The Application provides adequate assurance that the discharge of fill material into the waters of Currituck Sound in conjunction with the proposed bulkhead and groin in Currituck County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. The groin and riprap shall be positioned no further waterward than 5 (five) feet from normal water level in order to minimize fill of submerged aquatic vegetation. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 22 day of December, 1992. Calhoun for a Department of the Army permit to construct and backfill a riprap bulkhead and construct a riprap groin on currituck Sound, Harbinger, Currituck County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The riprap bulkhead will be positioned no farther waterward than 5 feet from the normal water elevation contour. The riprap groin will extend no-farther waterward than 15 feet from the authorized alignment of the riprap bulkhead. To prevent an unintentional violation of this-authorization, representatives of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers will be available to stake the alignment of the bulkhead and waterward limit of the groin prior to placement of riprap material. b. All backfill materials will be obtained from a high ground source and confined landward of the permitted riprap bulkhead. c. The riprap and fill materials will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. e. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or %mer -2- construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. Since there will be fill of waters of the state (namely Currituck Sound) a 401 Certification will be required. A 401 Certification states that there will be no violation of state water quality standards as a result of this project. According to the Division of Coastal Management field report, there is good growth of submerged aquatic vegetation in the area which you intend to bulkhead and fill. The Division cannot approve fill which removes significant amounts of submerged aquatic vegetation since it provides existing uses such as aquatic life habitat and bottom sediment consolidation. Therefore we will need to deny your Certification which will result in an automatic denial of your permit form the Division of Coastal Management. However if you are willing to modify your project to locate the bulkhead within 5 feet of the existing shoreline (NWL), we will have no objection to your plans and will approve the Certification. Until you have responded to this letter, I am hereby asking that the Division of Coastal Management place your project on hold status. Calhoun Bio Report Page Two Site Description The applicant owns a 3 acre tract on the Currituck Sound located 225' north of the end of Halls Harbor Road in Harbinger, Currituck County. The tract hays an average elevation of approximately +3 feet above MSL and is roughly 1/2 cleared with a 26' x 180' boat basin separating the wooded and cleared portions. Two finger piers with dimensions of 2' x 10' extend into the basin. A single family dwelling which serves as a vacation home sits immediately to the south side of the basin. Three hundred ninety feet of wooden bulkhead has been constructed along the shoreline in front of the residence and along the southside of the basin as authorized by CAMA Permit #79-89 issued on April 7, 1989. The wooden portion of the tract which lies on the north side of the boat basin is dominated by mature Loblolly pines (Pinus taedal. Along the shoreline of this portion are wax myrtles (Myrica gg fer and an occasional willow (S lix At the north side of the property near the intersection of a ditch running along the north property line and the shoreline are cat- tails (Typha V) with a scattering of bulrushes Sci a §V,). Other wetlands are located immediately landward of the coastal wetlands described above. Located along the NWL are the decaying remains of several pines undermined by erosion of the bank. Beginning approximately 5' -10' waterward of the NWL is a thick bed of Widgeon grass Ru i m ri ima) and Eurasian milfoil extending 40' to 50' into Currituck Sound. Approximately 30' - 32' waterward of the NWL remnants of a 30 year old bulkhead are still visible. The application proposes to construct a 230 foot long rip rap bulkhead an average distance of 16 feet waterward of the NWL and place approximately 450 cubic yards of fill behind the bulkhead. At the south end of the bulkhead the applicant proposes to construct a 15 foot long rock groin at a right angle with the bulkhead. Anticipated Impacts This project would result in the filling of 3800 square feet of shallow water habitat. Approximately 2070 square feet of submerged aquatic vegetation would be destroyed.
