Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is a reasonable time for State action. Therefore, if you have not acted on the request by April 21, 1992, the District Engineer will deem that waiver has occurred. C ?. u Project setting The applicant's property is located in Tyrrell County off SR 1213 on the south side of Albemarle Sound at Edgewater Estates north of Columbia, North Carolina. The property is bordered on the east and west by developed and bulkheaded lots. The lot to the west is separated from the applicant's lot by a manmade canal. Both adjoining lots are vegetated with upland vegetation including lawn grass, pines, mixed hardwoods and ornamental shrubs. The site varies from 2' to 5' above mean sea level. The northern portion of the property fronts Albemarle Sound and is a highly eroded and unprotected shoreline. The eastern third of the property is highground vegetated with upland grasses and pines. The western two thirds of the property is designated as 404 wetland by the U.S. Army Corps of Engineers. The 404 wetland area is vegetated with mixed hardwood including cypress (most of which has been recently cut) and other various species of wetland vegetation. The western edge of the property borders a manmade agricultural drainage ditch and has a ± 10' wide spoil bank with several openings into the 404 wetland area. Albemarle Sound is classified as SB waters by the Environmental Management Commission. Project description The applicant proposes to excavate an irregularly shaped 3,638 square foot boat basin protected by a proposed rock riprap breakwater on one side and the remaining area stabilized by bulkhead. The riprap breakwater will have a 27' toe to toe width and will extend 5' above the NWL. The basin is to be excavated to 4' below the NWL. The landward side of the basin will be stabilized with bulkheading which will be adjacent the 404 wetland and will be 105' long and will not project above the adjacent wetland elevation. The project includes additional bulkhead and rock riprap for shore stabilization and reclamation of land lost to erosion. The maximum distance offshore for this section of bulkhead is proposed to be 30' and will extend 5' above the NWL. The section of this bulkhead adjacent the sound will also be armored with rock riprap extending 15' waterward of the bulkhead and tying into the proposed breakwater. Remaining highground on the project site is to be filled to increase the elevation above the NWL. This fill area will be confined by a combination of the 5' high section of bulkhead and a proposed retaining wall to be constructed along the highground wetland interface line approved by the U.S. Army Corps of Engineers. This area will be stabilized via sloping and seeding. An old spoil bank on the property is proposed to be excavated to the 3' contour above the NWL and the resulting material will be used as fill. Other structural features proposed include: a i 75' long by 6' wide pier with a 12' by 18' T-head, a ± 150' long by 6' wide dock constructed landward of the bulkhead, and two 20' long wooden breakwaters ± 90' offshore. The applicant proposes to repair and/or replace an existing 135' long wooden groin. Anticipated impacts The project as proposed would result in the covering of approximately 3,594 square feet of sound bottom with riprap. Approximately 1,800 square feet of sound bottom and 1,838 square feet of 404 wetland will be excavated for the boat basin. The project would result in localized turbidity associated with dredge and fill activities as well as with construction activity.
