Upon review of your request for Water Quality Certification
to place fill material in 0.01 acres of wetlands for
dry hydrant installation located at MAckay Island NWR near Great
MArsh Trail in Currituck County, we have determined that the
proposed fill can be covered by General Water Quality
Certification No. 2664 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 12.

This station seeks approval of a 401 Water Quality Certificate for a minor dry hydrant project
at Mackay Island National Wildlife Refuge. This station has received notice from the Corps of
Engineers that this project qualifies for a Nationwide Permit 12. To validate this permit, this
station seeks the above referenced certificate.
Enclosed are seven copies of a completed application for a 401 certification. To facilitate your
review of this application, please find enclosed a copy of our correspondence to the COE which
describes the scope of the project. There are no detailed wetland delineation maps available but
we have enclosed a copy of a USGS topographic map (Figure 1) that reflects the general
physiographic composition of the area. Figure 2 is a copy of a USDA aerial photograph
showing a more accurate depiction of the water body where the dry hydrant pipe will be placed.
The red line on Figure 2 shows a more specific location of the water body which actually
appears darker in relation to the surrounding features (e.g., vegetation, State Rt. 615).
The refuge staff will supervise placement of the pipe and best management practices will be
followed. Pipe excavation will begin at the road shoulder of State Rt. 615 and will progress
to the pond edge which will be dug last to minimize turbidity. All sidecasts will be placed on

upland ground until final placement of the pipe is completed. No underwater excavation will
be required. Considering that this project involves the placement of a six inch pipe in a trench
slightly over 25 feet long, we expect minimal environmental disturbance including turbidity
generation.

Dear Mr. Bland:
This correspondence notifies your office of this station's intent
to use Nationwide Permit m12 (Utility Line Backf ill and Bedding) to
install a dry hydrant system on Mackay Island National Wildlife
Refuge. As explained in our February 11 meeting, this project
would be conducted by volunteers of the Knotts Island Fire
Department to establish a site from which water could be pumped for
emergency firefighting of structures on Knotts Island.
Figure 1 indicates the general site location which is immediately
east of the Great Marsh Trail. The project area consists of a
vegetated corridor between State Highway 615 and the pond that
borders the Great Marsh Trail. Vegetation in the immediate area is
dominated by black willow, wax myrtle, and phragmites. Soils are
well-drained at the margin of the road right-of-way but they become
saturated as they approach the pond. .The pond is perenially full
and it is overfilled from wind tides through a small pipe under Hwy
615.
This project entails the placement of an approximately thirty-foot
long (six-inch wide) PVC pipe about 1.5 feet below the lowest
ground surface (see Figure 2). Pipe installaton would begin just
off the cleared highway right-of-way; the last 5-6 feet of the pipe
(south end) would extend into the pond adjacent to the trail. At
the north end, the pipe would elbow up and extend vertically about
three feet above the ground. Here the pipe would be capped and
reserved for official use. The installation ditch would be dug by
backhoe and it should only impact a 4-6 foot wide corridor; no
sidecasts would be placed in the pond. The ditch would be
backfilled with the same soil that was unearthened and efforts
would be made to restore the area to previous contour and provide
for erosion control.

On March 10, 1992, I received a letter from the Corps of
Engineers advising that your project entitled Dry Hydrant System
at Mackay Island National Wildlife Ref. in Currituck County
qualifies for a Nationwide Permit 12. Please be advised that
this Nationwide permit is not valid until a 401 Water Quality
Certificate is issued by the State of North Carolina.
Our existing regulations (15A NCAC 2H .0501(a)) require that
all applicants for 401 Certifications submit seven complete
copies of 401 Applications. These copies.must be supplied by the
Division of Environmental Management to various state and federal
agencies.
Therefore, please complete the attached form and send six
additional copies (a total of seven copies) of your 401
Certification application so we can initiate the comprehensive
review required by our rules. If you have any questions, please

Dear Ms. Souheaver:
Reference your application of February 19, 1992, for Department of the
Army authorization to install a dry hydrant system and construct the utility
access line through wetlands on Mackay Island National Wildlife Refuge, east
of Great Marsh Tr 1, between an un-named pond and the shoulder of N.C.
Highway 615, in rrituck Cqunty, North Carolina.
For the purpose of the/Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided for the discharge
of material for backfill or bedding for utility lines, including outfall and
intake structures, provided there is no change in pre-construction contours.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

RE: 401 Water Quality Certification

Dear Mr. Dorney:
This station seeks approval of a 401 Water Quality Certificate for a minor dry hydrant project
at Mackay Island National Wildlife Refuge. This station has received notice from the Corps of
Engineers that this project qualifies for a Nationwide Permit 12. To validate this permit, this
station seeks the above referenced certificate.
Enclosed are seven copies of a completed application for a 401 certification. To facilitate your
review of this application, please find enclosed a copy of our correspondence to the COE which
describes the scope of the project. There are no detailed wetland delineation maps available but
we have enclosed a copy of a USGS topographic map (Figure 1) that reflects the general
physiographic composition of the area. Figure 2 is a copy of a USDA aerial photograph
showing a more accurate depiction of the water body where the dry hydrant pipe will be placed.
The red line on Figure 2 shows a more specific location of the water body which actually
appears darker in relation to the surrounding features (e.g., vegetation, State Rt. 615).
The refuge staff will supervise placement of the pipe and best management practices will be
followed. Pipe excavation will begin at the road shoulder of State Rt. 615 and will progress
to the pond edge which will be dug last to minimize turbidity. All sidecasts will be placed on
