8. Project Summary The applicant proposes to construct a 172' X 6' pier including a
10' X 12' and 16' X 8' platform which encroaches into the minimum 85' setback from a
federally maintained channel.

9. PROJECT DESCRIPTION
The applicant currently owns a 0.60 acre tract of land off River Road, Lot#
307, Lockwood Folly Subdivision, adjacent the Lockwood Folly River, Brunswick
County. The applicant has cleared the property, and is in the process of
constructing a single family residence. The shoreline contains a plush stand
of Spartina alterniflora and other coastal wetland species. The Federally
maintained channel of Lockwood Folly River lies within 85' from mean high water
along the property.
The applicant proposes to construct a 172' X 6' pier including a 10' X 12'
and 16' X 8' platform at the waterward end. The water depth at this location
is approximately -4.01. The waterward end of the proposed pier will encroach
upon the minimum 85' setback form the near-bottom edge of Federally maintained
channel 15' leaving a 70' separation .
The adjacent waters are classified SA by the Division of Environmental
Management and are currently designated as a primary nursery area.
There appears to be no areas of archeological/historical significance within
the project area.
10. ANTICIPATED IMPACTS
Localized short-term turbidity increases will result from piling placement
during construction of the proposed pier. A large vessel moored at the
waterward end of the proposed platform could cause a navigational hindrance.
The decking of the proposed structure will shade approximately 840 square feet
of coastal wetlands. The structure waterward of the marsh fringe will shade
approximately 840 square feet of public trust waters.
The US Army Corps of Engineers have requested Public Notice for the proposed
encroachment into the minimum 85' setback.

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
12 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line p e 2 Z
prints or other larger plats are acceptable only if 0 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must b?_-- sufficiently detailed
to guide agency personnel unfarniliar with the area to the

Reference the application of Mr. John F. Parker for a Department of the
Army permit to construct a pier on the Lockwood Folly River, Lot No. 307,
Lockwood Folly Subdivision, Brunswick County, North Carolina.
We have completed our review of Mr. Parker's plan as presented by the
application and your field investigation report. In conjunction with our
Navigation Branch, we find that the waterward end of the pier, as proposed,
would extend to the very edge of the Federally maintained channel; and
therefore, its construction and use would create an undue hazard to
navigation. The site of proposed work is on the outward side of a turn in the
channel, and as there is a tendency for shoaling to occur on the inward side
of the channel, deeper draft vessels use the side of the channel upon which
Mr. Parker plans to encroach. Additionally, by letter of August 14, 1992
(copy enclosed), the Honorable Judy L. Galloway, Mayor, Town of Varnamtown,`
stated that the pier would be a navigational hazard and requested that the
application not be approved. We agree that authorization should not be
provided for the pier as designed. We will be glad to discuss alternatives
with Mr. Parker which would provide for his riparian access.

Reference the application of Mr. John F. Parker for a Department of the
Army permit to construct a pier on the Lockwood Folly River, Lot Nd. 307,
Lockwood Folly Subdivision, Brunswick County, North Carolina. Also, reference
our letter to you of September 1, 1992.
In conjunction with our Navigation Branch, we have reevaluated
Mr. Parker's plan. To allow him to express his right of riparian access, we
recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. Neither the pier or associated floating dock will extend closer than
43 feet to the near edge of the Federally-maintained channel or reach further
waterward than the natural depth contour of two feet at mean low water (MLW).
C. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
d. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
e. The permittee must install and maintain, at his expense, any signal
lights and signals prescribed by the U.S. Coast Guard, through regulations or
otherwise, on authorized facilities.

f. It is possible that the authorized structure may be damaged by
wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
g. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received July 23, 1992, for Department of the
Army (DA) authorization to construct a pier on the Lockwood Folly River,
Lot No. 307, Lockwood Folly Subdivision, Brunswick County, North Carolina,
indicates it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your application will
be accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
