General Certifications have been issue by the Division for most of the Nationwide Permits, however, several of the General Certifications require written concurrence from the Division before the Nationwide Permit is valid. Mr. Reijo Rainulainen 430 Cooper Creek Road Bryson City, North Carolina 28713 Dear Mr. Rainulainen: Reference your application of July 10, 1992, for Department of the Army authorization to construct a concrete intake structure adjacent to Little Snowbird Creek and to stabilize approximately 175 linear feet of„creekbank at your trout rearing facility off S.R. 1115 near Robbinsville, Graham County, North Carolina. The intake is to supply five fingerling tanks in expansion of your trout business. The proposal has been reviewed by the N.C. Wildlife Resources Commission (WRC) for potential adverse impacts to trout waters. For the purposes of the U.S. Army Corps of Engineers, Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits.(NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for bank stabilization activities provided: a. No material is placed in excess of the minimum needed for erosion protection; b. The bank stabilization activity is less than 500 feet in length; c. The activity will not exceed an average of one cubic yard per running foot placed along the bank below the plane of the ordinary high water mark or the high tide line; d. No material is placed in any special aquatic site, including wetlands; e. No material is of the type or is placed in any location or in any manner so as to impair surface water flow into or out of any wetlands area; f. No material is placed in a manner that will be eroded by normal or expected high flows; and g. The activity is part of a single and complete project. s ' -2- For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CPR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act, was provided for discharges of dredged or fill material into all waters of the United States provided: a. The discharge does not exceed 25 cubic yards; b. The discharge will not cause the loss of more than 1/10 acre of a special aquatic site, including wetlands. For the purposes of this nationwide permit, the acreage limitation includes the filled area plus special aquatic sites that are adversely affected by flooding and special aquatic sites that are drained so that they would no longer be a water of the United States as a result of the project; C. If the discharge exceeds 10 cubic yards or the discharge is in a special aquatic site, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected special aquatic sites, including wetlands' and; d. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project and is not placed for the purpose of stream diversion. Your work is authorized by these nationwide permits provided it is accomplished in strict accordance with the enclosed conditions, and those outlined in the attached August 24, 1992 WRC letter. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. DATE: August 24, 1992 SUBJECT: Review of a 404 permit application by Mr. Reijo Kainulainen of Hemac, Inc., to construct a concrete water intake for a trout rearing facility and stabilize approximately.175 feet of stream bank on Little Snowbird Creek off of SR 1115 near Robbinsville, Graham County Mr. Reijo Kainulainen of Hemac Inc., (430 Coopers Creek Rd. Bryson City, NC 28713) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC)' in order to obtain a 404 permit from the U.S. Army Corps of Engineers. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as-amended; 16 U.S.C. 661-667d.). Staff field biologists of the NCWRC have reviewed the information by Mr. Kainulainen, and an onsite investigation was conducted on August 13, 1992, for the purpose of assessing potential construction impacts on wildlife and fisheries resources. The applicant is requesting authorization to construct a 4-foot wide by 4-foot high by 20-foot long concrete screened intake structure along the edge of Little Snowbird. Creek. The intake will,,be,designed so that the stream side of the structure will be 1 to 1.5 feet lower than the other side to return overflow to the stream. Water is to be diverted through a series of five circular earthen ponds about 10 feet in diameter and through a settling pond prior to returning to Little Snowbird Creek. The applicant proposes to stabilize a 175-foot by 3-foot section of stream bank along the site..of the hatchery to provide 4 4 1 _J5 protection against future bank erosion. The purpose of the work is to create a facility for commercial trout production. . Little Snowbird Creek (LTN 1-2-2-22-6-6) is not Designated Public Mountain Trout Water; however, it does support wild rainbow and brown trout populations and may support a wild brook trout population in the headwaters. This stream is about 25 feet wide at the project site and has a substrate of large boulders, cobble, with moderate sand/silt. Riparian vegetation at the site has been removed, but was dominated by rhododendron,,Rhododendron maximum, yellow birch, Betula alleghaniensis, and hemlock, s a canadensis. No federal or state listed threatened.or endangered species are known to be present. This project may cause short- term turbidity during construction and could be detrimental to aquatic organisms if raw concrete escapes into the stream. . Our primary concern is the present dam/intake structure serving the lower hatchery facilities, which acts as barrier to fish movement upstream. This structure consists of a 4-foot high by 20-foot long dam constructed out of boulders and cobbles which spans the entire stream. The NCWRC is also concerned over the extensive modifications made to the riparian zone by the applicant. The NCWRC does not object to the issuance of the permit provided the following conditions are met by the applicant: 1) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. This includes placement of a silt fence along the stream bank to prevent sediment from entering the stream. 2) Adequate precautions should be taken to prevent wet concrete from coming into contact with the stream. This will reduce the likelihood of a fish kill associated with construction. 3)• The applicant should construct a fishway (fish ladder) on his existing dam/intake structure so that fish passage is possible. 4) The fishway should be-either a pool-and-weir type or a vertical slot type fishway. 5) Solid baffles in a pool-weir type fishway should not be over 1 foot higher than water level in the pool below the baffle. 6) Measures should be taken in the design and construction of the fishway to establish attracting flows through the fishway and at the entrance of the fishway. 7) The top of the fishway should be separated from the intake so that during periods of low flow, water continues through the fishway. M 00.014 . • of 8) Residual flow in the stream below the intake must be of sufficient magnitude to prevent destruction or serious diminution of downstream fishery habitat. Under no conditions may the entire flow of a watercourse be diverted to supply a fish propagation facility. 9) Work, is prohibited in the stream from November 1 to April 15 to protect egg and fry stages from sedimentation. 10) Temporary ground cover (e.g. hardwood mulch, straw, etc.) must be placed on bare soil during construction. Native vegetation such as rhododendron, willow, and river birch should be planted in the riparian zone and other unvegetated areas within 15 working days of project completion to provide long term erosion control. The Corps of Engineers office issued 404 permit for this activity prior to requesting 401 certification by the DEM. No impact is expected from the certification of this project, and, therefore should be approved. The owners have been given verbal approval of certification and allowed to continue construction activities to meet November 1, 1992 deadline for trout reproductive season.
