Reference is made to your application #0900092.15A received in this Office on August 6, 2015.
You requested specific data to be considered confidential. This data must meet the definition of "Trade
Secret" [as noted in NCGS 132-1.2 and NCGS 66-152(3)] and must not be considered "Emissions data" [as
defined in 40 CFR 2.301]. The information you requested to be confidential includes the maximum design
capacity and the production throughputs for the Polyvinyl Fluoride (PVF) process at your facility; you have
provided other non -confidential data to justify the emissions calculations in your air permit application.
The maximum design capacity and production throughputs contained under separate cover of the
application have met the definition of "trade secret" and are not considered "emissions data" because it is
not needed to "determine the identity, amount, frequency, concentration, or other characteristics (to the
extent related to air quality) of any emission which will be emitted by your facility. Therefore, a
determination has been made that this information (maximum design capacity and production throughputs)
is entitled to confidential treatment under 15A NCAC 2Q .0107 and North Carolina General Statute 143-
215.3C. It will remain in a locked file in this Division's Regional Office until such time as it is reviewed. It
will then be maintained in a locked file in this Division's Central Files located in Raleigh, North Carolina.
If access to this information is requested by another party, you will be advised of this request and will also
be notified of any appeal of this determination to the Environmental Management Commission.
