Reference your application for Department of the Army authorization to
install a subsurface fiber optic lightguide cable from Asheville to Johnson
City, Tennessee through Buncombe and Madison County, North Carolina. The
alignment will involve crossings of various waters of the United States, all
tributary to the Tennessee River. The project has been reviewed by the N.C.
Wildlife Resources Commission (WRC) for any potential adverse impacts to trout
waters; and the US Fish and Wildlife Service for potential impacts to
Federally listed threatened or endangered species.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for the discharge of material for backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in
pre-construction contours.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions. This NWP does not relieve you of the
responsibility to obtain any required State or local approval. Information
regarding issuance of a Section 401 Water Quality Certification may be
obtained through Mr. John Dorney, Division of Environmental Management, at
(919) 733-1786.
This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized

provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

Upon review of your request for 401 Water Quality
Certification to place fill material in 0.3 acres of wetlands or
waters for lightguide cable installation located as shown on your
permit application in Buncombe and Madison Counties and
directional bore under the French Broad River in Buncombe County,
we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2664 issued January 21,
1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 12.

Thank you for your letter of April 22, 1992, concerning the above
project.
There are no known archaeological sites within the proposed
project area. Based on our present knowledge of the area, it is
unlikely that any archaeological resources which may be eligible
for inclusion in the National Register of Historic Places will be
affected by the project construction. We, therefore, recommend
that no archaeological investigation be conducted in connection
with this project.
The above comments are made pursuant to Section 106 of the
National Historic Preservation Act of 1966 and the Advisory
Council on Historic Preservation's Regulations for Compliance
with Section 106, codified at 36 CFR Part 800.

RE: Proposed AT&T Lightguide Cable Route from Asheville, North Carolina to

Dear Mr. Baker:
AT&T Communications requests to do the aforementioned work under the new
Nationwide Permit Number 14 for utility work. We believe we will be eligible for this
permit and the applicable certification.
AT&T proposes to install 1-4 inch steel pipe to a minimum depth of 48 inches, 48
inches under stream bed, by open trench method to house the new lightguide cable.
Construction will be confined to a maximum corridor of 20 feet wide. Pre-project
wetland elevations and contours will be restored.
After extensive research from various map sources and detailed field surveys, we have
identified the streams and wetlands listed to be within our construction corridor.
Enclosed you will find a permit application, four (4) USGS Quadrangle Maps with the
proposed route and all stream crossings highlighted for easy review. A typical stream
crossing detail and detailed drawings of all major streams is also included for your
review along with a complete list of each location. All crossings are numbered on the
Quadrangle Sheets to coincide with the list.

project.
There are no known archaeological sites within the proposed
project area. Based on our present knowledge of the area, it is
unlikely that any archaeological resources which may be eligible
for inclusion in the National Register of Historic Places will be
affected by the project construction. We, therefore, recommend
that no archaeological investigation be conducted in connection
with this project.
The above comments are made pursuant to Section 106 of the
National Historic Preservation Act of 1966 and the Advisory
Council on Historic Preservation's Regulations for Compliance
with Section 106, codified at 36 CFR Part 800.

SEDIMENTATION CONTROL PLAN
1. CLEAN-UP AND RESTORATION
1.01 Initial clean-up shall consist of removing any unwanted soil, rocks, tree branches,
and construction material. The entire work area shall be smoothed and graded.
Also included are temporary soil erosion control measures.
1.02 Final clean-up shall follow construction within 30 working days.
Final clean-up shall consist of preparation of ground, seeding, and fertilizing of
all disturbed areas and will include hand raking as necessary, fence restoration,
terraces, and berms.
1.03 The entire work area, including ingress-egress to construction site, shall be
restored as nearly to its original condition as practical.
1.04 All complaints concerning clean-up and restoration of property disturbed by
construction are to be handled immediately. If the situation warrants, the
contractor will be expected to form an additional and separate clean-up crew to
handle property owner complaints.
1.05 All areas disturbed by construction shall be leveled, fertilized with a 10-10-10
mixture at a rate of 100 pounds per acre, apply lime at a rate of two tons per acre,
and seeded with KY-31 Fescue, (100 lbs/acre). Mulching at a rate of 2,000/4,000
pounds per acre will be required. The right-of-way in pastures and fields shall be
seeded with like seed.
Where any work disturbs the area outside the right-of-way, the contractor shall
insure that the area is completely restored in a manner acceptable to the AT&T
Communications, Inc. representative and property owner. Sod that is removed
shall be replaced with the same type. Unsodded areas shall be graded and then
seeded and mulched.
The contractor is responsible for establishing a dense stand of permanent grass
within a reasonable time. Shrubbery that is removed or destroyed shall be
replaced with equal types and sizes. Grassing and mulching operations are to
begin immediately after construction/installation has been completed.

1.06 When crossing manicured grass areas of Centipede, St. Augustine, Zoysia, or like
sod, sod is to be replaced with same as the undisturbed area.
1.07 The contractor shall be liable for all damage, injury, or loss to persons or property
to any character arising from or resulting from any act of commission, omission,
neglect or misconduct in the performance of work by the contractor, his
employees or agents. The contractor shall be further liable for all damage, injury,
or loss to persons or property arising from, or as a result of defective work or
materials.
1.08 Trees scarred, nicked or damaged by construction in public areas are to be
removed or have damaged areas painted over with an appropriate type of sealer.
2. SOIL EROSION, CORRECTIVE, PREVENTIVE, AND CONTROL DEVICES
2.01 Soil Erosion Control
The entire work area shall be restored as nearly to its original condition and in
accordance with current Department of Natural Resources requirements.
Temporary erosion control measures, silt check dams, silt fences, temporary slope
drains, brush barriers, or temporary seeding and mulching, shall be used as
required.
Erosion control measures shall be completed as soon as practical to minimize
damage to disturbed and undisturbed areas.
2.02 Corrective
Filling, repairing, or otherwise stabilizing existing surface conditions, ruts,
washes or other disturbances which lead to soil erosion. This includes all existing
or new right-of-way disturbed or undisturbed by construction.
Filling, repairing, or otherwise stabilizing ground surface disturbed during
construction. This will include filling and stabilizing of ruts which develop off
the right-of-way as a result of construction activity. This also applies to public
and private roads, private property, or driveways used for right-of-way across
during construction activities.

2.04 Control Devices
In addition to other measures that may be required, the following methods of
typical control will be required as shown on specification drawings.
A. Plugs
Plugs are built into the trench to act as a barrier to keep water from
flowing along the trench. The plug must extend into undisturbed earth
regardless of the width of the trench. Trench widths will determine the
arrangement and volume of plugs. Plugs will be required at all terraces
through areas that have open trenches.
B. Terraces
A Terrace is a long shallow mound used to divert water away from the
cable trench. Terraces shall be long enough and so constructed that they
do not divert water to disturbed construction area.
C. Diversion Berms
Diversion berms are constructed at stream and creek banks to divert water
run-off from surrounding areas from entering creeks or streams along
cable trench.
D. Retaining Walls
Retaining walls are used to control and re-establish steep banks that have
been disturbed during trench excavation. Place interlocked bags of earth
or rip rap in trench and all disturbed areas to restore normal contour to the
bank.
