The access will extend from NC Highway 191 and the Blue Ridge Parkway to the facility. The project has been reviewed by the NC Wildlife Resources Commission (WRC), and the US Fish and Wildlife Service (USFWS). Approximately 0.38 acres of wetlands will be filled in conjunction with roadway widening along the floodplain of Bent Creek. A culverted road crossing will be required across Wesley Branch. Several stormwater outlet structures will involve the discharge of a total of 9.4 cubic yards of clean washed stone below the plane of ordinary high water in Bent Creek. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. Coordinator U.S. Army Corps of Engineers Regulatory Branch Room 75, Grove Arcade Building Asheville, North Carolina 28801 SUBJECT: A review of an application by Barrett Kays & Associates on behalf of the North Carolina Arboretum, Buncombe County Dear Mr. Baker: Barrett Kays & Associates, on behalf of the North Carolina Arboretum, is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain 404 permits from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and conducted a site visit on December 10, 1991. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to improve an existing road from NC 191 and the Blue Ridge Parkway to the Arboretum's new Education Center and facilities. A single wooden bridge viaduct system that will span Bent Creek from high ground to high ground will be constructed, and a culvert will be installed in Wesley Branch Creek. Stormwater outlet structures and drainage pipe will also be installed along the road. Bent Creek is Designated Public Mountain Trout Water (DPMTW) in the project area; however, the NCWRC currently stocks trout in Bent Creek only to the Arboretum property line because of questions about angler access. Bent Creek and Wesley Branch Creek provide fair habitat for trout. The NCWRC does not object to the issuance of this permit provided the applicant implement these conditions! 1. y } 1) The culvert in Wesley Branch Creek should be placed at the same slope as the stream bottom and should be buried 1 foot unless bedrock is encountered. This will provide for 4V movement of aquatic organisms. 2) Heavy equipment should not be operated in stream channels its order to minimize sedimentation aftd reduce the likelihood of, introducing other pollutants into the stream. 3) Riprap placed for bank stabilization must not be placed below normal high water elevation so as to maintain natural substrate in the stream. Also, riprap should be kept to a minimum so as to retain riparian vegetation, which we prefer, for bank stabilization where possible. 4) If concrete will be used, construction must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 5) Erosion controls should be installed where soil is disturbed and maintained until project completion. 6) Waste earthen material from the project must not be placed in any stream or wetland or within the 25-foot buffer zone of any stream classified as "Trout" by the N.C, Division of Environmental Management. 7) Temporary ground cover (e.g. hardwood mulch, straw, etc.) must be placed on all bare soil during construction. Permanent vegetation in these same areas must be established within 15 days of ground disturbing activities to provide long term erosion control.
