Dear Mr. Furness:
Reference your application for a Department of the Army permit to install
six 19-cluster, wood-pile dolphins on the Adams Creek Canal, Atlantic
Intracoastal Waterway (AIWW), near the Core Creek Bridge, Carteret County,
North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Dear Mr. Parker:
Reference the application of Iftmasgulf, Incorporated, represented by
Mr. Jeffrey C. Furness, for a Department of the Army permit to temporarily
install six, 19-cluster, wood-pile dolphins on the Adams Creek Canal, Atlantic
Intracoastal Waterway (AIWW), adjacent to the Core Creek Bridge, Carteret
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
c. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
d. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.
e. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit.

f. Immediately upon completion of the construction of the new Core Creek
Bridge, all six, 19-cluster, wood-pile dolphins will be removed.

8. PROJECT SUMMARY: The applicant is proposing to place 6 cluster
dolphins up and downstream of the Core Creek Bridge, in the AIWW.

9. NARRATIVE DESCRIPTION: Texasgulf, Inc. is requesting a
permit to place a total of six (6) temporary cluster
dolphins in the AIWW, near the Core Creek Bridge, in
Carteret County. Three (3) of the cluster dolphins will be
placed approximately 1800' north of the existing bridge and
on the east side of the channel, while the other three (3)
will be located approximately 3,900' south of the bridge and
on the west side of the channel. Each dolphin will consist
of approximately 19 pilings and will be located at the toe
of the Federally maintained channel in approximately -12'
(MLW) of water.
The purpose of the project is to provide a temporary staging
area so that only one barge at a time will be pushed through
this area of Core Creek since the new bridge construction is
restricting normal navigation through the area. After one
barge is pushed through, it will be temporarily moored at
one set of dolphins until the tug boat can go back and
retrieve the second barge which will be at the other mooring
area. The applicant has indicated that once the high-rise
bridge is completed, the mooring dolphins will be removed.
It is estimated that this will be within approximately two
(2) years.
10. ANTICIPATED IMPACTS: The project as proposed will result in
the placement of six (6) cluster pilings on the channel's
edge of the Federally maintained AIWW. Approximately 114
sq. ft. of bottom area will be displaced with the placement
of the mooring dolphins. Once the high-rise bridge is
completed, all pilings will be removed. Since the
development is being undertaken along the channel's edge of
the AIWW, it will be extremely important to have appropriate
markings on the structures to prevent them from becoming a
navigational hazard.

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out

sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's

8. PROJECT SUMMARY: The applicant is proposing to lace 6 cluster
dolphins up and downstream of the Core Creek Bridge, in the AIWW
FIELD INVESTIGATION REPORT - TEXASGULF, INC., CARTERET COUNTY

9. NARRATIVE DESCRIPTION: Texasgulf, Inc. is requesting a
permit to place a total of six (6) temporary cluster
dolphins in the AIWW, near the Core Creek Bridge, in
Carteret County. Three (3) of the cluster dolphins will be
placed approximately 1800' north of the existing bridge and
on the east side of the channel, while the other three (3)
will be located approximately 3,900' south of the bridge and
on the west side of the channel. Each dolphin will consist
of approximately 19 pilings and will be located at the toe
of the Federally maintained channel in approximately -12'
(MLW) of water.
The purpose of the project is to provide a temporary staging
area so that only one barge at a time will be pushed through
this area of Core Creek since the new bridge construction is
restricting normal navigation through the area. After one
barge is pushed through, it will be temporarily moored at
one set of dolphins until the tug boat can go back and
retrieve the second barge which will be at the other mooring
area. The applicant has indicated that once the high-rise
bridge is completed, the mooring dolphins will be removed.
It is estimated that this will be within approximately two
(2) years.
10. ANTICIPATED IMPACTS: The project as proposed will result in
the placement of six (6) cluster pilings on the channel's
edge of the Federally maintained AIWW. Approximately 114
sq. ft. of bottom area will be displaced with the placement
of the mooring dolphins. Once the high-rise bridge is
completed, all pilings will be removed. Since the
development is being undertaken along the channel's edge of
the AIWW, it will be extremely important to have appropriate
markings on the structures to prevent them from becoming a
navigational hazard.
