Dear Mr. Galamb:
Pursuant to our conversation last week, Sabine & Waters is pleased to submit additional
information to clarify the following issues which you raised:
o Filling on Lot No. 2 adjacent to Tagus Drive
o Future development in the southwest corner of site.
The wetland area on the back (southeast) portion of lot No.2 was not identified for filling
in our proposal to you dated January 10, 1992. It was our opinion that the wetland would not
require tilling in order to utilize the lot for residential development. In accordance with our
telephone conversation, we have reevaluated this strategy in consideration of the merits of leaving
the wetland unaltered, and have concluded that filling the wetland at this location is preferable.
The additional tilling at Lot No. 2 will be offset by reducing proposed fill on lot Nos. 74 and
75 by an equal amount. This strategy affords maximum practical protection for the wetland
corridor between lot Nos. 76 and 39, which constitutes a large corridor of unaltered wetland.
The wetland till plan (attached) has been changed to reflect this modification.
The specific future development of the southwest corner of the site was not identified in
our original proposal. There are presently no specific development plans for this area. An
adjacent parcel, as shown on the Master Sketch Plan, has not been secured and access and
lot studies have not been completed for this area. We have, however, agreed to preserve the
wetlands between lot Nos. 70-75 and the unspecified development to the west. Regardless of
the specific development that occurs in this area, the jurisdiction wetlands that have begn
surveyed and platted will be preserved to be used as common area and/or drainage easementt .

Upon review of your request for Water Quality Certification
to place fill material in 0.61 acres of wetlands as shown onlyour
map of April 20, 1992 for road crossings and lot fill located in
Greensboro, North Carolina in Guilford County, we have determined
that the proposed fill can be covered by General Water Quality
Certifications No. 2671 and 2666 issued January 21, 1992. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permits No. 26 and 14. All other wetlands shall. be
placed in conservation easements or (if on private lots) have
deed restrictions.

The Division of Environmental Management, Water Quality Section has
reviewed your plans for wetland fill for 0.98 acres of wetlands lat
Brassfield Section I in Guilford County for residential lot fill' and
road crossings. Based on this review, we have identified significant
uses which would be removed by this project. These are wildlife:
habitat, water storage, streambank stabilization and removal of
pollutants in a sensitive watershed. Furthermore, insufficient '.evidence
is present in our files to conclude that your project must be bujilt in
wetlands. Therefore, we are moving toward denial of your 401
Certification. Until we receive this information, we are requesting (by
copy of this letter) that the U.S. Army Corps of Engineers place your
pzc-)ject on administrative hold.
Please provide us with information supporting your position that
your project must be constructed in wetlands. Specifically can ',you
construct your residential lots on nearby upland? Any documentajtion
such as maps and narrative which you can supply to address upland
alternatives may be helpful in our review of your 401 Certification.
Please respond within two weeks of the date of this letter.

This letter is to request your determination regarding General Water Quality Certification
for the above referenced project. Although this work is clearly authorized by the U.S. Army
Corps of Engineers (USACE) under Nationwide Permit Nos. 14 and 26, my understanding is
that your office must also determine if the project can be covered under your General Water
Quality Certification No. 2176, issued November 4, 1987.
BACKGROUND
Wetlands on the approximately 83-acre site were delineated by Sabine & Waters personnel
on June 20-21, 1991, using the routine on-site determination method as described in the Federal
Manual for Identifying and Delineating Jurisdictional I'?etlamis'. The flagged wetland
boundaries were verified on-site by Mr. John Thomas of the USACE on August 8, 1991. The
final letter of verification is attached. The USACE has also concurred with our determination
that the proposed work is covered by NWPs 14 and 26 for minor road crossing and filling less
than one acre of wetlands located above the headwaters (point of 5 cfs mean annual flow). A
letter substantiating this determination is forthcoming. The information that follows is submitted
for your review to reach a decision on Water Quality Certification.

PROPOSED PROJECT
The project consists of a residential subdivision and associated infrastructure incl ding
water, sewer, electrical utilities and drainage easements. A total of 156 residential lot are
proposed for a density of 2.0 units per acre. Wetlands on the 83-acre site have been avoided to
the maximum extent practicable. Wetlands are proposed for filling at five locations within the
project. Approximately 0.98 acres of intermittent tributaries to Horsepen Creek will be filled
to create buildable residential lots. Approximately 0.12 acres of wetlands will be filled for three
minor road crossings. All road crossings are less than 100 feet either side of ordinary high Water
(OHW) and require less than 200 cubic yards of fill material below OHW. The threeroad
crossings are also the minimal required to effectively and safely access the site.
Secondary impact to adjacent streams and wetlands will be minimized by, the
implementation of site specific erosion control measures, as well as best management practices.
An erosion control plan (attached) has been prepared by Evans Engineering, Inc., and will be
submitted to Guilford County for their review. The plan will control erosion and sedimentation
during and after construction activities and assist in maintaining high water quality in adj cent
streams and tributaries. The erosion control plan provides details for pre-and post-projectlland
contours and surface drainage, and describes methods to protect sensitive adjacent and dbwn-
gradient natural habitats, particularly streams, wetlands and floodplains. All practicable measures
will be taken to prevent non-point source runoff from the subdivision from impacting wetlands
and streams on the project site. These measures should provide filtration of potential pollutants
and assimilation of excess nutrients that may be associated with subdivision run-off.
Co sidering the total amount and the relative low quality of the wetlands being imp cted
(1.10 ac es), it is our opinion that compensatory mitigation is not warranted. Wetland
reservation and buffering, however, is proposed to maintain a high level of environ ental
quality and preserve the integrity of the significant flood plains adjacent to the site. Th site
contains approximately 14.4 acres of wetlands, of which 1.10 are being proposed for filling.
The remaining 13.3 acres of wetlands will be preserved in their natural state. Wetland
preservation will be complemented by establishing an undisturbed upland buffer around positions
of the preserved wetlands. Buffering will be accomplished adjacent to the primary wetlands to
create large blocks of undeveloped wetlands and upland. The buffer area will consist of upland
between the jurisdictional wetland boundary and the 100-year flood plain. The large blocks of
undisturbed wetland and upland habitats will protect the values and functions of the adjacent
wetlands as well as provide kravel corridors and habitat value for wildlife. These undisturbed
areas will be dedicated to the city of Greensboro as open space.

PROPOSED PROJECT
The project consists of a residential subdivision and associated infrastructure including
water, sewer, electrical utilities and drainage easements. A total of 156 residential lots are
proposed for a density of 2.0 units per acre. Wetlands on the 83-acre site have been avoidjed to
the maximum extent practicable. Wetlands are proposed for tilling at five locations within the
project. Approximately 0.98 acres of intermittent tributaries to Horsepen Creek will be tilled
to create buildable residential lots. Approximately 0.12 acres of wetlands will be tilled for',three
minor road crossings. All road crossings are less than 100 feet either side of ordinary high water
(OHW) and require less than 200 cubic yards of fill material below OHW. The three road
crossings are also the minimal required to effectively and safely access the site.
Secondary impact to adjacent streams and wetlands will be minimized by the
implementation of site specific erosion control measures, as well as best management practices.
An erosion control plan (attached) has been prepared by Evans Engineering, Inc., and ill be
submitted to Guilford County for their review. The plan will control erosion and sedimentation
during and after construction activities and assist in maintaining high water quality in adjacent
streams and tributaries. The erosion control plan provides details for pre-and post-project land
contours and surface drainage, and describes methods to protect sensitive adjacent and down-
gradient natural habitats, particularly streams, wetlands and floodplains. All practicable measures
will be taken to prevent non-point source runoff from the subdivision from impacting wetlands
and streams on the project site. These measures should provide filtration of potential pollutants
and assimilation of excess nutrients that may be associated with subdivision run-off.
Considering the total amount and the relative low quality of the wetlands being impacted
(1.10 acres), it is our opinion that compensatory mitigation is not warranted. Wetland
preservation and buffering, however, is proposed to maintain a high level of environmental
quality and preserve the integrity of the significant flood plains adjacent to the site. The site
contains approximately 14.4 acres of wetlands, of which 1.10 are being proposed for filling.
The remaining 13.3 acres of wetlands will be preserved in their natural state. Wetland
preservation will be complemented by establishing an undisturbed upland buffer around portions
of the preserved wetlands. Buffering will be accomplished adjacent to the primary wetlands to
create large blocks of undeveloped wetlands and upland. The buffer area will consist of upland
between the jurisdictional wetland boundary and the 100-year flood plain. The large blocks of
undisturbed wetland and upland habitats will protect the values and functions of the adjacent
wetlands as well as provide travel corridors and habitat value for wildlife. These undisturbed
areas will be dedicated to the city of Greensboro as open space.

Dear Mr. Dorney:
This letter is to request your determination regarding General Water Quality Certifi tion
for the above referenced project. Although this work is clearly authorized by the U.S. rmy
Corps of Engineers (USACE) under Nationwide Permit Nos. 14 and 26, my understandi g is
that your office must also determine if the project can be covered under your General Water
Quality Certification No. 2176, issued November 4, 1987.
BACKGROUND
Wetlands on the approximately 83-acre site were delineated by Sabine & Waters personnel
on June 20-21, 1991, using the routine on-site determination method as described in the Fe eral
Manual for Identifying and Delineating Jurisdictional Wetlands'. The flagged we land
boundaries were verified on-site by Mr. John Thomas of the USACE on August 8, 1991. The
final letter of verification is attached. The USACE has also concurred with our determination
that the proposed work is covered by NWPs 14 and 26 for minor road crossing and filling less
than one acre of wetlands located above the headwaters (point of 5 cfs mean annual flow). A
letter substantiating this determination is forthcoming. The information that follows is submitted
for your review to reach a decision on Water Quality Certification.
