I am alarmed that you are considering granting a p j? mit for the above mentioned project. I am absolutely op- posed to it and want to officially go "on the record" as such. The enclosure pinpoints submerged salt water grasses that will be destroyed if the dredging is allowed. The person who took that data is a licensed general contractor and an engineering graduate of the U.S. Air Force Academy in Colorado SDTIngs, Colorado. I flew with him as a pilot in the U.S.M.C. In short, he knows precisely what he is doing and this data should be regarded as highly reliable. I am also aware of clam beds in that same proposed channel area- Mr_ Schlaefer also knows where they are. He is of the same opinion as myself concerning this issue, but he has not come forward because, as a local businessman, he is concerned about the dangers of producing "hard feelings" In a small community. He is also concerned about what he feels is the long vindictive reach of the law firm that represents the applicant. In other words, he is loathe to come forward and speak against this application unless he is asked by an official who is considering Its merits. Therefore, I am asking you to ask him about it. At the very least, ask him about the enclosed document he produced. I am a pilot with considerable obligations out of the country, even though I am an official property-owning, tax--paying resident of Carteret County. In addition to my residence, indicated above, I own the rental property next door at 700 Bridges St. and a condo on Atlantic Beach. However, I would appreciate it if you would contact me, if needed, at my friend's mailing address. He forwards mail to me much more reliably than the U.S.P.S. r _l. Such a removal of use is inconsistent with 15A NCAC 2B .0201. Per the CAMA Bio-report, the impacts to shellfish bottom must be confirmed by survey. It is my understanding the applicants will stake the proposed alignment and that DMF will be conducting a shellfish survey of the area in the near future. PROJECT SUMMARY: Extend boat ramp, excavate a turning basin and access channel, construct a finger pier. FIELD INVESTIGATION REPORT COASTAL MOBILE ESTATES, INC., CARTERET COUNTY PAGE 9. NARRATIVE DESCRIPTION: The applicant's property consist of an approximately 17 acre tract of land located adjacent to NC Hwy. 58 and Bogue Sound, in the Town of Atlantic Beach, Carteret County. This property has been developed into a 140 space mobile home park. A community water system provides potable water to this development while individual septic tanks provide sewage disposal. The shoreline along the applicant's property is bulkheaded, and years ago, a boat ramp was constructed into Bogue Sound. This ramp terminates approximately 3' waterward of the MHW line and was recently resurfaced. Adjacent to the bulkhead, a 0-15' border of coastal wetlands exist which is vegetated primarily by Spartina alterniflora. An approximately 370' long pedestrian pier extends into Bogue Sound and was authorized by a General Permit in 1991. The area of Bogue Sound in front of this property can be characterized as relatively shallow with water depths approaching -4' MLW approximately 400' seaward of the shoreline. Within this 400' area are scattered amounts of seagrass vegetation growing in a sandy/silt substrate. Scattered amounts of oysters were observed near the shoreline and several clams were handraked during a recent site visit. The waters of Bogue Sound adjacent to the applicant's property are classified as 'SA' and are pen to the harvesting of shellfish. The applicant is requesting a permit to extend the existing boat ramp waterward and to excavate a turning basin and access channel in Bogue Sound. The proposed boat ramp is to be approximately 20' long x 12' wide x 6" thick and will terminate in a proposed 50' long x 50' wide (top width) x -4' MLW deep boat basin. An approximately 25' long x 4' wide finger pier would be constructed parallel to the boat ramp. The proposed access channel would extend from the boat basin for a distance of approximately 340' in length x 30' width (top) x -4' MLW deep. Excavation is proposed to be accomplished by the use of a hydraulic dredge with the approximately 1,250 cu. yds. of spoil material being pumped to an irregularly shaped diked disposal area. The applicant's engineer has calculated that the dike would contain approximately 1600 cu. yds. of material. 10. ANTICIPATED IMPACTS: It is estimated that the proposed excavation will directly impact approximately 3,000 sq. ft. of sea grass vegetation and potentially 13,000 sq. ft. of shellfish bottom. This, however, must be confirmed by an appropriate survey which has not been done as of this date. The approximately 1,250 cu. yds. of primarily sand/silt material to be excavated would be placed in a diked disposal area which should be adequate with property monitoring. NARRATIVE DESCRIPTION: The applicant's property consist of an approximately 17 acre tract of land located adjacent to NC Hwy. 58 and Bogue Sound, in the Town of Atlantic Brach, Carteret County. This property has been developed into a 140 space mobile home park. A community water system provides potable water to this development while individual septic tanks provide sewage disposal. The shoreline along the applicant's property is bulkheaded, and years ago, a boat ramp was constructed into Bogue Sound. This ramp terminates approximately 3' waterward of the MHW line and was recently resurfaced. Adjacent to the bulkhead, a 0-15' border of coastal wetlands exist which is vegetated primarily by SSpartina alterniflora. An approximately 370' long pedestrian pier extends into Bogue Sound and was authorized by a General Permit in 1991. The area of Bogue Sound in front of this property can be characterized as relatively shallow with water depths approaching -4' MLW approximately 400' seaward of the shoreline. Within this 400' area are scattered amounts of seagrass vegetation growing in a sandy/silt substrate. Scattered amounts of oysters were observed near the shoreline and several clams were handraked during a recent site visit. The waters of Bogue Sound adjacent to the applicant's property are classified as 'SA' and are open to the harvesting of shellfish. The arplica,it is requesting a permit to extend the existing boat ramp waterward and to excavate a turning basin and access channel in Bogue Sound. The proposed boat ramp is to be approximately 20' long x 12' wide x 6" thick and will terminate in a proposed 50' long x 50' wide (top width) x -4' MLW deep boat basin. An approximately 25' long x 4' wide finger pier would be constructed parallel to the boat ramp. The proposed access channel would extend from the boat basin for a distance of approximately 340' in length x 30' width (top) x -4' MLW deep. Excavation is proposed to be accomplished by the use of a hydraulic dredge with the approximately 1,250 cu. yds. of spoil material being pumped to an irregularly shaped diked disposal area. The applicant's engineer has calculated that the dike would contain approximately 1600 cu. yds. of material. 10. ANTICIPATED IMPACTS: It is estimated that the proposed excavation will directly impact approximately 3,000 sq. ft. of sea grass vegetation and potentially 13,000 sq. ft. of shellfish bottom. This, however, must be confirmed by an appropriate survey which has not been done as of this date. The approximately 1,250 cu. yds. of primarily sand/silt material to be excavated would be placed in a diked disposal area which should be adequate with property monitoring. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. C. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. The information provided below should be of assistance in your evaluation of the project. a. Justification: The plan which we have proposed is excavation of a channel, running perpendicular to the shoreline. The proposed excavation follows the former alignment of a channel which was originally excavated in the 1960's. There is no upland alternative for channel excavation to provide a logical extension of the boat ramp which exist at the shoreline. We feel that we selected the most appropriate location for maintenance of an existing channel . b. Development to minimize adverse impacts: The layout of the turning basin was modified by positioning it westward to more closely protect the marshgrass located on the east side. We also set a five (5) foot area of undistrubed soil between the edge of the channel and the edge of the marsh grass. c. Unavoidable loss of waters or wetlands: We see no unavoidable loss of wetlands, no unavoidable loss of waters and believe that digging the channel will simply return the area as it was in the 1960's. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. By letter of December 8, 1992 (copy enclosed), the National Marine Fisheries Service (NMFS) recommends that authorization be denied. NMFS is concerned regarding the projected loss of approximately 3,000 square feet of submerged aquatic vegetation (SAV) and about 13,000 square feet of shellfish habitat. At this time, we concur with the recommendation of the NMFS. Should the applicant successfully rebut the NMFS comments or alter plans to lessen or eliminate adverse impacts, we will reconsidered our position.
