The State of North Carolina certifies that the specified category of activity will not violate Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certification: 1. Proposed discharge of greater than 10 cubic yards of fill material or discharges into special aquatic sites including wetlands requires written concurrence from the Division of Environmental Management; 2. Proposed fill or substantial modification of waters or wetlands for this General Certification of any amount in Primary Nursery Areas (PNAs) and Outstanding Resource Waters (ORWs) requires written concurrence from the Divi- sion of Environmental Management; 3. If written concurrence is not issued by the Division of Environmental Management within 45 days from receipt of a complete application by the Division's 401 Certification Office in Raleigh, then 401 Certification is deemed to be issued as long as the applicant follows all other conditions of this General Certification unless additional information is requested in writing by the Director or his designee; 4., That established sediment and erosion control practices are utilized to prevent violations of the appropriate turbidity water quality standard (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTU° in all slatwater classes, and all lakes and reservoirs; and 10 NTUs in trout waters); 5. That additional site-specific conditions may be addec to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 6. Concurrence from DEM that this Certification applies to an individual project shall expire three years from i.he date of the cover letter from DEM. NARRATIVE DESCRIPTION: The applicant owns four (4) lots (Lot #73, #74, #75 & #76) on the Herring Pond, located off the Neuse River, in Sportsman Village, off SR1461, in the South River community of Carteret County. The applicant plans to build a home on Lot #73, #74 and #75, and desires to fill a total of approximately 4,000 sq. ft. of '404' wetlands within the Estuarine Shoreline AEC. There is a mobile home on Lot #76. A CAMA Major Permit is required since there is other State and Federal authorization required. At present, there is a camper trailer on Lot #73, #74 and #75. The vegetation on the property consist of loblolly pine, pond pine, sweet gum, and red maple. There is a Juncus rcemerianus fringe along the Herring Pond. The applicant proposes to place less than 25 cu. yds. of sand fill material in 7 depressions totalling less than 4,000 sq. ft. The applicant desires to fill these old stump holes, level his yard, and eliminate mosquito breeding areas. 10. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant.
