On February 6, 2006, the Division of Water Quality (DWQ) received your application dated February 1, 2006 to
impact 0.295 acres of wetlands and 72 feet of stream to construct the proposed 48 lot residential subdivision. On
June 7, 2006, DWQ received a response to a request for additional information and the total impacts proposed
were reduced to 0.207 acres of wetlands. This response letter also stated that you were still preparing the draft
preservation language in the form of deed restrictions. Please provide the draft document and associated maps so
that we may continue to review your project. The project will remain on hold until we receive this information.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Cyndi
Karoly of the DWQ 401 Oversight Unit in the Raleigh Office. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at this
