segment of U.S. 52 between Lexington and Welcome,
Permit SAWCO86-N-029-0549 Extension Request.
The subject permit, which was issued the North Carolina
Department of Transportation on March 26, 1987, and renewed
on January 3, 1991, expired on December 31, 1991. It has
come to my attention that work in the permitted area is not
yet complete. Therefore, it is requested that this permit be
extended. Project plans remain unaltered from our original
permit application.

Upon review of your request for Water Quality Certification
to place fill material in 1.6 acres of waters and wetlands for
development of the Dvaidson County landfill located at
SR 2014 in Davidson County, we have determined that the proposed
fill can be covered by General Water Quality Certification No.
2671 issued January 1, 1992. A copy of the General Certification
is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

SUBJECT: Davidson County Landfill
401 Certification No. 92378
Davidson County
WSRO has reviewed the 401 Certification application for
the construction of a new landfill in Davidson County. The
project will only impact 1.6 acres of wetlands. Please note
that although a site visit was not conducted, the site was
previously inspected in February 1991.
The tributaries that will be affected by the project
are above headwater tributaries and are not even indicated
as flowing streams on the USGS topographic maps. Due to the
small area of wetlands will be impacted and the fact that
the landfill activities will destroy all surrounding
habitat, WSRO recommends that the necessary certifications
be issued for the project.

we have compared your site location for a Davidson County
landfill with our mapped data of occurrences of rare and
endangered species and locations of natural areas. No such
special natural resources are reported for this area, though this
is most likely the result of no biologists having ever visited
the area. In general, we have very little information from
Davidson County. If any part of the site were to hold potential
for rare or endangered species it would probably be the slopes
along Hamby Creek.

Thank you for your letter transmitting the archaeological survey report
by Archaeological Research Consultants, Inc. (ARC) concerning the above
project.
Contrary to comments expressed in your letter of February 23, 1990,
indicating that the ". . . 393.5-acre project area is also the proposed
survey area," and that "more intensive survey efforts will focus on the
more level floodplains and ridgetops," we note that the consultant actually
limited investigation to the "construction area." The "buffer zone" and
"floodplains" were excluded from intensive investigation, but "were checked
through walkover surveys, whenever they were accessible." No specific
indication is given concerning which areas were actually investigated.
Because of this situation we are unable to consider clearance for the entire
project, but only for that which has been subjected to intensive study.
During the course of the survey sixteen sites were identified. None were
considered significant according to the National Register of Historic Places
criteria and the consultant recommended no further work be conducted for the
project. In our opinion, none of the sixteen sites identified is potentially
significant. However, because the methodology employed in the study
failed to intensively investigate portions of the buffer zone and floodplains,
we cannot exclude the possibility that potentially significant sites might
exist in these areas. Should future plans call for expansion in the buffer
zone or in the floodplains, an intensive archaeological investigation should
be undertaken. Current plans for the "construction area" may proceed without
additional investigation.

the May 24, 1991 wetlands survey verification of the proposed Davidson County
Land Fill adjacent to an unnamed tributary of Hamby Creek and Rick Fork Creek,
east of Lexington, Davidson County, North Carolina.
Reference is also made to the conceptual design for the aforementioned
project received from Mr. Mark N. Hargrove of Camp Dresser & McKee
(engineering consultant for project) on February 13, 1992. This proposed
project design showed jurisdictional impacts of approximately 1.3 acres on
unnamed/above headwater tributaries of Hamby Creek.
Your proposed placement of this fill material may qualify for Federal
authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please
review the enclosed pre-discharge notification (PDN) application form package
and follow the outlined application form procedures.
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization.

Reference the meeting on September 5, 1990, with Messrs. John Thomas and
Ken Jolly of my staff; Messrs. Pete Wallace and Mike Babuin of Camp Desser and
McKee; Mr. Bland Moore of Davidson County Sanitation Department; and Mr. Jim
Adams (surveyor for Davidson County) onsite of the proposed Davidson County
Land Fill adjacent to an unnamed tributary of Hamby Creek and Rick Fork Creek,
east of Lexington, Davidson County, North Carolina. The purpose of this
meeting was to inspect the site for waters and wetlands subject to Department
of the Army permitting authority. This letter also confirms the May 24, 1991,
wetlands survey verification.
Based upon aforementioned onsite inspections and review of the
aforementioned survey, we recognize this surveyed alignment to be the limits
of our regulatory jurisdiction on the property. Unless there is a change in
the law or our published regulations, this determination of the limits of
wetlands may be relied upon for a period not to exceed three (3) years.
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization.
Impacts to delineated wetlands will require further review by this office.

CDM is submitting an application for a Section 401 Water Quality permit for impacting
approximately 1.6 acres of wetlands at the proposed sanitary landfill located east
Lexington in Davidson County, North Carolina.
First, let me give you a brief history of the site. The wetlands were staked out by our
wetlands subconsultant, Peter M. Wallace, Ecologist, from 7/25/90 to 8/2/90, and from
8/30/90 to 9/5/90. The field staking was approved by Corps of Engineers in the field on
9/5/90. A letter approving the survey alignment to be the limits of Corps of Engineers
regulatory jurisdiction on the property was received on 6/17/91. A letter dated 3/24/92
was received referencing the conceptual design which was sent to John Thomas of the
Raleigh Regulatory Field Office of the Army Corps of Engineers. Both of these letters
are included in the application package. Originally, 1.3 acres were proposed to be
impacted, but this number has been increased to 1.6 acres. CDM had a meeting with Ron
Ferrell, Wetland Scientist of the North Carolina Division of Environment, on February
13, 1992. After reviewing the conceptual plans for the landfill, he did not believe there
would be a problem with obtaining a permit to impact wetlands from the state of North
Carolina. A letter and map of the conceptual design of the landfill was sent to Eric
Galamb, field inspector in Winston-Salem, so he could inspect the site before he moved
to the Raleigh office. I hope this information will clarify any questions you may have
about the site.
Enclosed is the joint application form for impacting wetlands required by the Army Corps
of Engineers and Division of Environmental Management. Answers to some of the
questions are expanded in this letter.

Question #14 wants to know why the applicant believes that the proposed activity must
be carried out in wetlands and what measures will be taken to minimize wetland impacts.
This question is answered by stating that the amount of wetlands which are to be
impacted is very small when compared with the total number of acres of wetlands on site.
Only approximately 1.6 acres out of 20-25 acres of wetlands will be impacted. The
majority of the proposed impacted wetlands are considered "bed and bank" wetlands and
are in the center of the proposed site of the landfill. If these wetlands were not allowed
to be impacted, the expected life of the proposed landfill would greatly be reduced. The
drainage feature located in the center of the site, which is also "bed and bank" wetlands,
will not be needed once the landfill is constructed.
Question #15 asks to contact the U.S. Fish and Wildlife Service (USFWS) and/or National
Marine Fisheries Service (NMFS) regarding the presence of any federally listed or
proposed for listing endangered or threatened species or critical habitat that my be in the
permit area. Neither of these agencies were contacted but the North Carolina Department
of Parks and Recreation, Natural Heritage Program were contacted and they reviewed a
map of the proposed landfill location and did not have any endangered species on record
that may inhabit the area. They recommended that a study would not be needed. A copy
of this letter is included.
Question #17 asks for additional information about the site.
(A) A wetlands delineation map is provided showing all wetlands and streams on the
property. The wetlands which are to be impacted are hatched in a different pattern than
the undisturbed wetlands. The limits of wetlands were approved by the Army Corps of
Engineers in a letter dated June 17, 1991. A copy of this letter is included.
(B) There are no photographs available showing the wetlands which are to be impacted.
(C) Data sheets are included which show the delineation line of the surveyed wetlands.
The data points for the wetland line at traverse #1 and traverse #2 are for the proposed
landfill site.

(D) A storm water management plan is proposed for this project, but due it being in the
initial stages of design, a final storm water management plan is not available. A
conceptual plan showing the perimeter access road, which will surround the proposed

Reference is made to my letter of June 17, 1991. This letter confirmed
the May 24, 1991 wetlands survey verification of the proposed Davidson County
Land Fill adjacent to an unnamed tributary of Hamby Creek and Rick Fork Creek,
east of Lexington, Davidson County, North Carolina.
Reference is also made to the conceptual design and permit application
(PDN) for the aforementioned project received from Mr. Mark N. Hargrove of
Camp Dresser & McKee (engineering consultant for project) on July 16, 1992.
This proposed project design showed jurisdictional impacts of approximately
1.6 acres on unnamed/above headwater tributaries of Hamby Creek.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. the discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. the permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. the discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.

Your proposed work, involving adverse modification to 1.6 acres of waters
of the United States located above the headwaters of the aforementioned
tributary, is authorized by nationwide permit provided it is accomplished in
strict accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any other
required or local approval. You should contact Mr. John Dorney, North
Carolina Division of Environmental Management, (919) 733-5083, to obtain the
necessary Section 401, Water Quality Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Conceptual Design of the Davidson County
Sanitary Landfill for Wetlands Evaluation
CDM is providing the conceptual design for the proposed Davidson County Sanitary
Landfill. CDM met with Ron Ferrell of the Raleigh office and discussed proposed
activities that may take place at the site. Davidson County has not determined how they
want to develop the entire site. On the enclosed topo map of the site, the maximum
amount of wetlands which would be disturbed is highlighted. The conceptual design
sheet is provided in an effort to assist you in evaluating the proposed site for wetlands.
It is estimated that only ± 1.6 acres of wetlands will be disturbed. Please do not hesitate

Reference is made to my letter of August 3, 1992. This letter authorized
the discharge of fill associated with the Davidson County Land Fill within
waters of unnamed tributaries of Hamby Creek, east of Lexington, Davidson
County, North Carolina.
Reference is also made to a revised grading plan for the aforementioned
project received from Camp Dresser and McKee (engineering consultant for
project) on November 22, 1993. This proposed project design included three
sediment control basins that would require an additional 0.15 acre impact to
the aforementioned waters and wetlands. This impact would be in addition to
the 1.6 acres of impacts, giving a total impact of 1.75 acres on the
referenced unnamed/above headwater tributaries of Hamby Creek.
Final reference is made to a second revised grading plan received from
Camp Dresser and McKee on December 13, 1993. This proposed project design
included one additional control basin and two slope fills that would require
an additional 0.18 acre impact to the aforementioned waters and wetlands.
It should be noted that all wetland impacts resulting from the aforementioned
slopes and basin are temporary and that these wetland areas are to be restored
upon completion of the grading work. This impact would be in addition to the
1.75 acres of impacts, giving a total impact of 1.93 acres on the referenced
unnamed/above headwaters tributaries of Hamby Creek.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
