With reference to the subject project, Corps letter (I.D.
199300174) dated November 3, 1992, and NCDEM (Project # 92606) 401.
concurrance letter dated October 27, 1992, this work has essentially
been completed. In the final stages of this work, I have been contacted
about the need for the construction of a "static pole" on the east side
of the permitted road construction. The installation of the static pole
will require the driving of two parallel rows of 4 piling and the
construction of a reinforced concrete pile cap about 8' square by 7 feet
thick on top of the pilings.
Initially this work was proposed immediately off the edge of the
road as shown on the attached sketch. We considered the effort and
difficulty of constructing the pile cap in such a manner as to elevate
it above the wetlands in that. area, and generally decided that it could
probably not be accomplished in that location without filling the
wetlands and therefore without a permit.
At my suggestion, we are now proposing to shift the static pole
location 16 feet west into the area already filled for the road.
Although the road would become restricted at that point, it would still
provide access for service vehicles past the pole installation. The
attached sketch shows that proposed location and there is also a section
view showing the approximate dimenisions of the proposed pile cap.

This proposal will (1) avoid further wetland disturbance, (2)
maintain the usefulness of the newly constructed road, and (3) subject
to your agreement, avoid the necessity for additional permits.
Accordingly, we request that this work, within the existing road fill,
be considered a minor modification to the existing approvals and allowed
to proceed.

Dear Mr. Somers:
Please reference your application of October 23, 1992, and our October 29,
1992 telephone conversation regarding Department of the Army authorization to
construct a service road for your proposed electrical substation expansion
project within Section 404 wetlands, located within the Weyerhaeuser
industrial property off S.R. 1565, adjacent to Welch Creek, in Plymouth,
Martin County, North Carolina.
The application revealed that you propose to place fill material within
approximately 7,000 square feet (0.16 AC) of wetlands to construct a service
road to access your proposed electrical substation expansion project. The
proposed road is approximately 176 feet long by 23 feet wide. In conjunction
with the electrical substation expansion, you also propose to discharge 16.2
cubic yards of fill material within approximately 450 square feet (0.01 AC) of
wetlands for cable supports and transformer pads.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act-of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than 1/3 acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;

d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Your proposed service road is authorized by this NWP provided it is
accomplished in strict accordance with the enclosed conditions. This
NWP does not relieve you of the responsibility to obtain any required State or
local approval.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for discharges of dredged or
fill material into all waters of the United States provided:
a. The discharge does not exceed 25 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
C. If the discharge exceeds 10 cubic yards or the discharge is in a
special aquatic site, including wetlands, the permittee notifies the District
Engineer in accordance with the "Notification" general condition. For
discharges in special aquatic sites, including wetlands, the notification must
also include a delineation of affected special aquatic sites, including
wetlands and;
d. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project and is not placed for the
purpose of stream diversion.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.

This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of tile NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

Dear Mr. Dorney:
Confirming our telephone conversation this morning (Monday, 10/26),
I am sending you a revised PDN for the proposed work in wetlands related
to the "Electrical Substation Addition" at the Weyerhauser Plymouth
Plant in Martin County, N.C. This revised PDN replaces one furnished to
you on October 16, 1992.
The revision does two things:
1. The total area of wetland disturbance has been reduced from
approximately 14,200 square feet to approximately 7450 square
feet; a 50'/ reduction '. '.
2. It was noted in the earlier plan that some of the NWP 14 fill
was for the foundations of some of the electrical facilities
(transformer, cable supports, etc.). This revision eliminates
some of that earlier fill and requests the remainder (16.2 cu.
yds/450 sq. ft.) under the authority of NWP 18. The road
length has also been reduced as well as its overall fill area.
It is extremely important to Weyerhaeuser that construction.
commence as soon as possible. The Corps anticipates that they will be
able to approve this work on Thursday morning, October 29th, subject to
any Federal agency comments. I have already contacted the affected
Federal agencies to urge their early review of this project. As you and
I discussed, I would urge your agency review and approval also by that
time. The Weyerhaeuser people have worked hard to develop this revision
and the significant minimization of wetland impacts of this project and
I believe it fits well within the respective NWP's.

Thank you for our discussions today regarding the use of Nationwide
Permit 14 to allow the proposed construction of the subject project. I
furnished today by FAX an advanced copy of the plans and Predischarge
Notification to you and to Ms. Debra Sawyer (NCDEM). I also filed the
PDN with the District Office today.
As you know from your discussion with me and with Mr John Somers of
Weyerhaeuser, the Weyerhaeuser people have been confused about the
permit process and the time required for that process to run its course,
and have somehow set plans in motion to start this work very soon. I am
sure you I made it very clear to them as I did, that land disturbing
activity cannot proceed in the wetland area prior to the Corps and state
DEM concurrance that the nationwide permit applies to their proposal.
In an effort to assist Weyerhaeuser avoid as much delay as possible, I
have spent considerable time with their plans and in conversation with
Mr. Somers to express in the enclosed PDN, the Weyerhaeuser Company's
absolute commitment to abide by the stated conditions of. Nationwide
Permit 14.
It is my understanding that you will receive from them, by COB
October 16, a wetland deli_neati.on survey with metes and bounds of the
positions of the flags you placed in the field several weeks ago. I
also understand your need to visit the site again to verify the accuracy
of that survey, and that you will be unable to make that visit before
November 5, 1992.

I know it is critical that the wetlands be accurately surveyed and
depicted on any permit drawing, and I believe the plan you have does
that. The wetland line is only about 200 feet long and contains only
about 14 points, which, first of a11, considerably reduces the margin
for error that could occur. Secondly, the survey work was performed by
McKim and Creed Engineers of Wilmington, N.C., a highly skilled and
experienced engineering company professionally licensed by the state of
North Carolina whose work is bonded by their professional seal. I
believe the possibility for error here is highly unlikely.
Nevertheless, if field verification is required and indeed your schedule
wilt not allow a site visit within the next week, I would urge your
consideration to approval ofd the PDN with a condition that:
"...any work performed in reliance of the wetland survey prior
to the Corps verification that is found to be outside of that
area authorized by the Nationwide Permit will result in the
immediate stopping of all work in aft wetlands until. the
unauthorized area is completely restored to the Corps
satisfaction."
I certainly believe this condition would protect all of the Corps'
interests and also allow the Weyerhaeuser Company to begin their work
within the next week and honor their contractural. and scheduling
commitments that they, unfortunately, have made.
