HAROLD CLARK, 55 Cowee School Road, Franklin, North Carolina 28734, has applied for a Department of the Army (DA).after-the-fact permit TO CONTINUE A COMMERCIAL SAND DREDGING OPERATION ON THE LITTLE TENNESSEE RIVER AT LAKE EMORY IN Franklin, Macon County, North Carolina. This public notice does not imply, or other agencies, either favorable or performed; but it is issued to solicit which a final decision will be based. the outcome of this consideration. on the parts of the Corps of Engineers unfavorable opinion of the work comments on the factors listed above on Legal action has been suspended pending The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the hydraulic dredging, of an approximate 2000-foot reach of Lake Emory. An average of 6 feet of sand will be removed and pumped to an adjacent processing plant and stockpile area located across the river from the new Macon County landfill site. The applicant estimates the removal of approximately 100 cubic yards of sand per day. Runoff from the processing plant flows through a settling pond and empties into a wetland area before returning into the river. An approximate 1/8 acre area of the wetland has been filled at the processing site. The dredging operation began in March, 1992. The purpose of the work is to obtain sand for commercial sales. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested -3- r parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serve as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, DEM, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The DEM plans to take final action in the issuance of the Clean Water Act certification on or after June 25, 1992. The Application provides adequate assurance that the discharge of fill material into the waters of Lake Emory and adjacent wetlands in conjunction with the proposed sand dredging operation in Macon County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. Streambank vegetation shall not be disturbed except where absolutely necessary and shall be replanted as soon as possible. 3. A vegetative buffer shall be maintained between the stream and the operation site. Rainfall and process water not discharged through the wetland area shall be returned to the stream through the vegetative buffer. 4. The location of stock piles and any other site specific measures to eliminate erosion shall be taken as appropriate. Violations of any condition herein set forth shall result in revocation of this Certification. This location is just across the river from the Town of Franklin's wastewater treatment facility and the new Macon County la.ndf_i-11-. These permits typically require that t:lhe receiving stream turbidity in Class "C" waters not be increased to more than 50 NTU as a result of the discharge. This permit will allow 50,000 gallons of water per day to be returned to the stream. Army Corps of Engineers Public Notice Action ID X1199201996 dated May 28, 1992 describing a project undertaken by Mr. Harold Clark of Franklin. The activity, involving sand mining in the Little Tennessee River at Lake Emory, has been ongoing since March of 1992. The request is to authorize continued mining at the rate of 100 cubic yards per day. Based on a coordinated agency review, the state interposes no actual objection to the request. The writer finds it interesting that the applicant would undertake such activity in public trust waters without carefully reviewing regulatory requirements. The following agency comments are provided for your consideration should a permit be issued: Division of Environmental Health - expresses concern that sedimentation could effect area water supply. Careful monitoring of sedimentation should be a control provided in the permit; Division of Land Resources - finds no mining permit required; Wildlife Resources Commission - recommends sedimentation from the project be rigidly controlled; Division of Environmental Management - issued Water Quality Certifi- cation No. 2749 for this activity on July 6, 1992. This certification, for the record, includes important environmental safeguards that should be made a part of any permit issued. P.O. Parker, 404 Coordinator Division of Coastal Management FROM: Dennis Stewart, Manager Habitat Conservation Program DATE: June 23, 1992 ;ion C? aw_? jt?4p SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199201996, Request for an after-the-fact permit by Mr. Harold Clark to continue a commercial sand dredging operation on the Little Tennessee River at Lake Emory in Franklin, Macon County The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and biological field staff are familiar with the project site. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to continue to hydraulically dredge an approximate 2000-foot reach of Lake Emory. An average of 6 feet of sand will be removed and pumped to an adjacent processing plant and stockpile area located across the river from the new Macon County landfill site. The applicant estimates the removal of approximately 100 cubic yards of sand per day. Runoff from the processing plant flows through a settling pond and empties into a wetland area before returning into the river. An approximate 1/8-acre area of the wetland has been filled at the processing site. The dredging operation began in March 1992. The purpose of the work is to obtain sand for commercial sales. The Little Tennessee River in this area and downstream to Fontana Reservoir has been designated as critical habitat for the following species: spotfin chub Hybopsis monacha - state and federal threatened species, Little-wing pearly mussel Pegias fabula - state and federal endangered species, Appalachian elktoe Alasmidonta raveneliana - state endangered/candidate for federal listing, Tennessee pigtoe Fusconaia barnesiana - state endangered Memo Page 2 June 23, 1992 species, and Slippershell mussel Alasmidonta viridis - state endangered species. The Little Tennessee River downstream of the dam at Lake Emory provides excellent habitat for these species. Lake Emory itself has served as a catch basin for sand and silt resulting from poor land practices upstream. Therefore it is unlikely that this project will adversely affect these species provided sedimentation is adequately controlled so as not to affect the Little Tennessee River downstream of the dam.
