determined that the proposed fill can be covered by General Water
Quality Certification No. 2663 issued January 21, 1992. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 7.

ADDITIONAL INFORMATION
Cabarrus County proposes to develop a small wastewater treatment plant (WWTP) designed as
a modular treatment unit consisting of an aeration basin, sludge digester and secondary clarifier
(Figures 1 & 2). The WWTP, which will serve the growing population of the town of Midland,
is to be situated on the Rocky River, approximately 1000 feet southwest of the confluence of
Muddy Creek. The WWTP has been designed to initially discharge 300,000 GPD, with
potential expandability to 1.8 MGD. The project can be located on the Midland and Stanfield
USGS Quad sheets. The WWTP is presently under review by the NCDHENR Division of
Environmental Management for a NPDES permit.
The County also proposes to develop a sewerage interceptor system between Midland and the
WWTP, following the course of the Muddy Creek channel from approximately HWY 601 to the
WWTP. The surrounding land use along the interceptor and at the WWTP site is open
agricultural fields and undeveloped woods. An Environmental Assessment, developed pursuant
to the NC Environmental Policy Act, is presently under review by the DEM. During
development of this document, an evaluation was made of the interceptor alignment and WWTP
site for the following: federally listed or proposed threatened and endangered species of plants
and animals; cultural resources such as historic structures or archaeological artifacts; and 404
jurisdictional wetlands.
The results of this evaluation revealed that there are no known threatened or endangered species,
cultural resources or wetlands to be impacted in any way by the sewerage interceptor.
There exists the possibility of certain protected species, as indicated in the attached letter
(USFWS, 10/4/91), to be in the project vicinity. A review of the interceptor alignment and
WWTP site revealed that neither the sunflower nor the Nestronia are present. The outfall for
the WWTP is to be located well south of the mouth of Rocky River, and so the potential impact
to any Carolina heelsplitter population residing in Muddy Creek is negligible.
There are no known historic structures or archaeological resources to be impacted by the
WWTP. Additionally, there is a small wetland area near the confluence of Muddy Creek and
Rocky River, between the WWTP and its outfall; however, this area will be avoided and so no
impacts are proposed to the wetland. The wetland was identified pursuant to the 1987 and 1989
manuals, and a jurisdictional "safe line" drawn around the area to ensure avoidance (Figure 2).
Ultimately, the only impact proposed is an approximately 50-foot area of the Rocky River bank
which will be excavated to install the WWTP outfall. The outfall pipe will be laid in the
excavated trench, and then backfilled with cover material and natural soil so that pre-
construction grade will be restored.

This responds to your letter of September 9, 1991, requesting our
comments concerning the proposed Waste Water Treatment Plant and
transmission main, for the City of Midland, near the confluence
of Muddy Creek and Rocky River in Cabarrus County, North
Carolina. These comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act, as amended
(16 U.S.C. 661-667d) and Section 7 of the Endangered Species Act
of 1973, as amended (16 U.S.C. 1531-1543).
Staffing limitations currently prevent us from conducting a field
inspection of the proposed site. Therefore, we are unable to
provide you with site-specific recommendations at this time. If
any of the proposed work may impact wetland habitats, we
recommended that you consult the U.S. Army Corps of Engineers
regarding the need for Department of the Army permits to perform
work in wetlands for which they may have regulatory
responsibility. The Corps' contact person in this regard is
Robert Johnson, Room 75, Grove Arcade Building, 37 Battery Park
Avenue, Asheville, North Carolina 28801-2714.
There are one Federally-listed endangered (E), one species
formally proposed for listing as endangered (PE) and one
candidate (C) species which may occur in the area of influence of
this action:
Schweinitz' sunflower (Helianthus schweinitzii) - E
Carolina heelsplitter mussel (Lasmigona decorata) - PE
Nestronia (Nestronia umbellula) - C
The Carolina heelsplitter is known to occur in sections
Rocky River in Union County, downstream of the proposed

performed to determine if potentially significant archaeological sites or historic
structures were present. This work is not intended to satisfy any Section 106 (NHPA)
compliance requirements that may be associated with the project, but rather is
intended to provide preliminary information on the potential for involvement of National
Register sites.
Prior to fieldwork, the North Carolina Department of Cultural Resources site records
were consulted. Accordingly, no known archaeological sites have been recorded within
the project area. Nor has the project area undergone a systematic cultural resource
survey.
Three known historic structures are located near the project area within 1,000 feet of
Muddy Creek. The John Bunyon Green Farm is located on the south side of C.R.
1114, 0.5 mile east of C.R. 1178, and about 650 feet east of Muddy Creek. This
structure was placed on the National Register of Historic Places on June 2, 1988. The
James Chaney House is located west of C.R. 1113, 0.3 mile south of the C.R. 1191
junction, and roughly 500 feet southwest of Muddy Creek. The Billy Teeter House is
located on the south side of C.R. 1114, 0.1 mile east of the C.R. 1 189 junction, and
approximately 900 feet northeast of Muddy Creek.
Based on surveys conducted in the State's south-central Piedmont region, and on an
evaluation of soils and topography in the project area, archaeological sites are expected
to occur on elevated terraces and relatively level sideslopes and upland knolls bordering
the floodplain. Throughout the project area, surface exposures (useful for disclosing
the presence of buried archaeological remains) were very infrequent. The
reconnaissance revealed no cultural remains. If sites are present, subsurface testing
will be necessary to uncover them.
