Upon review of your request for Water Quality Certification
to place fill material in 0.32 acres of wetlands for
sewer line installation located at SR 1825 and SR 1845 in Durham
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2664 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 12.

1. Project No. 92242.
This project consists of expansion of the existing runway to
allow larger airplanes to use the airport. FAA grant money has
already been used to build a $2,000,000 hanger. FAA money will
also be available pending the approval of this project. The
larger planes are deemed to be of economic benefit to the county.
The runway expansion will take about 7.7 acres of wetlands.
This wetlands has moderately good value (see enclosed rating
sheet). A portion of this is to be used for temporary sediment
control, as required by USF&W (no sediment to leave the site). As
soon as construction is complete, this 3.5 acres will be returned
to wetlands type habitat. The remaining wetlands on site are low
value and associated with ditches and stormwater drains which
parallel the existing runway and roads. The wetlands to be
impacted do not border Swift Creek. They are low, level, and
characterized by ponded, marshy vegetation. It is not perceived
that water quality problems to surrounding surface waters will be
realized as a result of this project. The main impact will be the
actual wetland acreage loss.
To mitigate this, the applicant is proposing a 2:1
mitigation ratio. I have not seen these plans, but they are
supposedly sent to your office. An existing sediment basin is not
to be disturbed with this project. This must be stressed in the
certification, as this area has quite a high value presently. The
mitigation site is to be adjacent to a tributary which drains
easterly away from the runway. This tributary has good quality
also, and should not be disturbed during the mitigation phase.
This should be a requirement in the mitigation plan. An
additional concern is that creating about 18 acres of wetlands
adjacent to this creek by removing existing uplands will greatly
impact the hydrology of the area. This could reduce flow of water
(or possibly increase it) to the existing creek, impacting the
biology of that area. Maybe it is possible for the wetlands to be
created nearby but not contiguous with the creek.
The RRO agrees that the wetlands disturbance may be
satisfactorily remedied by mitigation. Water quality impacts
resulting from wetland loss should be minimal. However, the
mitigation site should be thoroughly examined. The RRO recommends
issuance of the certification, if the mitigation plan which is
filed is satisfactory and addresses the above concerns.
The project is adjacent to Swift Creek in the Neuse River
Watershed. Classification: C-NSW.

I have not been to this project site. It is proposed to
impact 0.32 acres with a sewer outfall line. It is a tie-on to an
existing line, so the topography dictates the wetlands impacts.
The RRO has no particular concerns with this project and
recommends the general certification be issued with standard
conditions.
The project is adjacent to Little Lick Creek in the Neuse
River Watershed. Classification: C-NSW.

Dear Mr. Wright:
Reference your application of April 15, 1992, for Department of the Army
authorization to discharge fill material within waters of the United States,
and wetlands adjacent to, and above the headwaters of, an unnamed tributary to
Little Lick Creek, for backfill and bedding related to construction of a
sanitary sewer outfall for the proposed Greystone Subdivision, east of Durham,
Durham County; North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for the discharge of material for backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in pre-
construction contours.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for two years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the two years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within twelve months of the date
of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case base to modify,
suspend or revoke the authorization.
