By letter, received January 8, 1993 (copy enclosed), the Town of Ocean
Isle Beach requested a modification to its State/Federal permit which
authorizes excavation of a shoal in Shallotte Inlet and renourishment of the
beachfront, between the Atlantic Ocean and the Atlantic Intracoastal Waterway
(AIWW), near Oean Isle Beach and Holden Beach, Brunswick County, North
Carolina. The modification is to reconfigure and deepen the area to be
excavated.
We have completed review of the revised proposal and have no objection to
modification of the authorization provided all conditions of State permit No.
52-92, issued May 26, 1992, remain valid and in full effect.

Dear Mr. Winfordner:
Reference our application for a Department of the Army
permit to excavate a shoal in Shallotte Inlet and renourish
the beach front, between the Atlantic Ocean and the
Atlantic Intracoastal Waterway (AIWW), near Ocean Isle
Beach and Holden Beach, Brunswick County, North Carolina.
The Town of Ocean Isle Beach wishes to make four minor
modifications to the project.
The Town of Ocean Isle Beach has been made aware of the
difficulty a dredging operation would have in maintaining a -8
foot deep channel. The Town requests its permit include an
allowable 2 feet of over depth. An allowable over depth might
not be used but would insure compliance with the permit in
creating an 8 foot channel. A drawing of the proposed profile
is enclosed.
Surveys subsequent to obtaining this permit have found
substantial amounts of suitable beach sand slightly east of
the original proposed location. The Town would like to
move the alignment of the channel to take advantage of the
sand available. The new proposed barrow area would be 200
feet by 700 feet. The original requested area was 150 feet
by 1000 feet. The total area of disturbed bottom would be
decreased by 1000 sq ft. A map to the new area is
enclosed.

Recent winter storms have caused erosion to endanger several
homes on the far East end of the beach. The Town of Ocean Isle
Beach proposes to move the renourishment area Eastward so that
the renourishment project will benefit these threatened homes.
A map showing this change is enclosed.
In order to most efficiently place sand in the above proposed
area the pipeline carrying the material from the barrow area
will need to traverse the Eastern end of the Island. A map
showing this change is enclosed.

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS:
1. That the terminal end of the pipeline be positioned
landward of MHW to allow for maximum settlement of
suspended solids.
2. That where the discharge pipeline crosses wetlands,
pipeline joints will be properly sealed to prevent
leakage.
3. That nuisance materials such as plastic and glass be
removed from the beach after each pumping event.
4. That the project be done in such a manner so as to not
cause turbidity outside the immediate construction area
to exceed 25 NTU.

9. PROJECT DESCRIPTION
The proposed project site is located at the intersection of
Shallotte Inlet Channel and the Atlantic Intracoastal Waterway,
between Ocean Isle and Holden Beach in Brunswick County.
Shoaling in the throat of Shallotte Inlet is hindering navigation
at low water, in the otherwise navigable channel of the inlet.
The inlet channel connecting the AIWW and the Atlantic Ocean is
approximately 3800 feet long. Adjacent water depths at MLW are
-12 to -15 feet in the AIWW and -7 to -10 feet in Shallotte Inlet
channel. The waters in the project area are classified SA by the
North Carolina Division of Environmental Management, and are open
to the taking of shellfish. The waters are not designated as
primary nursery area by the North Carolina Division of Marine
Fisheries. The Town of Ocean Isle Beach had petitioned the U.S.
Army Corps of Engineers to expand their existing Shallotte River
project to include the dredging of Shallotte Inlet. However,
after reviewing the request, the Corps determined that the
expansion of the current project was not economically feasible,
given the limited commercial boat traffic and long length of the
inlet channel from the AIWW through the ocean bar. The Town of
Ocean Isle Beach has subsequently filed this application to, at
least, open the shoal which is hindering entrance from the AIWW
to the inlet channel, in which, adequate depths (average -10ft
m.l.w.) exist to accommodate the smaller recreational boat
traffic which is important to the Town's recreation/tourism based
economy. The Town proposes to improve the channel through the
shoal by hydraulically dredging the channel 150 feet wide, 1,000
feet long, to -8 feet depth at m.l.w. The project would begin at
the intersection of tangent 19 and 20 (USACOE Survey 1991) of the
AIWW channel and proceed northwest for approximately 1,000 feet
to existing -8 t0 -10 feet channel depths. The applicant
proposes to dispose of the dredge spoil by beach renourishment on
Ocean Isle Beach, waterward of Ashville Street, proceeding ±
2,500 feet west through Lumberton Street. This area is currently
one of the approved disposal sites for portions of the USACOE
Shallotte River project which completed it most recent
maintenance dredging in January 1992. The Town of Ocean Isle
Beach proposes to coordinate this project with future USACOE
maintenance of the Shallotte River project and enter into
independent contract with their dredging contractor to complete
maintenance dredging of this area. According to the USACOE,
dredging of this area was last completed in the 19701s. The
project would generate approximately 25,000 cubic yards of dredge
spoil sands which would be placed along 2,560 linear feet by 40
linear feet of beach, approximately 3/4 mile northeast of the
project site. A beach profile of six (6) feet depth of
deposition is proposed at the dune escarpment tapering to
equilibrium below M.L.W. A M.H.W. line forty (40) feet waterward
of its current location is the project goal.

10. ANTICIPATED IMPACTS
Some short-term turbidity will be associated with the dredging,
as well as, with spoils disposal on the beach. Turbidity around
the project site is not expected to be significant given the
volume of water and rapid tidal interchange characteristic of
inlet hydrology, however these very factors will cause turbidity
to be spread over a much larger area than less dynamic sites.
Along the beach disposal site, adequate parallel diking to
decrease velocity and increase sand deposition, should control
excessive ocean turbidity. As long as the project is timed to
avoid periods of peak biological activity, no long term adverse
effect on the marine resources are anticipated. Navigation and
ocean access through Shallotte Inlet would be improved as a
result of the project, as well as supplementing the existing
federal beach nourishment project at Ocean Isle Beach.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Town of Ocean Isle Beach pursuant to an application filed on
the 13 day of April 1992 to dredge Shallotte Inlet and dispose of
the spoil on Ocean Isle Beach.
The Application provides adequate assurance that the
discharge of fill material into the waters of Atlantic Ocean in
conjunction with.the proposed dredging and beach renourishment in
Brunswick County will not result in a violation of applicable
Water Quality Standards and discharge guidelines. Therefore, the
State of North Carolina certifies that this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-
217 if conducted in accordance with the application and
conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are
not considered significant).
2. That the terminal end of the pipeline be
positioned landward of MHW to allow for maximum
settlement of suspended solids.
3. That where the discharge pipeline crosses
wetlands, pipeline joints will be properly sealed
to prevent leakage.
4. That nuisance materials such as plastic and glass
be removed from the beach after each pumping
event.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Reference your application for a Department of the Army permit to excavate
a shoal in Shallotte Inlet and renourish the beachfront, between the Atlantic
Ocean and the Atlantic Intracoastal Waterway (AIWW), near Oean Isle Beach and
Holden Beach, brunavi:ek-County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Enclosed is the application of the Town of Ocean Isle Beach for Department
of the Army authorization and a State Water Quality Certification to excavate
a shoal in Shallotte Inlet and renourish the beachfront, between the Atlantic
Ocean and the Atlantic Intracoastal Waterway (AIWW), near Oean Isle Beach and
Holden Beach, Brunswick County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by June 16, 1992, the District
Engineer will deem that waiver has occurred.

8. Project Summary The applicants propose to dredge the shoaled channel in
Shallotte Inlet, 150 ft wide by 1000 ft long by -8 ft deep.

9. PROJECT DESCRIPTION
The proposed project site is located at the intersection of
Shallotte Inlet Channel and the Atlantic Intracoastal Waterway,
between Ocean Isle and Holden Beach in Brunswick County.
Shoaling in the throat of Shallotte Inlet is hindering navigation
at low water, in the otherwise navigable channel of the inlet.
The inlet channel connecting the AIWW and the Atlantic Ocean is
approximately 3800 feet long. Adjacent water depths at MLW are
-12 to -15 feet in the AIWW and -7 to -10 feet in Shallotte Inlet
channel. The waters in the project area are classified SA by the
North Carolina Division of Environmental Management, and are open
to the taking of shellfish. The waters are not designated as
primary nursery area by the North Carolina Division of Marine
Fisheries. The Town of Ocean Isle Beach had petitioned the U.S.
Army Corps of Engineers to expand their existing Shallotte River
project to include the dredging of Shallotte Inlet. However,
after reviewing the request, the Corps determined that the
expansion of the current project was not economically feasible,
given the limited commercial boat traffic and long length of the
inlet channel from the AIWW through the ocean bar. The Town of
Ocean Isle Beach has subsequently filed this application to, at
least, open the shoal which is hindering entrance from the AIWW
to the inlet channel, in which, adequate depths (average -loft
m.l.w.) exist to accommodate the smaller recreational boat
traffic which is important to the Town's recreation/tourism based
economy. The Town proposes to improve the channel through the
shoal by hydraulically dredging the channel 150 feet wide, 1,000
feet long, to -8 feet depth at m.l.w. The project would begin at
the intersection of tangent 19 and 20 (USACOE Survey 1991) of the
AIWW channel and proceed northwest for approximately 1,000 feet
to existing -8 to -10 feet channel depths. The applicant
proposes to dispose of the dredge spoil by beach renourishment on
Ocean Isle Beach, waterward of Ashville Street, proceeding +
2,500 feet west through Lumberton Street. This area is currently
one of the approved disposal sites for portions of the USACOE
Shallotte River project which completed it most recent
maintenance dredging in January 1992. The Town of Ocean Isle
Beach proposes to coordinate this project with future USACOE
maintenance of the Shallotte River project and enter into
independent contract with their dredging contractor to complete
maintenance dredging of this area. According to the USACOE,
dredging of this area was last completed in the 19701s. The
project would generate approximately 25,000 cubic yards of dredge
spoil sands which would be placed along 2,560 linear feet by 40
linear feet of beach, approximately 3/4 mile northeast of the
project site. A beach profile of six (6) feet depth of
deposition is proposed at the dune escarpment tapering to
equilibrium below M.L.W. A M.H.W. line forty (40) feet waterward
of its current location is the project goal.

10. ANTICIPATED IMPACTS
Some short-term turbidity will be associated with the dredging,
as well as, with spoils disposal on the beach. Turbidity around
the project site is not expected to be significant given the
volume of water and rapid tidal interchange characteristic of
inlet hydrology, however these very factors will cause turbidity
to be spread over a much larger area than less dynamic sites.
Along the beach disposal site, adequate parallel diking to
decrease velocity and increase sand deposition, should control
excessive ocean turbidity. As long as the project is timed to
avoid periods of peak biological activity, no long term adverse
effect on the marine resources are anticipated. Navigation and
ocean access through Shallotte Inlet would be improved as a
result of the project, as well as supplementing the existing
federal beach nourishment project at Ocean Isle Beach.

Reference the application of the Town of Ocean Isle Beach for a Department
of the Army permit to excavate a shoal in Shallotte Inlet and renourish the
beachfront, between the Atlantic Ocean and the Atlantic Intracoastal Waterway
(AIWW), near Oean Isle Beach and Holden Beach, Brundwick`County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. In order to protect the endangered loggerhead sea turtle (Caretta
caretta), no excavation or filling will be permitted between the dates of May
1 and November 15 without the prior approval of the National Marine Fisheries
Service (NMFS) and the U.S. Fish and Wildlife Service (USFWS).
b. Excavation will not exceed eight feet below the elevation of mean low
water (MLW).
c. The excavated material to be used for beach nourishment will be clean
and free of any pollutants except in trace quantities.
d. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
e. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.

f. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less are not considered significant.
g. If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State/Federal coordination.

This is the report of the U.S. Fish and Wildlife Service (Service)
on Public Notice 199201683, dated April 10, 1992. The Town of
Ocean Isle Beach has applied for a Department of the Army permit to
maintain a navigation channel at Shallotte Inlet, adjacent to the
Atlantic Ocean and the Atlantic Intracoastal Waterway, Brunswick
County, North Carolina. This report is submitted in accordance
with the requirements of the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661-667d), and Section 7 of the
Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543).
It is to be used in your determination of compliance with 404 (b) (1)
guidelines (40 CFR 230) and in your public interest review (33 CFR
320.4) as they relate to protection of fish and wildlife resources.
According to information provided in the Public Notice,
approximately 25,000 cubic yards of water bottom material would be
excavated from the existing channel over an area 1,000 feet long by
150 feet wide, to a depth of -8 feet mean low water. Dredged
material would be deposited on the intertidal beach on the Atlantic
Ocean at the Town of Atlantic Beach. Dredged material would be
placed along 2,560 linear feet of beach between Asheville and
Lumberton streets over an area 40 feet wide.
Project area beaches provide known nesting sites for the federally-
listed, threatened loggerhead sea turtle (Caretta caretta).
Deposition of sand and use of heavy machinery on the beach during
nesting season could disrupt nesting females and crush or smother
their eggs and hatchlings. Indirect impacts could result if the
sand placed on project area beaches is of improper grain size to
match the existing beach and the requirements of nesting turtles.
In order to minimize the probability of adverse effects to sea
turtle nesting, the service recommends that no use of heavy
machinery or deposition of dredged material be permitted on the
proposed beach disposal/ nourishment site during the sea turtle
nesting season, May 1 through November 15, in any year. The
service also recommends that a grain size analysis be conducted to
ensure the compatibility of dredged sand with existing beach
composition. Analyses performed by the Corps for their Shallotte
River project would be acceptable as long as they included the
proposed channel maintenance site.
The Service has identified no other endangered or threatened
species, nor critical habitats that would be adversely affected by
the proposed project. Therefore, the requirements of Section 7 of
the Endangered Species Act are fulfilled, provided that the above
recommendations are included as special conditions of the
Department of the Army permit issued for this project. However,
obligations under Section 7 of that Act must be reconsidered if:
(1) new information reveals impacts of this identified action that
may affect listed species or critical habitat in a manner not
previously considered; (2) this action is subsequently modified in
a manner which was not considered in this review; or, (3) a new
species is listed or critical habitat determined that may be
affected by the identified action.
The Service appreciates the opportunity to comment on this project.
