The Division of Environmental Management (DEM) received a
letter from the Corps of Engineers (COE) stating that your
project qualified for a Nationwide Permit. Please be advised
that the Nationwide Permit is not valid until a 401 Water Quality
Certification has been issued by the Division. General
Certifications have been issue by the Division for most of the
Nationwide Permits, however, several of the General
Certifications require written concurrence from the Division
before the Nationwide Permit is valid.
If you are utilizing Nationwide Permit # 26 and your fill
activity is equal to or less than one-third (1/3) of an acre you
are not required to obtain written concurrence. Otherwise please
complete the attached form (except for conditions 15 and 16) and
send six additional copies (a total of seven copies) so that the
review of your request can be initiated.

Reference your application for Department of the Army (DA) authorization
to place excavated material in wetlands adjacent to Whipping Creek associated
with the construction of 9,100 linear feet of firebreaks (control lines)
within the A1,11gator River National Wildlife Refugeyy ?P?ara County, 5, North
Carolina. The purpose of the firebreaks will be to NM8ia for a safe prescribed
burn of the habitat management areas for the endangered red-cockaded
woodpecker (Picoides borealis).
On March 23, 1992, we issued general permit, Action ID No. 199200297,
(copy enclosed), that authorizes the discharge of dredged or fill material
resulting from the following activities on federal or state owned property,
and, when performed by the U.S. Forest Service or N.C. Division of Forest
Resources, on privately owned land, within non-tidal waters of the United
States in the State of North Carolina: (1) Discing of soils for the purpose of
maintaining regularly maintained existing firebreaks. (2) Discing of soils for
the purpose of continuing ongoing, site specific, wildlife management
activities where discing is used to manipulate habitat and feeding areas for
native species of fauna and flora. (3) Discing of soils for the purpose of
creating a new firebreak when approved by the District Engineer on a case by
case basis. (4) The use of a fire plow for the purpose of fire control for a
prescribed burn when approved by the District Engineer on a case by case basis
provided that preconstruction contours are immediately reestablished upon
conclusion of the specific prescribed burn. (5) The use of a fire plow for the
purpose of fire control during emergency fire fighting situations provided
that preconstruction contours are immediately reestablished upon conclusion of
the emergency.
Your proposed work is authorized provided that you comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. This Department of the Army general permit does not
relieve you of the responsibility to obtain any other required State or local
approval.

Enclosed is an apblication for placin fill material in pocosin

created throu:h the wetlands. Tile vegetation and debris in the
firebreaks will be removed and in this process soil will be.

in the wetlands. The purpose of the project is to allots a safe
prescribed burn which is needed for habitat management for the

Prescribed Burning Plan

Site Preparation: Chip Rd. Unit will be divided into two blocks,
Whipping Creek Rd. Unit will be divided into three blocks.
Vegetation along Chip and Whipping Creek roadsides will be mowed
using a boom axe-type mower. A portable bridge will be installed
at the Chip Rd. Unit to span the adjacent canal. One-half of
each block will be drum-chopped and slash will be cleared from
around colony trees out to a 20' radius. The cavity trees will
then be foamed with a fire retardant material. Control lines
will be double-blade width and will be installed using a D-6
dozer with a KG-type. After cutting the control lines with the
dozer, a hand crew will then police the lines ensuring that they
are functional. The dozer will be walked through the non-drum
chopped vegetation to create strips 150' apart which will be used
to allow the igniters to create a flanking fire. A 20' x 20'
sump will be dug at the intersection of Chip Rd. and Whipping
Creek Rd. using an excavator or backhoe. The sump will create a
reliable water source for pump use.

Special Constraints and Considerations: All burning will be done
outside the nesting season for red-cockaded woodpeckers. The
blocks which do not contain cavity trees will be burned first.
Only after successfully burning these blocks will be cavity tree
containing blocks be burned.
Burning in peat soils poses a potential danger. Smoke from the
burns could possible create a hazard on the Air Force Bombing
Range, approximately 1 mile north of the burn units and NC
Highway 264, which is approximately 3 miles southeast of the burn
units.

Holding and Control:
Critical Control Problems: Volatile adjacent fuel types containin
peat soils can present a control Droblem. All control lines must be as strai ht
as possible with few irreeularities.

Crew Briefing Points: Crew members will be notified on the
location of the control lines and the probable location of black
zones. Crew members can use the control lines and black zones as
escape routes to safety zones such as Chip Rd. and Whipping Creek
Rd. The black zones can also be used as safety zones.
Steve Fowler, Jonathan Windley, Stephen Grant, Amy Midgett, and
Edward Zakrajsek will serve as the first igniting crew. Scott
Lanier and Belton Gray will serve as secondary ignitors.
Personnel on both igniting crews will serve on the holding crew
when not igniting.
All personnel involved with the burn will be equipped with a two
channel radio monitoring the Fish and Wildlife Service frequency
163.15 (channel one) and 163.15/164.625 (channel two).
A truck tractor and lowboy trailer with the dozer will be sitting
on Whipping Creek Rd. facing east toward Stomper Rd. Two pumps
for a hose lay will be set up near the sump hole in addition to
two pumper trucks
Crew members will be made aware of the danger of snags and other
previously mentioned safety hazards (see Other Safety Hazards).
All crew members will be aware of the possibility of spot fires
and will be aware of the direction that cinders are traveling.

Dear Mr. Dorney:
The Corps of Engineers has instructed Alligator River National
Wildlife Refuge that we need to obtain a Section 401-Water
Quality Certification prior to construction of fire breaks
needed for a prescribed burn to improve red-cockaded
woodpecker habitat. This work will be done under General
Permit No. 199200297. The Refuge had applied for an
individual permit prior to the issuance of the General Permit.
As you discussed with Bob Noffsinger, of the Refuge Staff, the
application for that individual permit is enclosed for your
use in consideration of issuance of the 401-Water Quality
Certification. Six additional copies of the application,
without the burn plan attached,are also enclosed. Please call
