Dear Mr. Temple:
Reference your application for Department of the Army (DA) authorization
to undertake maintenance discing activities within Marsh Impoundment 4 (MI-4)
resulting in the discharge of fill material (redistribution of soil) within
the existing marsh impoundment unit located at Mattamuskeet National Wildlife
Refuge, de, County, North Carolina. The purpose of the maintenance discing is
to maintain vegetative species of grasses and sedges in early successional
stages to benefit migratory waterfowl. This activity is a continuation of
ongoing waterfowl management practices within the refuge.
On March 23, 1992, we issued general permit, Action ID No. 199200!'7,
(copy enclosed), that authorizes the discharge of dredged or fill material
resulting from the following activities on federal or state owned property,
and, when performed by the U.S. Forest Service or N.C. Division of Forest
Resources, on privately owned land, within non-tidal waters of the United
States in the State of North Carolina: (1) Discing of soils for the purpose of
maintaining regularly maintained existing firebreaks. (2) Discing of soils for
the purpose of continuing ongoing, site specific, wildlife management
activities where discing is used to manipulate habitat and feeding areas for
native species of fauna and flora. (3) Discing of soils for the purpose of
creating a new firebreak when approved by the District Engineer on a case by
case basis. (4) The use of a fire plow for the purpose of fire control for a
prescribed burn when approved by the District Engineer on a case by case basis
provided that preconstruction contours are immediately reestablished upon
conclusion of the specific prescribed burn. (5) The use of a fire plow for the
purpose of fire control during emergency fire fighting situations provided
that preconstruction contours are immediately reestablished upon conclusion of
the emergency.

Your proposed work is authorized provided that you comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. This Department of the Army general permit does not
relieve you of the responsibility to obtain any other required State or local
approval.

the required State authorizations prior to starting work: Mr. John Dorney,
North Carolina Division of Environmental Management, telephone (919) 733-1786,
and Mr. Steve Benton, North Carolina Division of Coastal Management, telephone
