Copies of the General Certifications are attached. These Certifications may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 13. Reference AFZA-DE-E letter, dated 11 September 1992, subject: Project Number FW-00460-1, Erosion Control at Recondo school, Fort Bragg, NC. 2. ]Excavation of sediment from the section of Little River beneath the "Slide for Life" cable at the Recondo School does not include activity in any area subject to our jurisdiction pursuant to Section 10 of the Rivers and Harbors Act, and no dredged or fill materials are placed in waters of the United states, including wetlands, which would invoke our jurisdiction pursuant to Section 404 of the Clean Water Act. Therefore, a Department of the Army (DA) permit is not required for the routine, continuous excavation of this sediment provided the material removed continues to be placed and retained on high ground. 3. Your proposed placement of a gabion mattress along approximately 380 linear feet of Little River shoreline at the Recondo School is authorized by Nationwide Permit No. 13 (Bank stabilization) as detailed In separate correspondence. 4. Several items/concerns discussed are as follows: 1) The gabion mattress being installed should not xceed one (1) cubic yard of fill below the mean high water leve per linear foot and will extend approximately 380 fe,t in length, in accordance with the Nationwide Permit 13 for bank stabilization. 2) I am of the opinion, the majority of the material being dredged will, be sands and gravel.. The auguring in the water performed at the site exhibited the material to disperse rather quickly. Any suspended particles should settle as the flow passed the "rope drop area" located approximately 300 feet downstream. In this area (drop rope) the natural bottom is much deeper and a natural barrier (located approximately 100 feet further downstream) limits the water velocity during normal flows. This area should perform as a natural sediment basin, not requiring any construction in the creek. We understand that specific turbidity limits will be described in our permit and/or certification. 3) There, is evidence on-site that the "slide for life" sediment has been cleaned out several times in the past. I am sure in order to maintain the safety and integrity of the facility the sediment must be removed. For the purposes of the corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to section 20 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for bank stabilization activities, such as your proposed placement of a gabion mattress along approximately 380 linear feet of Little River shoreline, provided: a. No material is placed in excess of the minimum needed for erosion protection; b. The bank stabilization activity is less than $00 feet in length; c. The activity will not exceed an average of one cubic yard per running foot placed along the bank below the plane of the ordinary high water mark or the high tide line; d, No material is placed in any special aquatic site, including wetlands; e. No material i5 of the type or is placed in any location or in any manner so as to impair surface water flow into or out of any wetlands area; f. No material is placed in a manner that will be eroded by normal or expected high flows; and g. The activity is part of a single and complete project. 3. Your work is.authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditiotii of the naiionwide' permit, activities which have commenced (i.e., are under construction) Or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. 5.
