Based on a field visit on 27 October 1992, we have determined that the wetlands (first terrace bottomland hardwood forest) provides the following significant uses - water storage, streambank stabilization, aquatic life, wildlife habitat and pollutant removal. This fill would remove those significant uses. Therefore we are moving toward denial of this Certification which would result in denial of the 404 Permit. We believe that a practicable alternative exists for this project other than filling the wetlands for the greenway trail, namely bridging of the wetlands. Please address whether bridging of these wetlands or relocation of the trail to avoid the fill are practicable alternatives. Please respond within two weeks of the receipt of this letter. Army Corps of Engineers Public Notice ID. 199203200 dated September 17, 1992 which describes a project proposed by the Mecklenburg County Parks and Recreation Department of Charlotte. The project description includes the filling of .35 acres of wetland along McMullen Creek in the r.nmple_tion phase of Phase II of the McMullen Creek Greenway Trail. 'T'his letter will serve as interim response inasmuch as the required Section 401 Water Quality Certification has not been issued and other agencies' objections have been submitted. During the course of the state agency review, the following comments of significance were submitted: Division of Environmental Management - by letter of October 30 requested the applicant examine alternatives to wetland fill, such as bridging. The writer understands that adequate response to the October 20 request has not been submitted. Immediate review of the matter is proposed by DEM; Wildlife Resources Commission - found that approximately 1250' of the trail encroaches into forested wetland and also provides for 12 intermittent stream crossings. The Commission recommended, as did DEM, that permit action be withheld until " .... additional measures have been taken to avoid and minimize impacts to wetlands along McMullen Creek"; Division of Control plan lations for plan should culverts are Land Resources - found that a Sedimentation and Erosion is required. "This plan should include runoff calcu- sizing all proposed culvert pipes under the trail.. The gravel will not afford adequate surface protection in these areas." He has asked me to respond. DEM issued a 401 Certification for the McMullen Creek Greenway Trail on 3 March 1993. The amount of wetland fill for this project has been reduced at our request by constructing a wooden walkway. The final plans are available for review in our Mooresville Regional office through Mr. Alan Hardy at 704-663- 6040. With respect to the turbidity standard, the applicant will be responsible for meeting the water quality standard. If DEM learns of potential violations and collects water samples which indicate a violation of the standard, then we will then be able to assess fines as necessary to assure compliance. Outside of the political issue on the propriety of altering this particular portion of land promoted to the public, and voted on by the public, as requiring protection, my personal concern is the effect of the fill material on my adjacent property. My not being an engineer makes it difficult to understand the survey documents I received so I cannot tell exactly where the proposed filling activity will take place. Since this area is a designated wetlands, a considerable area of drainage and runoff is required. I have enclosed photographs which depict current drainage problems and I am concerned that if existing runoff areas are destroyed with fill, then my property will be in further, and quite serious, jeopardy. NORTH CAROLINA Mecklenburg County CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Mecklenburg County Parks and Recreation Dept. pursuant to an application filed on the 25th day of September,1992 to construct construct McMullen Creek Greenway, Phase II. The Application provides adequate.assurance that the discharge of fill material into the waters of McMullen Creek and adjacent wetlands in conjunction with the proposed greenway in Mecklenburg County will not result in a violation of of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. Plans shall be as shown on your 18 February 1993 submittal. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 1st day of March, 1993. Outside of the political issue on the propriety of altering this particular portion of land promoted to the public, and voted on by the public, as requiring protection, my personal concern is the effect of the fill material on my ad3acent property. My not being an engineer makes it difficult to understand the survey documents I received so I cannot tell exactly where the proposed filling activity will take place. Since this area is a designated wetlands, a considerable area of drainage and runoff is required. I have enclosed photographs which depict current drainage problems and I am concerned that if existing runoff areas are destroyed with fill, then my property will be in further, and quite serious, 3eopardy. WAYNE WESTON, DIRECTOR, MEECKLIMURG COUNTY PARK AND RECREATION DEPARTMENT, 700 NORTH TRYON STREET, CHART=, NORTH CAROLINA 28202, has applied for a Department of the Army permit TO PLACE FILL MATERIAL IN WETLANDS ADJACENT TO MCMULLEN CREEK TO FACILITATE CONSTRUCTION OF PHASE II OF THE MC MULLEPI CREEK GRE NWAY TRAIL BETWEEN THE TIFTON DRIVE ACCESS AND THE cHARL(J= OUTER LOOP AT CHARLfJZr!'E, MECKLENBURG COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of approximately 6300 linear feet of 16-foot wide (bottom width) gravel surface trail extending south from the end of the existing trail to the right-of-way of the Charlotte Outer Loop Highway. The proposed trail alignment is largely on forested uplands. Along approximately 1250 feet of its length, however, the trail would encroach approximately 5 to 8 feet into the upper edge of forested wetlands vegetated with green ash, boxelder, sweet gum and red maple. An additional 300 feet of trail would cross wetlands at two separate locations. These areas are between stations 41+00 and 42+00 where it crosses a small perennial tributary stream and near station 49+00 where the trail reaches its closest point to McMullen Creek. The trail would also cross approximately 12 intermittent tributaries or ditches all of which would be culverted. Additional drainage structures are planned where there are no defined channels. The applicant has proposed constructing approximately 150 feet of elevated boardwalk as well as 490 feet of retaining wall to minimize encroachment into the most sensitive wetland areas. Approximately 500 cubic yards of earthen fill material and gravel would be placed into approximately .35 acres of wetland to extend this greenway trail which is part of Mecklenburg County's 1980 Greenway Master Plan. The purpose of the proposed work is to provide public recreation benefits and link several residential subdivisions with shopping areas along NC Highway 51 to the north and a planned sports facility at the McAlpine Wastewater Treatment Plant to the south. The centerline of the proposed trail has been surveyed, cut and flagged to facilitate field review. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, norwill a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. -2- This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. . 49 -3- Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after October 9, 1992. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. In particular, please address the practicality of shifting the trail alignment landward to avoid impacting wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. In particular, please design alternatives such as the use of elevated boardwalks or floating mats that would not require earthen fill. .?v 44V -2- c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practical measures. d. Because the project is located within the floodplain of McMullen Creek, please provide any information you have on the potential effects of the proposed trail to increase flooding of adjacent residential areas. This information is essential to our expeditious processing of your application and it should be forwarded to us by October 19, 1992. Also, a copy of this information must be sent to the North Carolina Division of Environmental Management to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act.
