Dear Mr. Murphy:
Reference your joint application of April 16, 1992, for Department of the
Army authorization to discharge fill material within waters of the United
States, causing the loss of an additional 1.1 acres of wetlands adjacent to
and above the headwaters of Northeast Creek, for a total fill of 2.6 acres,
for construction of the Northeast Creek Parkway extension, northeast of
Cornwallis Road, in Durham,;Durham County] North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.

Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions. This NWP does not relieve you of the
responsibility to obtain any required State or local approval. You should
contact Mr. John Dorney, North Carolina Division of Environmental Management,
(919) 733-5083, to obtain the necessary Section 401, Water Quality
Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

The enclosed joint application form and associated documents are to request a
Nationwide 26 Permit for filling and dredging 1.14 acres of wetlands, of
which 1.09 acres are within the Northeast Creek Parkway Right of Way,
adjacent to the Research Tricenter North development, in Durham, North
Carolina.
Little & Little is applying for this permit on behalf of Craig Davis Properties
and Lewis F. Ballard. As the developer of Research Tricenter, Craig Davis'
Properties is responsible for the future construction of Northeast Creek
Parkway, (the Right of Way of which has been dedicated to the City of
Durham). Because the road has not yet been constructed, Craig Davis
Properties is acting as the agent for the City of Durham for the purpose of
obtaining this permit. Please refer to the attached copy of the letter from the
City of Durham Department of Engineering to Mr. Eric Alsmeyer, Raleigh
District Office,Dept. of the Army, Corps of Engineers, dated April 10, 1992.
Mr. Ballard owns 0.05 acres, which have not been dedicated as right of way,
of the 1.14 acres within the permit application area.
A Nationwide 26 permit, (SAW 26-89-62), was originally issued for 2.63 acres,
on September 15, 1989, including the site for which permitting is currently
being requested. This permit will expire in January, 1993. Approximately 1.5
acres of wetlands included in the original permit will have been filled, prior to
the current permit expiration. Because the filling of the remaining 1.1 acres
will not be completed by this time, we are applying for a new permit for this
area.

Dear Ms. Gantt,
Little & Little, on behalf of Craig Davis Properties, (PO Box 31969, Raleigh, NC
27622), is applying for a Nationwide Permit 26 for filling of approximately 1.1
acres of wetlands within the Northeast Creek Parkway right of way, adjacent to
the Tricenter North development in Durham, North Carolina.
A Nationwide 26 permit, (SAW 26-89-62), was originally issued for 2.63 acres, on
September 15, 1989, including the site for which permitting is currently being
requested. This permit will expire in January, 1993. Approximately 1.5 acres of
wetlands covered by the original permit will have been filled, prior to the current
permit expiration. Because the filling of the remaining 1.1 acres will not be
completed by this time, we are applying for a new permit for this area.
Based on field investigations, we believe that there are no endangered or
threatened plant or animal species on the affected site, or on adjacent wetland
areas.
For your convenience, I am enclosing reductions of the original wetland
delineation map and the current development plan for Research Tricenter North.

Item 1. This project has an existing nationwide permit which
will expire before the project can be completed. This request is
essentially for a new permit to extend the deadline for fill. The
fill is to complete the road extension which has been started to
Cornwallis Road. Approximately 1.1 acres of wetlands is to be
filled. The wetlands have moderate value (rating by Howard
Partner enclosed- rating numbers generally concurred with). The
toe of fill -i..ll remain about 300 feet away from the channel of
Northeast Creek. The fill is to be on a broad floodplain, nearly
level. The main impacts are loss of wetland acreage and loss of
flood volume storage during flooding stages. Water quality
impacts should be minimal. There will be a large buffer of
wetlands remaining between the new road and the stream channel.
This area is characterized by level soils with dense cutover type
vegetation. There are no meandering channels through here, so
sediment and pollutant removal should be adequate. The RRO
recommends issuance of the general certification with standard
conditions.
Item 2. This request is for general certification along with
NW 12 for a sewer line about 200 feet long with a 25 foot wide
easement, to tie into the existing sewer line adjacent to
Northeast Creek. The soils in the area are moderately well
drained floodplain soils adjacent to the stream channel and would
not be considered "hydric". However, no impacts appear to be
associated with this sewer line extension. The "wetlands" were
not rated, but the floodplain has moderate value in pollutant
removal. This value will remain. No other unique or outstanding
features were noted with the site. The RRO recommends issuance of
the general certification for the sewer line.
