Cedar Island NWR is a naturally fire maintained ecosystem, and essentially all parts of the refuge, other than sites around buildings, should be burned on a fairly regular schedule. 2) Determination does not provide any info!:ma,tio-. on the location6 of the proposed firelines. There are several rare plants and animals on the refuge. Although it is unlikely that such species would be directly impacted by the construction of firelines, such impacts have occurred in other natural areas in the state, where firelines were constructed along the ecotone between savannas or flatwoods and pocosins, where the highest diversity of rare plants frequently occurs. The Natural Heritage Program would like to receive any information on locations of proposed firelines and burrs units, in order to be certain that no direct impacts to such species will occur. 3) The Division encourages the use of fire on the refuge. Several suggestions to burning are hereby made. a) if at all possible, fires should be directed from uplands (including flatwoods) toward wetlands such as marshes, so that the fires will be extinguished in a natural manner. Firebreaks should not be constructed along such a wetland/upland ecotone unless absolutely necessary. b) Extensive, large units of the same habitat should not be burned at. the same time, if possible. Animals need escape cover and suitable habitat in which to forage and later reproduce, so that the burned portions can later be re-colonized by animal populations from adjacent un-burned areas. The NC Division of Parks an Recreation generally supports the proposal although they do have concerns regarding potential impacts on rare an endangered species. A copy of their comments is attached. The NC Division of Health Services states that depressions made by tractors and deposits can provide mosquito breading habitat. Consistency Determination Proposed Action. Maintenance of Existing Firel.ines and Establishment of Additional Firelines on Cedar. Island National. Wildlife Refuge, Carteret County, North Carolina Proponent: U.S. Fish and Wi_ldlif.P Service, Mattamuskeet- Swanquarter-Cedar Island National Wildlife RefUges, Swan Quarter., Norr_h Carolina Description of Activity. As a natural. resource agency, the U.S. Fish and wildlife service has historically yt_r.'ived to practice good otewa.rdsh-ip of the lands of the National Wildlife Refuge System. One management practice used is prescribed horning (flra under prescribed conditions) in those habitat typen whore fire wars/is a Component of the ecosystem. Fire is also used to manage vegetation for the benefit of certain wildlife (endanger.Pd species and migratory birds) that, are :important in the agency's mission. Cedar Island National Wildlife Refuge (NWR) consists of approximately 11,000 acres of. irregularly flooded marsh (black needlerush), 1,000 acres of upland forest (Longleaf pine/loblolly pine), 1.,450 acres of high pocosin (pond pine bays, wax myrtle, gallbPrr.y) and 850 acres of mixed hardwoods (red maple, black gum, water oak, yellow poplar). Fire has historically been ar, i rnportdr,t, Factor of various habitat types in the Atlantic c_oa9tal plain. However, modern society's activities of read systemh, urbanization and fire protection pract-tees have greatly impacted the role of fire in the habitat types of this geographical region. Prescribe burning has historically been used on Cedar Island NWR but budget and manpower constraints have limited the frequency of this management ac_ti.vity. Cedar Island has an active history of wildfires with the last major- wildfire occurring in 1985. Fuel loads in the marshes and pi.ne forests are increasing annually and present a high fire danger. Prescribe burns under specified environmental condi ti ores at periodic time intervals will reduce these fuel leads and maintain native flora and fauna. To implement. r.hese prescribe bur.r,s, existing and new firelines will be plowed with off-set disks or fire plows pulled by crawler tractors :in the forested portions of the refuge. Firelines plowed with fire plows will be reclaimed with a f_ir.eline reclamation plow or other equipment to return the line to its original elevation and contour after the prescribe burn is completed. Where plowed lines must be connected with estuarine shoreline, the line will. be plowed to within a few feet of the shoreline and hand lines and/or_ wet lines used to connect the fi.reline to the water's edge. The distance betwACan the plowed line and the shoreline will, be determined by topography and slope of the area adjacent to the shoreline. Appropriate actions to minimize potential erosion and runoff into the estuarine waters will be implemented. Since many of the needed firelines transverse swales and other small areas that might be considered wetlands, the Service has applied for a General Permit #297 (GP 297 permit) from the U.S. Army Corps of Engineering for the plowing of f_irelines on Cedar Island NWR over the next three to five years- The!?c lines will be plowed on an as needed basis to implement pre-scribe burns or protect the refuge from fires occurring on adjacent land holdings. only a few of these lines will be plowed in any given year. Additional firel.ines will be needed in the future for other portions of tho refuge which will require an addendum to the GP 297 permit- Those lines will be conform with the activities conducted under this general consistency determination and will thus be covered by this determination. Consistency Determination In accordance with the Federal Consistency .requirements of. Section 307 of the Coasstal Zane Managment, Act of 1972, as amended, the on-going ar.t:i vi t:y has been reviewed for consistency wi.th the North Carolina Coastal Management Program. Based can that review it has been determined that this on-going activity iq connintent_ to the maximum extent practicable with the program. The .f.oll.owing information is provided to support this determination. Areas of Environmental Concern (AFC) Within the boundary of Cedar Island NWR are coastal wetlands (marshes) and estuarine shoreline, both AEC's under the North Carolina Coastal Management Program. Adjacent to the refuge is another AFC, estuarine waters. 1. Coastal. The state's guidelines for water dependency are specifically targeted at development projects that provide cultural ameni.tiAS for the human population and do not. consider natural resource management activities and project.s_ (2) (A) The activity is supportive of the stated objective for the estuarine system because the activity safely facilitates t_ho biological. role of fire in coastal habitats without adversely impacting the other- values of the estuarine system. (B) The on-going activity is site specific for the management. actJon to properly manage Cedar Tsland NWR. Fi.rel.ines are located in timbered or upland sites to the maximum extent, possible but the nature of fire necessitates continuous breaks to natural. feaT.ures or breaks to contain fire within a prescribed area for safety and management purposes. (C) The plowing of f.ireli.nes may require a water quality permit under Section 401 of the Clean Water Act and i9 being coordinated with the appropriate State agency. Air. quality (smoke management) considerations are undertaken when preparing prescribe burn prescriptions. Fires are only ignited under atmospheric and climatic conditions that minimize smoke and air duality Impacts. (D) The activity is riot, expected to iMPdCt any known archeological or historic resources. Comments from the N.C_ Department. of Cultural- Resources have been requested. (E) The activity as proposed will not measurably increase siltation based on past experiences with habitat types, soils, and topography involved. (P) The activity wi.11 not change contours and elevdLioris of Lhe Lopography Lhus 1L will noL create stagnant water bodies. Management activities generally strive to enhance and/or protect native fauna and flora for the public's benefit. Adjacent property owners stand to benefit from this activity by the reduction of the fire hazard potential to their property. Thera are no known adverse impacts to the estuarine resources from this activity. (4&5) Certain adjacent estuarine waters are classified as primary nurbery areas by the N.C. Marine Fisheries Commission and Outstanding Resource Waters by the N.C. Environmental Management Commission. The activity is not known to nor expected to have any adverse impact: on the water quality or resource values of the estuarine system. (b) Specific Use Standards - The specific use standards identified in 15 NC 07H.208 are not applicable to this activity. T1- Estuarine Shoreline (e) General Une Standard: for Estuarine Shorelineo AFC 15 NCAC 7H.0209 1) Activity will not weaken or eliminate natural barriers to erosion 2) No impervious surfaces are involved in the activity 3) The activity will he consistent with the standards of the N.C. Sedimentation Pollution Control. Land Use Plan, The J.ocal Carteret County Land Use Plan classifies the general. area containing Cedar Tsland NWR as conservation and there are no apparent confl.ict.s with this plan from plowing firelines. Conclusion The on-going activity of plowing firelines on Cedar Tsland NWR in Carteret County, North Carolina to cornduct per;i.odi.c prescribe burns to proter.t, and enhance refuge resource values, and reduce the potential of wildfire hazards to public, and private property, has been reviewed for consistency with the N.C. Coastal Management Program. The only disparity of the activity is related to the state's general. use standard of water dependency. However, the language and examples of this use standard specifically address physical structures serving the human population rather than resource management. activities. The creation of firel.ines is primarily located outside of the srate's ACE's but the safety consideration of conducting a prescribe burn requires some type of firebreak to transverse wetlands and/or connect, with the estuarine shoreline- Appropriate actions are being and will be taken to minimize the activity's impact on the state's AECs_ Only 1.05 acres of coastal wetlands and a minute acreage of estuarine shorelines are involved in this activity. The activity is ongoing with only a portion of the fireli.nes being plowed each year.
