Upon review of your request for Water Quality Certification
to place fill material in 0.53 acres of wetlands for
landscaping a drained pond located at South Elm Street in
Greensboro, Guilford County, we have determined that the proposed
fill can be covered by General Water Quality Certification No.
2671 issued January 1, 1992. A copy of the General Certification
is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.
Care should be taken during filling not to damage or disturb the
sewer line which is located on the property. Fill shall consist
of clean soil or concrete free from toxic contaminants.

RE: Application for 401 Certification
DEM # 92392
On 20 July 1992, the Division of Environmental Management
received your application for a 401 Water Quality Certification
to fill about one-half acre of wetlands behind a drained pond on
your property. Our Regional Office staff examined the site on
August 4, 1992. We have a few questions concerning your plans
before we can make a decision on the Certification. These
questions are listed below.
1. What is the acreage of wetlands which you propose to
fill? Our Regional staff believe that there may be
more than the one-half acre indicated on your
application.
2. Do you plan to use the area for landfill or
demolition debris? An adjacent area is being used
for that purpose and we would have concerns about
use of this lowlying area for disposal.
3. A sewer line is present between the landfill and
drained pond. What measures will be taken to
protect the sewer line during your filling activity?
4. If all you plan to do is bushhog and mow the drained
pond, then no Certification would be required from
the Division of Environmental Management since there
would be no fill. Please clarify this issue.

This site was visited on 920804. Despite the time of year, there
was a significant flow of water through the area. This is contrary to
the general perspective of the site when looking at the topo map.
The existing small pond is what is left after the large pond had
been drained. It appears that the destroyed pond would have been
developed in a wetland area. To the north, it appears that landfilling
has been going on for some time. A large concrete demolition area is
adjacent to the area and runs parallel to the sewer line (see drawing
attached). The total drained area is about 2-3 acres. It is not known
whether or not the landfilling is permitted or the result of illegal
activities. Behind the dam, there is a small draw that has been filled
in with old lumber. This filled draw feeds directly into the stream.
Further filling and or use of heavy equipment in this area could
possibly impact the sewer line negatively. The retention of
stormwater in this site should not be underestimated due to the sewer
line as well as the landfilling and the potential for rain to wash through
exposed concrete thereby causing possible erosion and sedimentation.
Accidental discharges from the nearby highway and the rather busy
intersection (approximately 500') may also be retained in the area if
the area is left as is.
The WSRO is not aware of any significant historic or wildlife
sites located in the vicinity. During the site visit, two turtles were
observed that appeared to be eastern painted turtles.
The WSRO does not recommend that a 401 permit be issued for
this site. If you have any questions please do not hesitate to call.
