Dear Sirs:
Reference is made to the meeting of February 4, 1992, with Mr. John
Thomas of my staff and Mr. Anthony Lester of Evans Engineering at the Oak Bend
Phase V Housing Development located off Old Oak Ridge Road, adjacent to an

unnamed tributary to Brush Creek, north of Greensboro, Guilford County,
Carolina. The purpose of this meeting was to discuss plans for a proposed
fill for lot development and a proposed sewer line installation for the
aforementioned subdivision, and to inspect the site for wetlands subject to
Department of the Army permitting authority.
The plans and profiles received on March 12, 1992, for the aforementioned
project revealed that you propose construction of a 8-inch sanitary sewer
below natural grade with a section that is elevated over waters of the United
States across an unnamed tributary of Brush Creek within a 20-foot construction
easement.
Title 33,
For the purposes of the Corps of Engineers' Regulatory Program,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided for the discharge
of material for backfill or bedding for utility lines, including outfall and
intake structures, provided there is no change in pre-construction contours.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. Please be
aware that this authorization does not relieve you of the responsibility to
obtain any other required or local approval. You should contact Mr. John
Dorney, North Carolina Division of Environmental Management, (919) 733-5083, to
obtain the necessary Section 401, Water Quality Certification prior to starting
work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity

complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP authorization, activities which have commenced (i.e.,
are under construction) or are under contract to commence in reliance upon the
NWP will remain authorized provided the activity is completed within 12 months
of the date of the NWP's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

The Division of Environmental Management (DEM) received a
letter from the Corps of Engineers (COE) stating that your
project qualified for a Nationwide Permit. Please be advised
that the Nationwide Permit is not valid until a 401 Water Quality
Certification has been issued by the Division. General
Certifications have been issue by the Division for most of the
Nationwide Permits, however, several of the General
Certifications require written concurrence from the Division
before the Nationwide Permit is valid.
If you are utilizing Nationwide Permit # 26 and your fill
activity is equal to or less than one-third (1/3) of an acre you
are not required to obtain written concurrence. Otherwise please
complete the attached form (except for conditions 15 and 16) and
send six additional copies (a total of seven copies) so that the
review of your request can be initiated.

Dear Mr. Michaels:
The Division of Environmental Management (DEM) is
responsible for issuing 401 Water Quality Certifications. On
July 2, 1992, we received an application from the Westminster
Company requesting 401 Certification for construction of a
sanitary sewer outfall in the Oak Bend subdivision.
A wetland delineation map showing all wetlands, streams, and
lakes on the property is to accompany the application (condition
17A). A map was not included in the application. Therefore, we
request that a plat map delineating wetlands for all phases of
the Oak Bend subdivision be submitted to me for all future 401
Certifications. Any additional fill in this development
(including the 0.05 acres described in the July 12, 1992 letter
from the Corps.) under Nationwide Permit (NW) 26 will require
written approval from DEM since you have already used NW 26 for
0.33 acres of fill.
On this date, I spoke to Mr. Anthony Lester of Evans
Engineering. Mr. Lester stated that earlier sewer line impacts
were included in Nationwide Permit 26 instead of NW 12. Mr.
Lester stated that he will contact Mr. John Thomas with the
Corps. of Engineers to resolve the problem. Please keep us
apprised of the development with the Corps.

Upon review of your request for Water Quality certification to
place fill material in 0.02 acres of wetlands for a road crossing and
sewer line located at Brush Creek, in Guilford County, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2732 and 2664 issued January 21, and May 1,
1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps of
Engineers' Nationwide Permit No. 14 and 12. This Certification does
not approve fill under Nationwide Permit No. 26. According to our
records you have used NW 26 to fill 0.33 acres of wetlands or waters.
Additional fill under NW 26 requires written confirmation from DEM.

We have received information concerning the above project from
the Division of Environmental Management.
We have conducted a search of our files and are aware of no
structures of historical or architectural importance located
within the planning area.
If there are any structures more than fifty years old on or
adjacent to the project site, please send us photographs
(Polaroid type snapshots are fine) of each structure. These
photographs should be keyed to a map that clearly shows the site
location. If there are no buildings over fifty years old on or
adjacent to the project site, please notify us of this in
writing.
There are no known archaeological sites within the proposed
project area. Based on our present knowledge of the area, it is
unlikely that any archaeological resources which may be eligible
for inclusion in the National Register of Historic Places will be
affected by the project construction. We, therefore, recommend
that no archaeological investigation be conducted in connection
with this project.
The above comments are made pursuant to Section 106 of the
National Historic Preservation Act of 1966 and the Advisory
Council on Historic Preservation's Regulations for Compliance
with Section 106, codified at 36 CFR Part 800.

aerial sewer line should not be a significant concern. The impacted
area in this plan appears to be less than 0.1 acre.

Reference is made to the meeting of February 4, 1992, with Mr. John
Thomas of my staff and Mr. Anthony Lester of Evans Engineering at the Oak Bend
Phase VI Housing Development located off old Oak Ridge Road, adjacent to an
unnamed tributary to Brush Creek, north of Greensboro, ord County, North
Carolina. The purpose of this meeting was to discuss plans for a proposed
fill for lot development and a proposed sewer line installation for the
aforementioned subdivision, and to inspect the site for wetlands subject to
Department of the Army permitting authority.
The meeting revealed that the site is located adjacent to an unnamed,
above headwaters tributary of Brush Creek. Site plans provided by Mr. Lester
on March 12, 1992 showed proposed impacts of 0.05 acre of jurisdictional
wetlands in association with development of Lots Nos. 159 and 160. This
impact is in addition to 0.33 acre of impacts in earlier phases of the
aforementioned subdivision. This addition gives a total of 0.38 acre of
impacts for all proposed subdivision phases.
For the purposes of the U.S. Army Corps of Engineers' Regulatory.Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and

c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your proposed work, involving adverse modification to less than an acre
(0.38 acre total for all phases to date) of waters of the United States
located above the headwaters of the aforementioned tributary, is authorized by
nationwide permit provided it is accomplished in strict accordance with the
enclosed conditions. Please be aware that this authorization does not relieve
you of the responsibility to obtain any other required or local approval. You
should contact Mr. John Dorney, North Carolina Division of Environmental
Management, (919) 733-1786, to obtain the necessary Section 401, Water Quality
Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Carolina. The purpose of this meeting was to discuss plans for a proposed
fill for lot development, road access, and a proposed sewer line installation
for the aforementioned subdivision, and to inspect the site for wetlands
subject to Department of the Army permitting authority.
The meeting revealed that the site is located adjacent to an unnamed,
above headwaters tributary of Brush Creek. Site plans provided by Mr. Lester
on March 12, 1992 showed that the construction of the road access for the
proposed Phase VI will involve a single crossing of the aforementioned
tributary. The site visit of the aforementioned road alignment showed that
the proposed road crossing would impact waters of the United States, but would
not include any impacts to special aquatic sites.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than 1/3 acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected high flows and the movement of
aquatic organisms;

d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval. Please contact Mr. John Dorney, North
Carolina Division of Environmental Management, telephone (919) 733-1786, to
obtain a waiver or water quality certification for the proposed work. This

The Division of Environmental Management (DEM) is
responsible for issuing 401 Water Quality Certifications. On
July 2, 1992, we received an application from the Westminster
Company requesting 401 Certification for construction of a
sanitary sewer outfall in the Oak Bend subdivision.
A wetland delineation map showing all wetlands, streams, and
lakes on the property is to accompany the application (condition
17A). A map was not included in the application. Therefore, we
request that a plat map delineating wetlands for all phases of
the Oak Bend subdivision be submitted to me for all future 401
Certifications. Any additional fill in this development
(including the 0.05 acres described in the July 12, 1992 letter
from the Corps.) under Nationwide Permit (NW) 26 will require
written approval from DEM since you have already used NW 26 for
0.33 acres of fill.
On this date, I spoke to Mr. Anthony Lester of Evans
Engineering. Mr. Lester stated that earlier sewer line impacts
were included in Nationwide Permit 26 instead of NW 12. Mr.
Lester stated that he will contact Mr. John Thomas with the
Corps. of Engineers to resolve the problem. Please keep us
apprised of the development with the Corps.

County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2671 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 26.
