Davis, N Assistant Fisheries Biologist DATE: December 2, 1992 Commission 919-733-3391 SUBJECT: A review of a 404 permit application by Mr. James A. McCauley to construct a dam and small pond on an unnamed tributary to Skeenah Creek off of SR 1128 near Franklin, Macon County. Mr. James A. McCauley FLA. 33308) is requesting Carolina Wildlife Resources a 404 permit from the U.S. biologist on the NCWRC staf provided by the applicant, and I of the project area. An onsite December 1, 1992, for the purpos construction impacts on wildlife comments are provided in accorda Water Act of 1977 (33 U.S.C. 466 Wildlife Coordination Act (48 St 661-667d). 25th Ave., Fort Lauderdale concurrence from the Nort (NCWRC) in order to obtai of Engineers. As a eviewed the information am familiar with habitat values investigation was conducted on e of assessing potential and fisheries resources. These nce with provisions of the Clean et. seq.) and the Fish and at. 401, as amended; 16 U.S.C. n Mr. McCauley proposes to construct a small dam and pond (1/4 acre) on an unnamed tributary to Skeenah Creek for irrigation and private recreation. Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant effects to waters supporting trout. However, the pond outlet structure (standpipe) should be designed to release cool water drawn off the bottom of the pond. This will ensure good water quality in the pond and provide cooler water to downstream habitats.
