Average stream flow of 0.06 c,fs discharges directly to Killian Creek. Flat alluvial area approx 400 feet long where stream meanders and sloughs exist is a wetland and was delineated by the Corps of Engineers. Primary vegetation is alder with scattered maples and gums, herbaceous stratum includes needlerush, spotted touch, me nots. various others. When tributary area is stabilized, sediment will be removed one last time and the riser & barrel discharge will be reworked into a permanent control structure that will keep water depth behind the dam at approximately 3 feet. Ir_ is expected that the resultant ponded area will create a marshland environment in excess of 0.5 acres which will span the project transmission line tie-in corridor. Area: Transmission Line Strain Tower Base Total area of impact: < 0.01 acres Description of area: A 15 ft by 15 ft area will be cleared for the installation of a piling foundation to support the strain tower. The area is adjacent to a large wetland area, but is hydrologically separate being a spring head located at a higher elevation. Flow is negligible as there is no surface outflow from the area, only permanently standing water. Thus, this impact will be upon waters isolated from waters of the United States. Huffman GS Environmental Division Duke Power Company Post Office Box 1007 Charlotte, North Carolina 28201-1007 Dear Mr. Huffman: Thank you for your letter of June 3, 1992, regarding your plans to construct a raw water storage pond, three temporary sediment retention basins, and a transmission line tower base at the proposed Lincoln Combustion Turbine Station off S.R. 1511 (Old Plank Road) west of Lowesville, Lincoln County, North Carolina. The raw water storage pond and one sediment basin would be located on an unnamed, headwaters tributary to Anderson Creek while the remaining two sediment basins and the 15-foot square tower base would be located on two unnamed, headwaters tributaries to Killian Creek. The total impact area to waters and wetlands would be .6 acres. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. Region Coordinator Habitat Conservation Programs?'?` DATE: February 11, 1993 SUBJECT: Application for 401 Certification by Duke Power Company for construction of an intake and outfall in Killian Creek, Lincoln County This correspondence responds to a request by you for our comments regarding the application for 401 Certification by the Duke Power Company for construction of an intake and outfall in Killian Creek to serve the Lincoln Combustion Turbine Station. The intake will be built adjacent to Killian Creek and the outfall will be located approximately 100 feet downstream of the intake structure. The North Carolina Wildlife Resources Commission (NCWRC) has the following recommendations: 1) The N.C. Division of Water Resources should be consulted if they have not been already to determine how much water can be removed from Killian Creek without adversely impacting aquatic habitat in the stream. Contact is Mr. Steve Reed at 919/733-4064. 2) Construction must be accomplished so that wet concrete does not contact stream water. Box 29535 Raleigh, NC 27626-0535 Re: Duke Power Company Lincoln Combustion Construction of Raw Sediment Control Application for 401 File: 01-1407.04 Turbine Project Water Storage Pond Dam and Structures Under NWP No. 26 Water Quality Certification Concurrence Dear Mr. Dorney: In order to provide water for plant operations and to control sedimentation from land disturbing activities, Duke Power Company intends to construct several retention structures on our 700+ acre power plant site in the Lincoln County township of Lowesville, NC. In addition to these structures, we intend to construct a pile-type foundation for a large transmission line tower. All these activities will require either the placement of fill into streambeds or wetlands or the inundation of these same streambeds or wetlands. Said fill or inundation of jurisdictional waters will not exceed 0.6 acres in total and in no cases do flows of the subject streams exceed 0.7 cfB under normal conditions. For further information please see the attached summary and plans. After several site consultations with Corps of Engineers Asheville Field office representative, Mr. Steve Lund, as well as representatives of the US Fish and Wildlife Service, NC Wildlife Resources Commission, yourself and other NCDEM representatives, we elected to revise a previous project configuration which would have necessitated the destruction of 2 acres of forested wetland for the construction of a sedimentation basin. This configuration revision was accomplished only after considerable expenditure of engineering effort and will necessitate significant increased material costs for construction, but it was done based on our understanding that the best mitigation of our impacts on the existing wetlands would be accomplished by avoidance and protection of those wetlands. We believe that the resulting project configuration will preserve these sensitive environments to the greatest extent possible while allowing the regional economic growth this plant is intended to support. Because all our impacts occur either above the headwaters or within isolated waters of the drainage basin where the project is located, and because the total area to be impacted is less than 1 acre, we believe that our activities fall well within the provisions of Nationwide Permit No. 26 as described in 33 CFR 330.6 revised 11/22/91, and that they meet all the conditions of compliance therein. Accordingly, we have applied to the Corps of Engineers for certification of this activity under the Nationwide Permit Program. We have further reviewed the conditions placed by your office on General 401 Certification of this activity and we believe that this project as planned is in full compliance with them and will have no trouble remaining within compliance through all phases of construction. Please consider this letter and attachments as formal notification of our intent to perform these activities and a request that you supply written concurrence of our compliance. You will find attached seven copies of the form recommended for Nationwide Permit Concurrence by your office as well as a summary, maps and plans of the relevant areas of the project.
