Reference the application of Mr. David Beckner for a Department of the
Army permit to replace the Yaupon Beach commerical fishing pier on the
Atlantic Ocean, Yaupon Beach, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
C. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.
d. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
e. This permit does not grant any property rights or exclusive
privileges.
f. This permit does not authorize interference with any existing or
proposed Federal project.

g. The National Ocean Survey (NOS) has been notified of this
authorization. The permittee must notify NOS and the Wilmington District
Engineer, in writing, at least two weeks before beginning work and upon
completion of the authorized work. The notification of completion will
included a drawing which certifies the location and configuration of the
completed activity (a certified permit drawing may be used). Notifications to
NOS will be sent to the following address: Director, National Ocean Survey
(H/CG 222), Rockville, Maryland 20852.

8. Project Summary The applicant proposes to reconstruct the Yaupon Beach Fishing
Pier to the original dimensions that existed prior to hurricane storm damage in
1989 The pier would be 914 feet long 16 feet wide with a 40 feet by 16 feet
T-head platform constructed at the waterward end.

The projec.-t site is the existing location of the Yaupon Beach public ocean
fishing pier at 705 Ocean Drive, Yaupon Beach, on Oak Island in Brunswick County.
The high ground property area is approximately 1/2 acre in size. It measures
approximately 200 feet wide by 110 feet deep to the east, and 140 feet deep to
the west. The average elevation of the property is 9.4 feet. The southern, or
ocean side of the property is stabilized with large concrete rip rap, which pre-
dates the Division's ban of ocean front hardening structures. The rip rap begins
at the applicant's eastern property line and extends several hundred feet west
of the project. Existing high ground structures include a combination
restaurant/pier house (approximately 4000 sq. ft. ), and paved parking area
(approximately 13000 sq. ft.). The ocean fishing pier sustained moderate damage
during Hurricane Hugo in 1989, losing several hundred feet of pier decking and
numerous pilings. The previous owner opted not to make immediate repairs to the
pier, and subsequent structural deterioration over the past three years resulted
in the condemnation of the pier as unsafe by local inspectors. The pier currently
exists in three separate sections, with remnant pilings and other debris exposed
in the water between sections, as well as several hundred feet waterward of the
end of the last section.
The long-term annual erosion rate in the project area is three (3) feet per year.
The Flood Insurance Rate Map (F.I.R.M.) classifies the project area in the
Coastal Flood Hazard and Velocity Zone (VE-22), with a base flood elevation of
22 feet. The Town of Yaupon Beach's, Focal Flood Ordinance, requires that
structures be elevated an additional two (2) feet above the base flood elevation.
The waters of the Atlantic Ocean are classified SB, by the N.C. Division of
Environmental Management.
The applicant and new property owner, is currently in the process of dismantling
and removing the hazardous debris and remains of the old pier. He proposes to
rebuild the pier along the same alignment, and to the same dimensions that
existed prior to the 1989 storm damage and subsequent deterioration, resulting
from neglect. The pier would be 914 feet long and 16 feet wide. A T-shaped
platform, 40 feet long and 16 feet wide, would be constructed at the waterward
end of the pier. Engineered construction details indicate that the elevation of
the pier's lowest horizontal supporting timber would be raised from 18.75 feet
to 24 feet, to meet the Local Flood Ordinance regulations. There are no
construction or improvements proposed for the existing high ground structures or
property.
10. ANTICIPATED IMPACTS
The proposed replacement of the ocean fishing pier would cover the same 15,264
square feet of waters of the Atlantic Ocean as the previous pier. The removal of
the existing pier debris would abate the navigational and public safety hazards
that currently exist with the pier in it's present state of disrepair. The
rebuilding of the pier would provide public access and utilization of the
resource, as well as, promoting the local economy through associated business
(i.e. motels, restaurants, tackle shops, etc.).

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-01291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received September 21, 1992, for Department
of the Army authorization to replace the Yaupon Beach commerical fishing ?iqr;
on the Atlantic Ocean, Yaupon Beach, Brunswick County, North Carolina,
indicates it to be a candidate for Federal authorization under this generall
permit. Accordingly, the administrative processing of your application will
be accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the

8. Project Summary The applicant proposes to reconstruct the Yaupon Beach Fishing
Pier to the original dimensions that existed prior to hurricane storm damage in
1989 The pier would be 914 feet long, 16 feet wide, with a 40 feet by 16 feet
T-head platform constructed at the waterward end.

9. PROJECT DESCRIPTION
The project site is the existing location of the Yaupon Beach public ocean
fishing pier at 705 Ocean Drive, Yaupon Beach, on Oak Island in Brunswick County.
The high ground property area is approximately 1/2 acre in size. It measures
approximately 200 feet wide by 110 feet deep to the east, and 140 feet deep to
the west. The average elevation of the property is 9.4 feet. The southern, or
ocean side of the property is stabilized with large concrete rip rap, which pre-
dates the Division's ban of ocean front hardening structures. The rip rap begins
at the applicant's eastern property line and extends several hundred feet west
of the project. Existing high ground structures include a combination
restaurant/pier house (approximately 4000 sq. ft. ), and paved parking area
(approximately 13000 sq. ft.). The ocean fishing pier sustained moderate damage
During Hurricane Hugo in 1989, losing several hundred feet of pier decking and
numerous pilings. The previous owner opted not to make immediate repairs to the
pier, and subsequent structural deterioration over the past three years resulted
in the condemnation of the pier as unsafe by local inspectors. The pier currently
exists in three separate sections, with remnant pilings and other debris exposed
in the water between sections, as well as several hundred feet waterward of the
end of the last section.
The long-term annual erosion rate in the project area is three (3) feet per year.
The Flood Insurance Rate Map (F.I.R.M.) classifies the project area in the
Coastal Flood Hazard and Velocity Zone (VE-22), with a base flood elevation of
22 feet. The Town of Yaupon Beach's, Local Flood Ordinance, requires that
structures be elevated an additional two (2) feet above the base flood elevation.
The waters of the Atlantic Ocean are classified SB, by the N.C. Division of
Environmental Management.
The applicant and new property owner, is currently in the process of dismantling
and removing the hazardous debris and remains of the old pier. He proposes to
rebuild the pier along the same alignment, and' to the same dimensions that
existed prior to the 1989 storm damage and subsequent deterioration, resulting
from neglect. The pier would be 914 feet long and 16 feet wide. A T-shaped
platform, 40 feet long and 16 feet wide, would be constructed at the waterward
end of the pier. Engineered construction details indicate that the elevation of
the pier's lowest horizontal supporting timber would be raised from 18.75 feet
to 24 feet, to meet the Local Flood Ordinance regulations. There are no
construction or improvements proposed for the existing high ground structures or
property.
10. ANTICIPATED IMPACTS
The proposed replacement of the ocean fishing pier would cover the same 15,264
square feet of waters of the Atlantic Ocean as the previous pier. The removal of
the existing pier debris would abate the navigational and public safety hazards
that currently exist with the pier in it's present state of disrepair. The
rebuilding of the pier would provide public access and utilization of the
resource, as well as, promoting the local economy through associated business
(i.e. motels, restaurants, tackle shops, etc.).

SECTION 2.0 MATERIALS AND CONSTRUCTION
DIVISION OF
COASTAL h1ANAGLEMENT
2.1 GENERAL REQUIREMENTS:
This work includes labor, materials, equipment, necessary
to construct pier as shown on plans.
2.2 LUMBER :
Lumber shall be No.2 Southern Yellow Pine. All lumber shall be
pressure treated in accordance with AWPA C1. Preservative
treaty„ent shall be for continuous salt water immersion and ground
contact with a minimum of .80 pounds per cibic foot net
retention. All lur,,ber-hall bear the grade mark of a certifi_-d
grading agency and the AWPA LP-22 grade mark.
2.3 BOLTS
Bolts shall be hot dipped galvanized in accordance with ASTM
A153. Bolts shall be installed with 3" x 3" x 3/8" washers or
round washer. Bolts shall not be over-torqued so as to deforr„ the
washer. Hole size shall not exceed bolt (liar:eter by mcire titan
2.4 MISCELLANEOUS=STEEL COMPONENTS
Steel corriponeritc ; ha` be ASTM A3G but
accordance with ASTM A153.Galvanizing :_;hal be perforiied after
fabrication.
2.5 NAILS:
Nails shall be Commercial grade common wire nails hot dipped
galvanized in accordance with ASTM A153.
2.6 PILES;
Piles shall be Southern Yellow Pine Cori for mijig to ASTM D25-73 and
ASTM D2289-74. Pile shall bt_ L)ru-ure treated in accordan, u
witl-, AWPA C3 and C18. Preservative treatment shall be for
continuous salt water immersion and ground contact with a r:.ir,i?rum
of 0.30 pounds per cubic foot net retention. All piles shall
bear the grade mark of a certified grading agency ai;d the 1.W71 A
LP-22 grade mark. Miniruur;i pile size _:;gall bu Cla,s 2, (:0- ?oc;t
length in accordaric with ANSI-05.1.

The butt end of the piles shall be embedded to the initial
geologic shell layer, but riot less than 12 feet. Minimum safe tip
capacity of pier piles shall be 11,800 pounds. Piles may jetted
for initial placen;erit but shall be driven below the jetted depth
until the required capacity is obtained by t1he following formula:
P= 2WH / (S + 0.7H/15)
P= BEARING CAPACITY (POUNDS)
W= WEIGHT OF DRP HAMMER (FEET)
S= AVERAGE PENTRATION IN INCHES PER BLOW FOR
THE LAST TEN BLOWS
The fall of the hammer shall not exceed ten (10) feet.
