Upon review of your request for Water Quality Certification
to place fill material in 0.1 acre of wetlands or waters for
commercial development located at Hwy. 54 and SR 1999 in Durham
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2671 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 26.

The purpose of this letter is to inform you of our intention to
utilize a General 401 Water Quality Certification for the project
to be known as. the Wachovia RTP property. The property is located;
north of N.C. Hwy. 54 east of S.R. 1999 (Davis Drive) and south of
1-40 (see attached USES Topo) The'. only jurisdictional areas on
site are channels which qualify as Waters of the U.S. and a swale
at the toe of the existing slope that contains cattails. The
jurisdictional areas are along unnamed tributaries to Burdens
Creek,
The approximate dimensions of the jurisdictional areas are
shown on the attached map. These delineations were reviewed by
Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers. Due to the
poor quality and small size of the jurisdictional areas we do not
believe it is necessary to survey the proposed impact area in
detail because it would be an unjust cost for our client. Mr.
Alsmeyer agreed with this conclusion.
Fill in less than 1/3 acre of Waters of the U.S. on-site will be
required to utilize the property for a commercial development
including road access, parking etc., similar to surrounding
properties.
It will be necessary to fill approximately .l acre of
jurisdictional Waters of the U.S. above headwaters for placement
of the proposed facilities. The waters to be filled are contained
within channels bounded by uplands but still technically qualify
as jurisdictional Waters of the U.S. These areas do not appear to
be of a_high quality.
Please call if you have questions or require further information.
We realize that ourclient is not required to notify you for fills
less than 1/3 acre above headwaters but we have chosen to do so
for the record and as a professional courtesy.
