SUBJECT: Application for Nationwide Permit 25 to install a handicap accessible fishing pier and General Permit 30 to install a boat ramp on Lake James, Burke County The North Carolina Wildlife Resources Commission is requesting 404 permits from the U.S. Army Corps of Engineers for the above referenced projects. By copy of this memorandum we are applying to the North Carolina Division of Environmental Management, Water Quality Section, for 401 certification. The first project consists of installation of a handicap accessible fishing pier at the Linville Boat Access Area on Lake James. A T-shaped wooden pier will be built on 22 concrete- encased pilings, (see attached diagram). Twenty of the pilings will be below the ordinary high water level. Each barrel will contain 1 cubic yard of concrete for a total of 20 cubic yards of concrete below high water. The concrete will be poured on site into reinforced barrels when the lake level is down so that it will not contact lake water until it hardens. The pilings are expected to be complete before March 15, 1993. The pier will be 8' wide in order to allow wheelchair access and meet federal government standards set forth in the Americans with Disabilities Act of 1992. The pier ramp will be protected from erosion by the placement of riprap along 40' of lake shore. Less than 12 cubic yards of riprap will be placed below ordinary high water elevation. The entire project will be completed by June 30, 1993. A 14'-wide boat ramp will also be installed at the Linville Boat Access Area immediately east of the existing ramp. The entire ramp will be 90' in length, with 50' below the ordinary high water level, and 6" thick. The concrete will be poured into it a forms on high ground and allowed to cure before being pushed into the lake. Less than 13 cubic yards of concrete will be below the ordinary high water level. The boat ramp will be installed by March 15, 1993. In order to protect the ramp from wave action, less than 12 cubic yards of riprap will be placed below ordinary high water. In addition, maintenance activities will be performed on the existing boat ramp consisting of patching holes with concrete. This will be conducted while the lake level is down and the ramp is dry. This memorandum also serves to meet the concurrence requirements necessary in certain trout counties. Also, I hereby request a determination on the need to contact the U.S. Fish and Wildlife Service regarding the presence of any Federally listed threatened or endangered species in the area, or the State Historic Preservation Officer regarding the presence of historic properties in the area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. G61-667d). The site consists of an open water portion of the reservoir which is controlled by Duke Power Company. Under normal operations, the annual water level fluctuation of Lake James is 8' in elevation. Based on our information on the range of trout in the project area, we do not believe this project will impact waters supporting trout. No wetlands or habitats likely to support any endangered, threatened, or special concern species will be impacted. As project applicant we will take all necessary precautions to ensure that no negative environmental impacts will occur. Therefore, we do not object to the project as proposed.
