Upon review of your request for Water Quality Certification
to place conduct streambank stabilization along 180 feet of
Sweeten Creek located at Kellwood Building Site in Asheville,
Buncombe County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2665 issued
January 1, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 13.

by removal of vegetation and silt deposits along the banks of both sides of the stream, sloping the banks
back to generally conform with the width and slope of the banks immediately upstream, and placement of
rip rap along the toe of each bank. A temporary rip rap check dam will also be placed in the stream of
erosion control during construction.
The enclosed copy has been provided to your office to verify that this project is approvable under
general Water Quality Certification. We would appreciate your timely review and reply at your earliest
convenience.

Dear Mr. Baker:
Thank you for your time recently in meeting with me at the above site. You may recall that the work
on the project generally consists of improvements to an existing stream by removal of vegetation and silt
deposits along the banks on both sides of the stream, sloping the banks back to generally conform with the
width and slopes of the banks immediately upstream, and the placement of rip rap along the toe of the
banks to prevent further erosion. It appeared that the project would fall under 33 CFA Part 330.5(a)(13), a
nationwide permit for bank stabilization activities and our meeting was to confirm that opinion.
As you have instructed, the "Joint Application Form for Nationwide Permits That Require Notification
to the District Engineer" has been completed. Enclosed are two (2) copies of that form. I am also
transmitting copies of this letter and application forms to Mickey Clemmons with Wildlife Resources.
Based on our conversation, it is my understanding that this project is approvable under general Water
Quality Certification and under Nationwide Permit by the Corps as the construction activities are less than
the minimum activity allowed before additional permits are required. All of the provisons of 330.5(a)(13)
appear to apply to this project especially since the bank stabilization project is approximately 180 feet in
total length and is limited to less than an average of one (1) cubic yard of rip rap fill per linear foot. A
temporary rip rap check dam to be installed downstream for erosion control will be less than ten (10) cubic
yards of material below normal stream depth. It is also my understanding that this area is not considered
wetlands.
