The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted structures must not interfere with the public's right to free navigation on all navigable waters of the United States. b. If the display of lights and signals on the authorized structures is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. The permittee will maintain the authorized structures in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted structures without having them transfered to a third party. J. PROJECT SUMMARY: The applicant proposes to revamp the built- upon areas on the highground property and add physical amenities to the waterfront such as, a bulkhead, boat ramp, pier with 4 boat slips. 9. NARRATIVE DESCRIPTION: The applicant, Mr. Donald R. Carpenter, Jr., is the owner and operator of Performance Marine Sales & Service, Inc., a jet ski and boat rental business located on Bogue Sound, in the Town of Indian Beach (west), Carteret County, NC. The project site is listed as Lot #3 and consists of 30,287 sq. ft. of highground property situated on the north side of the Salter Path Road (Highway 58). The rectangularly shaped property extends some 300' north of Highway 58 and is approximately 108' wide fronting on the Outstanding Resource Waters (ORW) of Western Bogue Sound. The project site is one of five (5) lots on 4 acres of land that has been subdivided from the original Indian Beach Fishing Pier property situated on the ocean side immediately south of the Salter Path Road. Mr. Ken Heaverly, the original owner of the property, is making the 5 separate lots available for redevelopment from the original campground area on Bogue Sound. As a result, a majority of the campground remains paved with marl stone and gravel that created the original driveways and parking spaces. Today, it has been calculated that 48%, or 14,516 sq. ft., of Lot #3 is built-upon and/or covered with pavement gravel and a bath house. These physical features are clearly detailed on the accompanying workplat drawings. The applicant proposes to redesign the built-upon and impervious surface areas so that the net result will limit the coverage to 32%, or no more than 9,652 sq. ft. of impact. In order to accomplish this reduction, the applicant proposes to remove the existing bath house (26' x 161) and all the existing pavement and gravel on the east side of the lot (280' x 101), as well as, that section of gravel that borders the north side of the property at the top of the bank measuring 75' x 101. In addition, an inoperative septic tank will be removed from the northeast corner of the property and backfilled with appropriate earthen material. Collectively, these areas account for approximately 5,474 sq. ft. and a similar amount of suitable sand backfill material will be imported and the surface area vegetated to control erosion. Still on the highground property, the applicant proposes to construct an office building measuring 50' long x 30' wide for a total of 1500 sq. ft. The new FIELD INVESTIGATION REPORT - PERFORMANCE MARINE SALES & SERVICE/ DONALD R. CARPENTER, JR, CARTERET CO PAGE #3 office building will be constructed at a point 75' landward of the MHW shoreline. As the workplat drawings show, the new office building will occupy about 890 sq. ft. of old gravel driveway, while 610 sq. ft. will be taken from the original grass covered area in the central part of the property. On the shoreline, the project plans call for construction of a wooden bulkhead measuring some 180' long to be installed at or landward of the MHW shoreline. On the east end of the shoreline, about 15' from the property line, the bulkhead will be notched to allow for construction of a 12' wide x 32' long wooden boat ramp for the express use of rental Hobie Catamarans. The ramp will be in close contact with the vegetated slopes of the bank that cross the dedicated 30' wide buffer zone associated with the ORW. The next item scheduled for construction is the proposed pier measuring 5' wide and having an overall length of 200 ln. ft. On the west side of the pier, a series of 5 mooring piles will create 4 boat slips, each measuring 12' x 81. The workplat drawing shows a 15' separation between the property line and the mooring piles. On the east side of the pier, 2 floating jet ski ramps will be constructed, each measuring 10' wide x 17' long. In addition, an L-head platform will be constructed on the east side of the pier and it will measure 12' x 161. The water depths along the pier average -1.8' with a maximum water depth at the end of the pier shown to be -2.6' relative to the MLW level. 10. ANTICIPATED IMPACTS: The redevelopment project will reduce the overall impervious surface area by 16%. The net result of this project will render the built-upon surface area to 9,652 sq. ft. of the 30,287 sq. ft. of Lot #3. However, the redevelopment is still 6.8%, or 2,081 sq. ft., over the maximum 25% coverage allowance by the CAMA ORW Use Standards. Nevertheless, the increased grass-covered area at some 7,571 sq. ft., and, the dedicated 30' buffer zone will significantly improve the absorptive or permeable nature of the property. The proposed bulkhead and associated backfill will arrest a long-term active erosion problem along the 108' section of shoreline. The bulkhead will be installed at or above the MHW shoreline which will help preserve the fringe of remnant cordgrass marsh on the west side of the shoreline. The proposed bulkhead alignment will also help maintain the sand beach for public use along the east side of the project shoreline. CARPENTER, JR, CARTERET CO PAGE #4 The proposed pier at 200 ln. ft. will provide water access to this commercial boat rental business and will not conflict with traditional navigational uses along Bogue Sound. The 4 boat slips are for temporary mooring of the rental boats which have been characterized as small sailboats. Like the boat slips, the 2 floating ramps at the end of the pier are for temporary docking of the rental jet ski. The jet ski/sailboat rental business is an ongoing commercial activity at the project site. The proposed improvements to the physical character of the commercially zoned property can only improve the environmental status at this location. It is doubtful if the new pier and designated boat slips will have a negative impact on the open 'SA' water quality of Bogue Sound. PREPARED BY: JAMES L. PROJECT SUMMARY: The applicant proposes to revamp the built- upon areas on the highground property and add physical amenities to the waterfront such as, a bulkhead, boat ramp, pier with 4 boat slips. 9. NARRATIVE DESCRIPTION: The applicant, Mr. Donald R. Carpenter, Jr., is the owner and operator of Performance Marine Sales & Service, Inc., a jet ski and boat rental business located on Bogue Sound, in the Town of Indian Beach (west), Carteret County, NC. The project site is listed as Lot #3 and consists of 30,287 sq. ft. of highground property situated on the north side of the Salter Path Road (Highway 58). The rectangularly shaped property extends some 300' north of Highway 58 and is approximately 108' wide fronting on the Outstanding Resource Waters (ORW) of Western Bogue Sound. The project site is one of five (5) lots on 4 acres of land that has been subdivided from the original Indian Beach Fishing Pier property situated on the ocean side immediately south of the Salter Path Road. Mr. Ken Heaverly, the original owner of the property, is making the 5 separate lots available for redevelopment from the original campground area on Bogue Sound. As a result, a majority of the campground remains paved with marl stone and gravel that created the original driveways and parking spaces. Today, it has been calculated that 48%, or 14,516 sq. ft., of Lot #3 is built-upon and/or covered with pavement gravel and a bath house. These physical features are clearly detailed on the accompanying workplat drawings. The applicant proposes to redesign the built-upon and impervious surface areas so that the net result will limit the coverage to 32%, or no more than 9,652 sq. ft. of impact. In order to accomplish this reduction, the applicant proposes to remove the existing bath house (26' x 161) and all the existing pavement and gravel on the east side of the lot (280' x 101), as well as, that section of gravel that borders the north side of the property at the top of the bank measuring 75' x 101. In addition, an inoperative septic tank will be removed from the northeast corner of the property and backfilled with appropriate earthen material. Collectively, these areas account for approximately 5,474 sq. ft. and a similar amount of suitable sand backfill. material will be imported and the surface area vegetated to control erosion. Still on the highground property, the applicant propose§ to construct an office building measuring 50' long x 30' wide for a total of 1500 sq. ft. The new FIELD INVESTIGATION REPORT - PERFORMANCE MARINE SALES & SERVICE/ DONALD R. CARPENTER, JR, CARTERET CO PAGE #3 office building will be constructed at a point 75' landward of the MHW shoreline. As the workplat drawings show, the new office building will occupy about 890 sq. ft. of old gravel driveway, while 610 sq. ft. will be taken from the original grass covered area in the central part of the property. On the shoreline, the project plans call for construction of a wooden bulkhead measuring some 180' long to be installed at or landward of the MHW shoreline. On the east end of the shoreline, about 15' from the property line, the bulkhead will be notched to allow for construction of a 12' wide x 32' long wooden boat ramp for the express use of rental Hobie Catamarans. The ramp will be in close contact with the vegetated slopes of the bank that cross the dedicated 30' wide buffer zone associated with the ORW. The next item scheduled for construction is the proposed pier measuring 5' wide and having an overall length of 200 ln. ft. On the west side of the pier, a series of 5 mooring piles will create 4 boat slips, each measuring 12' x 81. The workplat drawing shows a 15' separation between the property line and the mooring piles. On the east side of the pier, 2 floating jet ski ramps will be constructed, each measuring 10' wide x 17' long. In addition, an L-head platform will be constructed on the east side of the pier and it will measure 12' x 16'. The water depths along the pier average -1.8' with a maximum water depth at the end of the pier shown to be -2.6' relative to the MLW level. 10. ANTICIPATED IMPACTS: The redevelopment project will reduce the overall impervious surface area by 16%. The net result of this project will render the built-upon surface area to 9,652 sq. ft. of the 30,287 sq. ft. of Lot #3. However, the redevelopment is still 6.8%, or 2,081 sq. ft., over the maximum 25% coverage allowance by the CAMA ORW Use Standards. Nevertheless, the increased grass-covered area at some 7,571 sq. ft., and, the dedicated 30' buffer zone will significantly improve the absorptive or permeable nature of the property. The proposed bulkhead and associated backfill will arrest a long-term active erosion problem along the 108' section of shoreline. The bulkhead will be installed at or above the MHW shoreline which will help preserve the fringe of remnant cordgrass marsh-on the west side of the shoreline. The proposed bulkhead alignment will also help maintain the sand beach for public use along the east side of the project shoreline. The 4 boat slips are for temporary mooring of the rental boats which have been characterized as small sailboats. Like the boat slips, the 2 floating ramps at the end of the pier are for temporary docking of the rental jet ski. The jet ski/sailboat rental business is an ongoing commercial activity at the project site. The proposed improvements to the physical character of the commercially zoned property can only improve the environmental status at this location. It is doubtful if the new pier and designated boat slips will have a negative impact on the open 'SA' water quality of Bogue Sound. PREPARED BY: JAMES L.
