A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. An additional condition is that the lake elevation at site Number 1 must be restored to the original elevation after construction. Regulatory Branch Action ID. 199300703 and Nationwide Permit No. 26 (Headwaters and Isolated Waters) City of Durham Attn.: Mr. Ken Wright, Engineering Department 101 City Hall Plaza Durham, North Carolina Dear Mr. Wright: City Engineer 27701 Reference your application of December 4, 1993, for Department of the Army authorization to discharge fill material within waters of the United States, and adjacent wetlands, causing the loss of 4.40 acres of waters of the United States and adjacent wetlands, above the headwaters, and within the drainage basins of Northeast and Third Fork Creeks, for the construction of Martin Luther King Parkway, from NC 55 to Cook Road, in Durham, Durham County, North Carolina. Reference is also made to F.T. Green and Associates letter, dated December 16, 1992, providing revised drawings and acreage impact calculation for the project. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge 'does not cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. f . . Z s -2- This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. How was the 3.20 acres of wetland impacts computed? 2. Are there additional impacts to Lake Cook from a proposed dam relocation which is not indicated on the submitted plans? 3. Does the 3.20 acres include the additional impacts to Lake Cook, as well as those shown on the drawings? In addition, we recommend that you provide the following information to assist our review of your application: 1. Justify the need for a 110-foot-wide right-of-way for a portion of the parkway, as opposed to the 60-foot-wide portion at NC 55. Future approval of an interchange at NC 55 cannot be assumed. 2. Justify the need for the parkway segment between Fayetteville Road and Cook Road. Future approval of connections to other roadways cannot be assumed. -2- Please furnish the requested information to this office by December 31, 1992. The proposed plan will require the dam to be moved up stream from its current position. This will eliminate a proximately 1.8 acres of Cook Lake. I do not feel that the propos ed 'impact will be a problem. However I recommend that a condition of the permit should include returning the lake depth to its previous level . This would prevent negatively impacting wetlands located near the mouth of the lake. site 2} - see rating system worksheet- Mixed hardwood bottoms adjacent to current dam structure. Predominant overstory canopy is sycamore (Plantanus occidentalis), sweetgum (Liquidambar styraciflua), and red maple (Acer rubrum). This area is likely a utilized as a corridor for both game and non-game wildlife species, site 3} Hardwood bottom. The most of the wetland habitat encountered at this site was associated with the stream bank. The rest of the wetland habitat at this site been severely impacted by a sewer line. This site will result in a very minor wetland habitat impact. site 4} - see rating system worksheet- Hardwood bottom. Predominate plant species are White oak (Quercus alba), Loblolly pine (Pinus taeda), and Smilax qW. The juxtaposition of an adjacent stand of loblolly pine, which roughly parallel the creek bottom, provides good edge habitat for wildlife. Although this bottom is likely a locally valuable corridor, the wetland habitat that will be impacted is minor. site 5}- see rating system worksheet- A nice mixed hardwood bottom. Predominate overstory species are white oak (Q. alba) , Scarlet oak (Q. coccinea), and Sweetgum (Liquidambar styraciflua}. The predominate understory species are sourwood (Qxydendrum arboreumbeech (Fagus grandifolia), and Smilax spy. This area not only provides a variety of mast producing species for wildlife but it is also an important corridor. The area also has relatively high pollutant removal potential. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by the District Engineer, or b. If notified that an individual permit may be required, or c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer and no notice has been received from the District Engineer, and required state approvals have been obtained. November 17, 1992 Justification for the Martin Luther King, Jr. Parkway The City of Durham began working with the Corps of Engineers in 1988 to locate the proposed Martin Luther King, Jr. Parkway route with as little effect as possible to wetlands. At that time, City staff worked with Ms. Cathy Trott and Mr. Ken Jolly. At the point where the proposed roadway was to cross just below the Lake Cook Dam, the City agreed to move the roadway to the north into the existing dam (requiring reconstruction at great expense) in order to miss existing wetlands below the dam. In every case, the City has attempted to locate the roadway to provide as little impact as possible to wetlands. The proposed Martin Luther King, Jr. Parkway is one of the most important elements of the Durham Thoroughfare Plan. It is the only new major east-west thoroughfare planned for the area between the Durham Freeway and I-40 and is projected to carry 30,000 vehicles per day at Hope Valley-Road, and 50,000 vehicles per day at N. C. #55 by the year 2010. MLK's primary function will be to provide an intra-City corridor linking large areas of existing and planned residential development in southern and southwestern sections of the City with the region's largest employment area, the Research Triangle Park. Delays in constructing MLK Parkway will be increasingly noticeable on existing corridors including Archdale Drive (east of Hope Valley Road), South Roxboro Street (south of Cornwallis Road), Cornwallis Road, and Fayetteville Street. Development occurring in the area has created significant traffic volume increases along these roadways which are reaching their designed capacities. For example, Cornwallis Road traffic volumes increased by 65% in eight years from 4,900 vehicles per day in 1980, to 8,100 vehicles per day in 1988. Capacity is 12,000 vehicles per day. Volumes will continue to increase with the build-out of Hope Valley Farms and other developments along Fayetteville Road and Cook Road. The construction of this project was reflected in the area's 1991 Air Quality Conformity Analysis. The Analysis, as required by the Clean Air Act Amendments of 1990, determined that the completion of this project would contribute to an overall reduction in vehicle emissions. As these facilities approach capacity, the alternative to constructing a new corridor will be to widen an existing hodgepodge of two-lane thoroughfares, many of which cross major streams. The NCDOT computer model was used to stimulate the 2010 thoroughfare system without MLK Parkway. The projected volumes on the remainder of the system would require: widening Garrett Road to five lanes; widening Cornwallis Road between University Drive and South Roxboro Street to five lanes; and widening Cornwallis Road from Fayetteville Street east into the Park to five lanes. In addition, there will be significant increased traffic volumes on residential collector streets such as Obie Street, Carpenter Fletcher Road, Cook Road, and Woodcroft Parkway. Such alternatives would include significantly higher construction costs and social impacts than the construction of MLK Parkway. The Parkway is a major feature in the Council's growth management strategy and has been such since the mid 1980's. The 1984-90 Capital Improvement Program (CIP) adopted by City Council in 1984 was a major effort by Council to begin "directing" growth to areas of the City most suited for it. The Southern Durham and downtown areas were strategically selected due to the desire to promote downtown and to prepare better to accommodate the expected job boom in the Research Triangle Park area and in the South Square area. The Southern Parkway (at that time) was one of the centerpieces of that strategy. Following that, the Durham. 2005 Comprehensive Plan adopted by City Council in 1985 strongly endorsed the downtown area and southern area growth priority areas, urging the placement of key public investments in those concentrated areas. In 1986, the Council adopted the South Durham Plan, which recommended the construction of the (then) Southern Parkway as soon as possible to handle the traffic to be generated from land uses projected in the area so that existing roads would not be overloaded. The 1986 Bond Issue was designed and funded at a level to specifically provide funding for the Parkway. It is strongly felt that the benefits to the public gained from the construction of this roadway far outweigh the + 3.2 acres of wetlands taken during construction. R.
