeseen or
altered conditions or for any other reason, plans revised to show the change
must be sent promptly to this office and the North Carolina Division of
Coastal Management prior to performing any such change or alteration. Such
action is necessary as revised plans must be reviewed and the authorization
modified.
