SUBJECT: 401 Water Quality Certification for Pete J. and Katherine S. Andros lot
development in the Back Creek Subdivision, Merrimon Township, Carteret
County, North Carolina.
The Wildlife Resources Commission has reviewed the subject permit application
and biologists on our staff are familiar with habitat values of the project area. An on-site
investigation was conducted on May 1, 1992 for the purpose of assessing construction
impacts to wildlife and fisheries resources. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661 et. seq.).
Plans call for the filling of 4,363 square feet of 404 wetlands to develop an access
road for a single family dwelling. The road would access a small, upland portion of a 10.6
acre lot that is completely surrounded by wetlands. Vegetation occurring in the area
proposed for filling includes: wax myrtle, pennywort, broomstraw, greenbriar, Jun us, sweet
gum and pine. The affected wetlands are relatively undisturbed and provide quality habitat
for raccoon, oppossum, deer and a variety of songbirds.
The proposed project is a private, non-water dependent development activity
involving biologically productive wetlands. No public benefits are apparent. A total of
4,363 square feet of wetlands would be lost to filling. We consider this loss excessive and
find the project inconsistent with our Policies and Guidelines for Conservation of Wetlands
and Aquatic Habitats. We must therefore recommend that 401 Water Quality Certification
be denied. A revised application substituting a bridge for the fill-based road would receive
a more favorable review from this agency.

Dear Mr. Roberts:
An evaluation was made of the above subject property for the pur-
pose of determining if the septic tank system could be installed
in the upland area located near the water.
The evaluation was made according to the Laws and Rules for
Sanitary Sewage Collection, Treatment and Disposal, Section .1900
of the North Carolina Administrative Code.
An area was found that could be made provisionally suitable for a
conventional system if filled with eight. (8") inches of sand in
an area 36' x;65'. Also, six (6") inches of topsoil will be
required after the,drain lines are installed. (Modification sheet
enclosed for this option).
A second option which would not, require any sand fill and few
trees would have to be removed, would be to design a low pressure
pipe (LPP) system for this area. Also, six (6") inches of top-
soil would be required after the drain lines are installed.
If you choose the latter option you will need to contact this of-
fice for further discussion.

14. STORM WATER RUNOFF. Construction of the Subdivi-
sion has been permitted by the Department of Environmental Man-
agement of the State of North Carolina based upon the commitment'
of Declarant that the total "built upon area" of the Subdivision
shall be less than twenty five (25%) percent of the total subdi-
vision project area. It is therefor prohibited, subject to the
further provisions of this paragraph, that the "built upon area"
shall exceed on any Lot 30,260 square feet. "Built upon area"
shall be defined as by the State of North Carolina in its storm-
water regulations and rules as of the date of recordation of
this Declaration.
Notwithstanding this provision, upon application
of the owner of any Lot to the Architectural Control Committee,
the Architectural Control Committee shall be allowed to approve
a "built upon area" on any Lot in excess of 30,260 square feet,
if ,and only if the owner of another Lot within the subdivision
agrees, in writing, to reduce the "built upon area" on said
other Lot within the Subdivision an equal number of square
feet. Appropriate documentation indicating the approval and
restriction as required herein shall be recorded in the office
of the Register of Deeds of Carteret County.
This restriction may be enforced by Declarant, the
Back Creek Homeowners Association, Inc., and the State of North
Carolina, and is for the benefit of Declarant, the owners of all
Lots within the Subdivision and the State of North Carolina.

to place fill material in 0.10 acres of wetlands for road
crossing located at Lot 9, Back Creek Subdivision in Carteret
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2732 issued May 1,
1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 14.

Dear Mr. Roberts:
An evaluation was made of the above subject property for the pur-
pose of determining if the septic tank system could be installed
in the upland area located near the water.
The evaluation was made according to the Laws and Rules for
Sanitary Sewage Collection, Treatment and Disposal, Section .1900
of the North Carolina Administrative Code.
An area was found that could be made, provisionally suitable for a
conventional system if filled with eight (8") inches of sand in
an area 36' x;65'. Also, six (6") inches of topsoil will be
required after the,drain lines are installed. (Modification sheet
enclosed for this option).
A second option which would not require any sand fill and few
trees would have to be removed, would be to design a low pressure
pipe (LPP) system for this area. Also, six (6") inches of top-
soil would be required after the drain lines are installed.
If you choose the latter option you will need to contact this of-
fice for further discussion.

14. STORM WATER RUNOFF. Construction of the Subdivi-
sion has been permitted by the Department of Environmental Man-
agement of the State of North Carolina based upon the commitment
of Declarant that the total "built upon area" of the Subdivision
shall be less than twenty five (25%) percent of the total subdi-
vision project area. It is therefor prohibited, subject to the
further provisions of this paragraph, that the "built upon area"
shall exceed on any Lot 30,260 square feet. "Built upon area"
shall be defined as by the State of North Carolina in its storm-
water regulations and rules as of the date of recordation of
this Declaration.
Notwithstanding this provision, upon application
of the owner of any Lot to the Architectural Control Committee,
the Architectural Control Committee shall be allowed to approve
a "built upon area" on any Lot in excess of 30,260 square feet,
if and only if the owner of another Lot within the subdivision
agrees, in writing, to reduce the "built upon area" on said
other Lot within the Subdivision an equal number of square
feet. Appropriate documentation indicating the approval and
restriction as required herein shall be recorded in the Office
of the Register of Deeds of Carteret County.
This restriction may be enforced by Declarant, the
Back Creek Homeowners Association, Inc., and the State of North
Carolina, and is for the benefit of Declarant, the owners of all
Lots within the Subdivision and the State of North Carolina.

The NC Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 3/31/92 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based
upon our review, we have determined that the proposed activity is
consistent with the North Carolina Coastal Managen?ent Program provided the
following conditions are met.
1. The activity described in the above referenced application qualifies
to receive one of the Nationwide Permits described in 33 CFR Part 330 with
the exception of numbers 17, 21, 24, and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from
the NC Division of Environmental Management.
This letter does not relieve you of the responsibility to insure that
all other State authorization and/or permit requirements are met prior to

Dear Mr. Andros:
This is in reference to your request for a permit to proceed with work on
a road crossing through wetlands to access high ground on your property
located in Qw-telreU County, North Carolina. Specifically, the property is
located at Lot 9, Back Creek Subdivision. The road crossing will be 125 feet
long by 10 feet wide and located north of the original planned crossing (which
would have been through tidal marsh wetlands also regulated by the State
Division of Coastal Management).
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
c. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and

e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
