Upon review of your request for Water Quality Certification
to place fill material in 0.01 acres of wetlands for temporary
road access across Pup's Branch located at Armstrong Fish
Hatchery on SR 1443, in McDowell County, we have determined that
the proposed fill can be covered by General Water Quality
Certification No. 2732 issued May 1, 1992. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide
Permit No. 26.

As 1 mentioned in our telephone conversation of August 4, 1992,
repni.rs to roads and water intakes has been initiated at
Armstrong Hatchery. The scope of this work was originally
limited to nctivities listed in the project description dated
April 22, 1992. However, after work was begun, our personnel
:found the need to cross a small stream (Pup's Branch) with heavy
equipment to ferry packing material to Site 9 of the project
description. Provision for crosning Pup's Brattoh was not
included in the original project plan.
To facilitate completion of our project, we propose to constr'uc't
n temporary road crossing at Pup's Branch. The crossing will
consist of one (1) 24-inch diameter iron pf-pe placed in the
stream hed of Pup's 11ranch and surrounded with coarse fill
material which will be sloped no ns to allow crossing with a dump
true):. It is anticipated the fill required will not exceed 15
yd?I. The temporary crossing will be removed upon completion of
the original work at Site 9.
To minimize the potential for habitat alteration, the pipe will
be placed on top of the stream bed rather than buried below the
surface of the stream bed. Coarse fill (.large gravel and rock)
will be used to limit sedimentation and allow for easy removal.
Only minor reshaping of the stream banks will be required. All
affected areas will be restored to their original configuration
upon project completion, approximately one week after the

week after disturbance occurs.
I have asked Ms. Stephanie Gaudreau, NCWRC Habitat SiologisL, for
recommendations to limit potential habitat destruction in
relation to this work and these are incorporated into the plan.

regarding this project.

SUBJECT: A review of an application by the NCWRC to place a
temporary pipe and associated fill in Pups Branch at
Armstrong Fish Hatchery, McDowell County
Dear Mr. Johnson:
The North Carolina Wildlife Resources Commission (NCWRC),
represented by Mr. Mallory Martin (Fish Production Coordinator),
is requesting a letter of concurrence to obtain a 404 permit from
the U.S. Army Corpd of Engineers. These comments are provided in
accordance with provisions of the Clean Water Act of 1977 (33
U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The NCWRC proposes to place a temporary pipe in Pups Branch
along with coarse gravel fill material in order,to provide short-
term access to a water intake structure for heavy equipment.
This intake, which serves part of Armstrong Fish Hatchery, is in
need of repair. The pipe and fill will be removed upon
completion of the repair work, which should be completed before
trout spawning season begins.
Pups Branch (CAT 7-12-3-9) serves as a trout nursery stream
to Armstrong Creek, which is Hatchery Supported Designated Public
Mountain Trout Water downstream of hatchery property. Armstrong
Creek provides good habitat for brook and rainbow trout.
This project should have minimal adverse impacts on the
fisheries resources of Pups Branch and Armstrong Creek. As the
permit applicant, we can assure you that adequate erosion and
sedimentation controls Will be used during all work performed and
that the sole purpose of the proposed work is to repair the water
intake. Consequently, we do not object to issuance of this
permit.

The Division of Environmental Management (DEM) received a
letter from the Corps of Engineers (COE) stating that your
project qualified for a Nationwide Permit. Please be advised
that the Nationwide Permit is not valid until a 401 Water Quality
Certification has been issued by the Division. General
Certifications have been issue by the Division for most of the
Nationwide Permits, however, several of the General
Certifications require written concurrence from the Division
before the Nationwide Permit is valid.
If you are utilizing Nationwide Permit # 26 and your fill
activity is equal to or less than one-third (1/3) of an acre you
are not required to obtain written concurrence. Otherwise please
complete the attached form (except for conditions 15 and 16) and
send six additional copies (a total of seven copies) so that the
review of your request can be initiated.
