The Application provides adequate assurance that the discharge of fill material into the waters of. Alligator River tributaries in conjunction with the proposed culverts/flash board risers in Dare County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the . turbidity in the Stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. The following description of the work is taken from data provided by the applicant. Installation of the proposed structures will allow the refuge to restore, or partially restore, over 50,000 acres of altered wetlands. The post project water level will more closely approximate the natural hydrology of forested and scrub/shrub wetlands. This project will improve water quality enhancement and runoff retention functions of these wetlands, and improve their wildlife habitat quality. The existing bridges are unsafe for transporting heavy equipment. The N.C. Forest Service, who is under contract for fire suppression, has requested the refuge to upgrade and/or replace the bridges to insure safe movement of fire fighting equipment to required areas. The proposed water control structure fill will replace the wooded bridge and be utilized as the crossing. In addition, the water level control that these structures provide.will also allow holding a higher water level in the area while insuring that the level is not so high as to inundate the road system. This will reduce wildfire risk in the areas that are presently drained by the canals, provide better prescribed fire management capability, and provide a better supply of water for fire suppression. Installation of each culvert/riser will require an average of approximately 450 cubic yards of fill material to be placed below the normal water level contour at each existing canal site, and the placement of approximately 1,800 square feet of excavated material within adjacent wetlands associated with site preparation work. Total impacts to wetlands associated with this project equals approximately 68,400 square feet (1.57 AC). Total fill material to be placed below the normal water level contour within the existing drainage.canals equals approximately 17,100 cubic yards. Fill material for culvert/riser installation will be obtained from existing commercial borrow pits in the area and/or permitted sites on the refuge. The aluminum culverts will be 40 feet long by 48 inches in diameter. The risers will be 54 inches wide and 9 feet high. This project is proposed to be accomplished within a 5 year period. Plans showing the work are included with this public notice. It -2- The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management (NCDCM'? for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies which may include: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. (DEM) b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the NCDCM. c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the NCDCM or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 145-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the :Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested DA permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register -3- constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. It -4 Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. Box 1890 Wilmington, NC 28402-189o Lear Mr. Wright: Enclosed is an application for placing fill material in pocosin wetlands on the Alligator River ?rational Wildlife Refuge, in Dare County, North Carolina. The filling will occur when firebreaks are created through the wetlands. The vegetation and debris in the firebreaks will be removed and in this process soli will be disturbed and the soil, vegetation and debris will be redeposited in the wetlands. The purpose of the project is to allow a safe prescribed burn which is needed for habitat management for the endangered red-cockaded woodpecker (ricoides boreaiis) . The colony sites at Chip Road and 'whipping Creek Road have a hardwocd understory developing-which has reached the level of the nesting cavities. For reasons not completely understood red-cockaded woodpeckers will often abandon sites where this occurs. Fire suppression in the area has allowed the-hardwood encroachment at the sites. The prescribed burn will kill and/or retard the hardwoods in the sites and improve the quality of the sites for red-cockaded woodpeckers. The Chip Road site is about 25 acres in size and the Whipping Creek Road site is about 50 acres in size. The permit application and the attached excerpts from the burn plan give more specifics on the project. Basically, about 9,100 feet of firebreaks (control lines) will need to be created. These will be 24' wide and will disturb the duff layer (6-12 inches of roots and poorlS decomposed plant material) and up to 6 inches of soil. A wide track low ground pressure dozer will be used to create the firebreaks. An area with a 20' radius, will be hand cleared of all vegetation around each cavity tree. Each cavity tree will be sprayed with foam fire retardant. This project has been coordinated with and approved by the Services Endangered Species Office in Raleigh. Unit will be divided into three blocks. Vegetation along Chip and Whipping Creek roadsides will be mowed using a boom axe-type mower. A portable bridge will be installed at the Chip Rd. Unit to span the adjacent canal. One-half of each block will be drum-chopped and slash will be cleared from around colony trees out to a 20' radius. The cavity trees will then be foamed with a fire retardant material. Control lines will be double-blade width and will be installed using a D-6 dozer with a KG-type. After cutting the control lines with the dozer, a hand crew will then police the lines ensuring that they are functional. The dozer will be walked through the non-drum chopped vegetation to create strips 150' apart which will be used to allow the igniters to create a flanking fire. A 20' x 20' sump will be duff at the intersection of Chip Rd. and Whipping Creek Rd. using an excavator or backhoe. The filling will occur when firebreaks are created through the wetlands. The vegetation and debris in the firebreaks will be removed and in this process soil wiiL be disturbed and the soil, vegetation and debris will be redeposited in the wetlands. The purpose of the project is to aiiow a safe prescribed burn which is needed for habitat management for the endangered red-cockaded woodpecker (Picoides borealis). The coion?- sites at Chip Road and Whipping Creek Road have a hardwood understorv developing-which has reached the level of the nestin& cavities. For reasons not completely understood red-cockaded woodpeckers will often abandon sites where this occurs. Fire suppression in the area has allowed the hardwood encroachment at the sites. The prescribed burn will kill and/or retard the hardwoods in the sites and improve the quality- of the sites for red-cockaded woodpeckers. The Chip Road site is about 25 acres in size and the whipping Creel: Road site is about ?,0 acres in size. The permit application and the attached excerpts from the burn plan give more specifics on the project. Basically, about 9,100 feet of firebreaks (control lines) will need to be created.
