Johnson, Office Manager U.S. Army Corps of Engineers, Asheville FROM: Dennis Stewart, Program Manager Habitat Conservation Program AWA?U44J DATE: August 24, 1992 SUBJECT: A 404 permit review of an application by Mr. J. C. Cope to install a 48" culvert in an unnamed tributary to the Swannanoa River, Buncombe County The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by Mr. J. C. Cope, and staff field biologists on our staff are familiar with habitat values of the project area. An onsite investigation was conducted on August 13, 1992 for the purpose of further assessing potential construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant effects to waters supporting trout. Therefore, we do not object to the project as described. We appreciate the opportunity to provide our comments concerning this project.
