Upon review of your request for Water Quality Certification
to place fill material in 0.86 acres of wetlands for
road construction, Industrial Park Drive located at Kernersville
in Forsyth County, we have determined that the proposed fill can
be covered by General Water Quality Certification No. 2671 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.
An additional condition is that development in the industrial
park served by this road must determine whether DEM's water
supply regulations are applicable at the time of construction.

Reference is made to the site visit of April 14, 1992, conducted by
Mr. John Thomas of my staff at the site for the proposed extension of
Industrial Park Drive located off N.C. 66 and Macey Road adjacent to West Fork
Deep River, Kernersville, Forsyth County, North Carolina. Also in attendance
was Mr. Russell Radford of Callahan Survey Co. (consultant for site). The
purpose of this site visit was to review provided plans for construction of
the aforementioned road access, and to inspect the site for waters and
wetlands subject to Department of the Army permitting authority.
The meeting revealed that the proposed site is located adjacent to, and
above the headwaters of, West Fork Deep River. The review of the proposed
development plans provided by Mr. Russell Radford indicates that the proposed
road alignment would impact wetlands of the aforementioned tributary. A
review of the jurisdictional wetland limits and of your project plans
indicates that you propose adverse modification to approximately 0.86 acres of
wetlands above the headwaters of and adjacent to the aforementioned tributary.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the lose of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.

Your proposed work, involving adverse modification to less than an acre
(0.86 acre) of waters of the United States located above the headwaters of the
aforementioned tributary, is authorized by nationwide permit (NWP) provided it
is accomplished in strict accordance with the enclosed conditions. Please be
aware that this authorization does not relieve you of the responsibility to
obtain any other required or local approval. You should contact Mr. John
Dorney, North Carolina Division of Environmental Management, (919) 733-5083,
to obtain the necessary Section 401, Water Quality Certification prior to
starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP authorization, activities which have commenced (i.e.,
are under construction) or are under contract to commence in reliance upon the
NWP will remain authorized provided the activity is completed within 12 months
of the date of the NWP's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization.
Please contact this office for any future proposed impacts in any water or
wetland areas subject to Department of the Army permitting authority.

Subject: 401 Certification Review
City of Kernersville Industrial Park Roadway
After a site visit on 920505 of this site, it appears that there are
some concerns with this project that should be considered in the
roadway design. This area of the watershed is subject to potential
impacts from interstate highway traffic to the north and four lane
traffic to the west. This general area has a heavy concentration of
truck traffic due to several large terminals located on Hwy 66 South.
The new industrial park will probably contribute significant parking
lot runoff to this watershed section as it will probably be closer to the
stream than any other pollutant runoff source other than I-40.
Additionally, more development is anticipated south of this site as
Hwy 66S is now three and four laned to Bunker Hill-Sandy Ridge Rd.
The I-40 Bypass also crosses this riparian ecosystem which is shown
on the attached map. Zoning approved business development at the
intersection of Hwy 66 and I-40 Bypass is anticipated. Hwy 66 South
(and possibly North), I-40 and I-40 Bypass comprise the busiest
trucking corridor through Forsyth County as this area of is the
trucking "hub" of the Piedmont Triad. The classification for this
segment of the Deep River is WS-III due to High Point's Oak Hollow
Lake. The Lake is used for fishing, boating, walking and picnicking,
etc. There are no known threatened or endangered species in this
area to my knowledge.
Recommendation: WSRO recommends that if this road is an
economic necessity that it would be better to span this section of the
river with a bridge type structure in order to disrupt the wetland area
as little as is possible. This should help in returning the area to its
natural condition, thereby recovering the filtering capabilities of this
stream section which includes small finger or headwater tributaries.
If spanning the wetland is not practicable and if the City owns the
industrial park, it may be appropriate to require permanent wet
detention ponds for all newly developed sites. The biodiversity and
integrity of this watershed system should be protected as holistically
(systematically) as possible due to potential cumulative impacts to
High Point's water supply. The wildlife and aquatic values for this
corridor may be more significant than expressed in the attached
rating which reflects the size of the project in relation to the area that
would remain in the wetland system.

Dear Sir:
Please find enclosed six (6) copies of the "Joint Application
Form for Nationwide Permits..." with supporting information
`covering proposed construction of Industrial Park Drive by the
Town of Kernersville. Routing of the proposed roadway is such
that approximately 0.86 acre of wetlands will be impacted. The
application and supporting information describe the location and
limits of wetlands adjacent to West Fork Deep River.
I have also forwarded a seventh set of copies of the material
described above to the W-knot4on- Salem Regional..office for their
concurrent review and comment(s).
The U. S. Army Corps of Engineers representative for this area,
Mr. John Thomas, has inspected the route for the proposed
roadway. Mr. Thomas determined that the limits of the wetlands
extends from Station 14 + 75 to Station 17 + 50, a roadway length
of 275 feet. Larry L. Callahan Surveying Co., Inc., the roadway
design consultant, has determined that within the defined
wetlands the roadway fill section encompasses 0.86 acre.
Scheduling for this roadway project calls for construction to
begin by mid-June and for bids to be opened on May 28th, 1992.
It is therefore requested that we receive your approval as soon
as possible. If you desire and if it will expedite the process,
