Dear Ms. Lutheran:
Please reference Helmsdale Investors, LLC application for a Department of the Army
Individual Permit pursuant to Section 404 of the Clean Water Act to discharge fill material into
0.295 acres of Section 404 wetlands and 72 linear feet of an unnamed tributary to Howe Creek to
facilitate the development of the proposed Helmsdale at Landfall residential subdivision. This
40.5 acre project area is located within the Landfall community, along the southside of
Arboretum Drive, west of Deer Island Lane, in Wilmington, New Hanover County, North
Carolina. Please also reference your Public Notice response, dated April 12, 2006 (copy
enclosed for reference).
On June 7, 2006, we received a letter from the applicant in response to your concerns.
Please note that the applicant has reduced their proposed wetland impact to 0.207 acre and
eliminated the stream impact. They have also amended their mitigation proposal such that they
now propose to make payment to the North Carolina Ecosystem Enhancement Program for the
restoration of 0.25 acre of riparian wetlands, preserve 46.59 acres of wetlands (8.98 acres on-site
and 37.61 acres within the Landfall community) and 0.176 acre of on-site uplands. Please
review the enclosed information and provide the Corps your comments and concerns on or
before September 1, 2006.
