to place fill material in water or wetlands for bulkhead as shown
on your 3/19/92 letter located at Harvey Point Station, in
Perquimans County, we have determined that the proposed fill can
be covered by General Water Quality Certification No. 2665 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 13.

Nationwide 404 Permit applications
Biologists on our staff have reviewed the enclosed Nationwide 404 permit
applications with regards to Section 401 Water Quality Certification. Due to insufficient
staff and time limitations we are unable to comment on several applications. This "no
comment" should not be considered as either approval or disapproval of the work
proposed. These projects are:
1. Dallas Farris, Pender County
2. SR 1141--near Beaufort, Carteret County
3. B-131 b-1318, Bridge 13 over Harrston's Creek and Bridge 18 over
Merricks Creek on-NC 210, Pender County
4. midge 314 over Little Creek, Beaufort County
t-YL7 S. Navy, Harvey Point, Perquimans County
6. Sara Meadows, Craven County (DEM ID 92176).
In addition, we have commented on the environmental reports for the Hobucken
Bridge Replacement over the Atlantic Intracoastal Waterway in Pamlico County. Provided
that there is full compliance with mitigation agreements, we do not object to 401
Certification for this project.
It would be most helpful to us if your office would indicate which projects are being
processed as a Nationwide Permit and those processed as individual permits. Also,
assigning a number to each application would provide an efficient tracking system within
and between agencies.
We appreciate the opportunity to comment on these applications. If we can provide

2. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on 22 November 1991 lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404
of the Clean Water Act, was provided for bank stabilization activities
provided:
a. No material is placed in excess of the minimum needed for erosion
protection;
b. The activity will not exceed an average of one cubic yard per running
foot placed along the bank below the plane of the ordinary high water mark or
the high tide line;
c. No material is placed in any special aquatic site, including wetlands;
d. No material is of the type or is placed in any location or in any
manner so as to impair surface water flow into or out of any wetlands area;
e. No material is placed in a manner that will be eroded by normal or
expected high flows; and
f. The activity is part of a single and complete project.

3. Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions, and the bank stabilization activity
is constructed within the area flagged by Mrs. Laura Fogo of my staff, which
is approximately 930 linear feet. This NWP does not relieve you of the
responsibility to obtain any required State or local approval.
4. This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case basis to modify, suspend, or
revoke the authorization.

1. Reference your application received on 25 March 1992, for Department of
the Army authorization to construct and backfill approximately 930 linear feet
of bulkhead for the purpose of stabilizing an eroding shoreline, adjacent to
the Albermarle Sound, located at the end of S.R. 1336 and S.R. 1351, Harvey
Point, Perquimans County, North Carolina.
