Through coordpnation with the North Carolina Division of Coastal
Management, we halve learned of the modification of your State permit which
authorizes you tomaintain a basin, reconstruct and backfill a bulkhead and
fill a boatramp a?rea off Peletier Creek, Morehead City, Carteret County, North
Carolina. This modification provides for relocation of five boatslips.
Your revised proposal has been reviewed and found to be consistent with
the provisions arid objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any addit onal change in your work is required because of unforeseen or
altered conditio s or for any other reason, plans revised to show the change
must be sent pro ptly to this office and the North Carolina Division of
Coastal Management prior to performing any such change or alteration. Such
action is necessary as revised plans must be reviewed and the authorization
modified.

Reference the application of 70 West Marina, represented by Mr. Jesse W.
Davis, for a Department of the Army permit to maintain a basin, reconstruct
and backfill a bulkhead and fill a boatramp area off Peletier Creek, Morehead
City, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit, including alignment of the
bulkhead, must be performed in strict compliance with the permit plans.
b. The ramp area must be bulkheaded prior to the placement of any
excavated or fill material.
C. All backfill materials will be confined landward of the permitted
bulkhead.
d. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
e. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour and any regularly or irregularly flooded
vegetated wetlands.
f. No vegetated wetlands will be excavated or filled.
g. Excavation will not exceed 4 feet below the elevation of mean low
water (MLW).
h. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.

i. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
j. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
k. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received November 23, 1992, for Department of
the Army authorization to maintain a basin, reconstruct and backfill a
bulkhead and fill a boatramp area off Peletier Creek, Morehead City, Carteret
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199300561
and will be coordinated by Mr. Scott McLendon in our Wilmington Field Office.

9. NARRATIVE DESCRIPTION: Mr. Jesse W. Davis is the operator of 70 West
Marina, a landmark off Bogue Sound and Highway 70, on the east prong of Peletier
Creek, known as Coral Bay, at 4401 Arendell Street, in Morehead City, Carteret
County, NC. Through a series of CAMA/Dredge and Fill permits in the early to mid-
1980s, the marina was developed to its current capacity of 69 wetslips and 320 dry-
storage units.
At this time, the applicant has three (3) basic needs to maintain and improve the
existing facility:
(1) Bulkheading on the south side of the marina basin needs to be
replaced. A total of 410 In. ft. of existing bulkhead in front of the
dry stack building and east to the boat ramp has been identified as
unstable. The new bulkhead will be installed at an average of 2'
waterward of the MHW level. However, because the old wall has
bowed out in a couple of locations, the new bulkhead alignment may
reach a maximum offset of 5' within this section of the man-made
basin;
(2) Excavation to reestablish the -4' MLW level depths along the new
bulkhead is required. Maintenance excavation will be accomplished
by a backhoe. An estimated 770 cu. yds. of silty sand will be
removed from an area shown on Sheet 1 of 3 as 260' long x 10-20'
wide. The spoil will be trucked to a designated spoil site on the
northwest side of the property. The spoil area has been used in the
past for permitted activities involving dredge spoil. Today, the spoil
site is level and well vegetated with domestic grasses. The spoil site
will measure 75' x 75' and will be defined with silt fence to help
contain the excavated material.
(3) Boat ramp usage at the marina is nominal and the physical space in
the northeast corner of the basin is under-utilized. The applicant
proposes to eliminate the ramp by excavating a section of highground
property next to the ramp and backfilling the adjacent ramp area with
the material. Sheet 3 of 3 shows the dimensions of the needed work.
The area of highground to be removed measures 38' x 18' and the
area within the ramp, waterward of the MHW shoreline to be filled,
measures 20' x 10'.
The first two items in this application proposal involving bulkheading and maintenance
excavation; they could have been processed as a CAMA General Permit. However,
the applicant wanted to combine the third element, that is, closing the boat ramp under
a comprehensive Major CAMA Permit Application. The surface waters of Peletier

Creek are classified 'SB' and are closed to the harvesting of shellfish. Other than the
proposed work activities outlined in this report, the applicant has no plans for
expanding the marina facility.
10. ANTICIPATED IMPACTS: The applicant proposes to replace almost 400 In. ft. of
wooden bulkhead and maintenance excavate some 770 cu. yds. of silty sand within the
marina basin. These activities meet the standard procedures of the CAMA General
Permit Numbers .1100 and .1500. If these activities are conducted in accordance with
the proposed plans, they should generate little to no significant impact on the quality of
estuarine life in this section of Peletier Creek.
Closing the boat ramp will involve excavating some 684 sq. ft. of highground property
and filling about 200 sq. ft. of surface waters within the existing ramp area. Impacts
associated with this kind of dredge and fill project can be minimized by installing the

Certification to maintain a basin, reconstruct and backfill a bulkhead and
fill a boatramp area off Peletier Creek, Morehead City, Carteret County, North
Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by January 25, 1993, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE DESCRIPTION: Mr. Jesse W. Davis is the operator of 70 West
Marina, a landmark off Bogue Sound and Highway 70, on the east prong of Peletier
Creek, known as Coral Bay, at 4401 Arendell Street, in Morehead City, Carteret
County, NC. Through a series of CAMA/Dredge and Fill permits in the early to mid-
1980s, the marina was developed to its current capacity of 69 wetslips and 320 dry-
storage units.
At this time, the applicant has three (3) basic needs to maintain and improve the
existing facility:
(1) Bulkheading on the south side of the marina basin needs to be
replaced. A total of 410 In. ft. of existing bulkhead in front of the
dry stack building and east to the boat ramp has been identified as
unstable. The new bulkhead will be installed at an average of 2'
waterward of the MHW level. However, because the old wall has
bowed out in a couple of locations, the new bulkhead alignment may
reach a maximum offset of 5' within this section of the man-made
basin;
(2) Excavation to reestablish the 4' MLW level depths along the new
bulkhead is required. Maintenance excavation will be accomplished
by a backhoe. An estimated 770 cu. yds. of silty sand will. be
removed from an area shown on Sheet 1 of 3 as 260' long x 10-20'
wide. The spoil will be trucked to a designated spoil site on the
northwest side of the property. The spoil area has been used in the
past for permitted activities involving dredge spoil. Today, the spoil
site is level and well vegetated with domestic grasses. The spoil site
will measure 75' x 75' and will be defined with silt fence to help
contain the excavated material.
(3) Boat ramp usage at the marina is nominal and the physical space in
the northeast corner of the basin is under-utilized. The applicant
proposes to eliminate the ramp by excavating a section of highground
property next to the ramp and backfilling the adjacent ramp area with
the material. Sheet 3 of 3 shows the dimensions of the needed work.
The area of highground to be removed measures 38' x 18' and the
area within the ramp, waterward of the MHW shoreline to be filled,
measures 20' x 10'.
The first two items in this application proposal involving bulkheading and maintenance
excavation; they could have been processed as a CAMA General Permit. However,
the applicant wanted to combine the third element, that is, closing the boat ramp under
a comprehensive Major CAMA Permit Application. The surface waters of Peletier

Creek are classified 'SB' and are closed to the harvesting of shellfish. Other than the
proposed work activities outlined in this report, the applicant has no plans for
expanding the marina facility.
10. ANTICIPATED IMPACTS: The applicant proposes to replace almost 400 In. ft. of
wooden bulkhead and maintenance excavate some 770 cu. yds. of silty sand within the
marina basin. These activities meet the standard procedures of the CAMA General
Permit Numbers .1100 and .1500. If these activities are conducted in accordance with
the proposed plans, they should generate little to no significant impact on the quality of
estuarine life in this section of Peletier Creek.
Closing the boat ramp will involve excavating some 684 sq. ft. of highground property
and filling about 200 sq. ft. of surface waters within the existing ramp area. Impacts
associated with this kind of dredge and fill project can be minimized by installing the
new 20' bulkhead across the ramp prior to beginning backfilling. In terms of open-
water area, the proposed modification of the ramp will increase the amount of surface
water within the basin by approximately 600 sq. ft. In addition, this new open-water
space will provide better maneuverability to those few boats that utilize the northwest
corner of the marina.
