concern on how the new intake screens will affect the aquatic life
must be submitted to your office to complete the 401 permit.
Attached is a copy of the letter from the North Carolina Wildlife
Resources Commission written in conjunction with the Environmental
Assessment. Also attached is our response to this letter and a
letter by Linda Sewall stating that "none of the (environmental)
impacts were found to be significant."
If you need further information, please call as soon as
possible. Please send us a copy of a letter of issuance when the
401 permit is issued.

Attached are the comments which we received as a result of the Department of
Environment, Health, and Natural Resources' review of the Environmental
Assessment (EA) for the City of Eden's proposed water treatment plant expansion.
It will be necessary to resolve the North Carolina Wildlife Resources
Commission's concerns related to the intake velocities and screens before I can
submit the EA and FONSI for State Clearinghouse review. If your design can
incorporate the Wildlife Resources Commission's recommendations, a letter stating
that fact is all that is required.
After the issues have been settled, I will need ten more copies of the EA for
the State Clearinghouse. I will prepare the FONSI here.

SUBJECT: Environmental Assessment (EA) for Harris Water
Treatment Plant Expansion, City of Eden, Rockingham
County, North Carolina.
The North Carolina Wildlife Resources Commission (WRC) has
reviewed the Environmental Assessment (EA) for the Harris Water
Treatment Plant Expansion for the City of Eden. Our comments are
based on reviews by biologists on our staff familiar with habitat
values of the project area, and are provided in accordance with
provisions of the North Carolina Environmental Policy Act (G.S.
113A-1 et seq., as amended; 1 NCAC 25) and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et
seq.).
The proposed project site is located on the Dan River near
the confluence with the Smith River in Rockingham County. This
section of the Dan River supports a sport fishery consisting
primarily of catfish, carp and suckers. However, sunfish,
largemouth bass, and two species of special concern, the bigeye
jumprock and riverweed darter may inhabit this section of the
river.

Dear Mr. Stewart,
We have been asked by Ms. Linda Sewall, Deputy Director of
the Division of Environmental Health, to respond to the comments
listed in your December 18, 1991 letter concerning the above
referenced assessment. In your letter, you pointed°o2 that there
has been identified two fish species of special concern, the
bigeye jumprock and the riverweed darter which may inhabit this
portion of the Dan River. The primary concern to each of the
species is an increased level of siltation in the river. The
siltation caused by construction will be temporary and minor. We
have submitted an Erosion Control Plan to the Division of Land
Quality for review.
Also of concern, is the opening size and withdrawal velocity
-of the new intake screens. The screen opening will be set at 1/8^
and the velocity through the screen will be limited to 0.5 fps at
the maximum withdrawal rate. An excerpt from the specifications
covering that part of the project has been included below:
5.3.INTAKE SCREEN ASSEMBLIES - The-intake screen assemblies
shall be a passive type design and of all AISI Type 304 stainless
steel, all-welded, continuous slot construction. 1glots shall
widen inwardly from the surface to minimize clogging. Each
assembly shall have a capacity of 8 MGD at a maximum through
screen velocity as a result of water withdrawal of not to exceed
0.50 feet per second. Pressure drop through the clean screen
surface, at rated flow, shall not exceed 0.1 psi. Slot opening
shall be 0.125 inch with a minimum corresponding open area of 64%.

The screen assembly shall be capable of withstanding a hydrostatic
differential pressure of 10 feet of water. Flange connection to
pipe shall be 30 inch pipe size and shall be drilled in accordance
with ANSI B16,L, Class 125.

Harris Water Treatment Plant Improvements

The State Environmental Policy Act (G.S. 113A-1 through 10) requires that
the Division of Environmental Health determine whether a proposed major agency
action will,significantly affect the environment. The proposed Water Treatment Plant
Improvements are such a major action.
In order to determine whether construction of the proposed improvements will
cause significant environmental impacts, an environmental assessment has been
prepared. This environmental assessment is attached. It contains detailed
information on the key issues, including a brief description of the proposed project
and a summary of probable environmental impacts. None of the impacts were found
to be significant.
On the basis of the analysis of the impacts as shown in the environmental
assessment, no environmental impact statement (EIS) will be prepared. This FONSI
completes the environmental review record which is available for inspection at the
State Clearinghouse.
Summary of FONSI for publication in the Environmental Bulletin: After
completion of an environmental assessment under G. S. 113A-1 through 1 C, a finding
of no significant impact (FONSI) has been made in the case of the proposed
improvements to the City of Eden's, Harris Water Treatment Plant. Information
supporting the need for the proposed project was reviewed, along with relative
impacts and costs of alternative approaches.

Through coordination with Mr. Steve Moran of Finkbeiner, Pettis & Strout,
Limited, we have learned of your plans to construct proposed improvements to
the City of Eden water treatment plant facility located offrth Bridge Street,
adjacent to the Dan River, Eden, Rockingham County, North Carolina.
Plans provided by Mr. Moran revealed your proposal to replace 2 existing
24" raw water intake screens with double tee assembly 36" raw water intake
screens within the Dan River. No discharge of fill would be required to
replace the aforementioned structures. Accordingly, Department of the Army
permit authorization will not be required for the screen modification.
However, the provided plans do reveal the proposed placement of 3.5" air
piping below river bottom grade to each of the new 36" screen structures.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 22, 1991, lists nationwide permits. Authorization was provided
for the discharge of material for backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in pre-
construction bottom contours and all excess material is removed to an upland
disposal area.
Your work, involving the construction of the aforementioned air piping in
association with the proposed raw water intake screen modifications, is
authorized by nationwide permit provided it is accomplished in strict
accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any other
required or local approval. You should contact Mr. John Dorney, North
Carolina Division of Environmental Management, [phone], to obtain the
necessary Section 401, Water Quality Certification prior to starting work.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or ij suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case base to modify,
suspend, or revoke the authorization.

This letter is written in response to our phone discussion
yesterday pertaining to the above referenced project.
As discussed, Mr. John Thomas of the U.S. Army Corps of
Engineers informed us that a "Section 404, Nationwide 12" Permit
is required on this job since new 3-1/2 inch air piping will be
buried within the Dan River. He has begun processing this 404
Permit. Since this permit is needed, a North Carolina 401 Permit
is also needed.
As directed, enclosed are seven copies of the plan sheet
showing the layout of this air piping at the Dan River. You
informed us there are no fees required with this permit. Please
proceed with issuing this permit.

Dear Mr. Moran;
On February 3, 1992, I received an application from you for a
401 Water Quality Certification for your project entitled
Eden Water Treatment Plant, at Eden, N.C. in Rockingham County.
Our existing regulations (15A NCAC 2H .0501 (a)) require that all
applicants for 401 Certifications submit seven complete copies of
401 Applications. These copies must be supplied by the Division
of Environmental management to various state and Federal agencies
as specified in the same regulations. Having copies available
for simultaneous review by other agencies will reduce the overall
processing time for your permit application. In the past, we
have not enforced this requirement and have seen processing time
slowed significantly.
Therefore, please send six additional copies of your 401
Certification application so we can initiate the comprehensive
review required by our rules. I am unable to do this copying
since there are numerous applications with this problem and our
regulations state that the applicant must supply these copies.
