The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be positioned in strict accordance with permit plans. To prevent an unintentional violation of this authorization, representatives ofthe North Carolina Division of Coastal Management and the Corps of Engineers will be available to stake the alignment prior to construction. b. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. C. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transfered to a third party. e. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. NARRATIVE DESCRIPTION: The applicant's property is located at Lot #1, Block 'B', Harbor Point Subdivision, adjacent to Myrtle Bay, off "The Straits", in the community of Straits, Carteret County. Harbor Point Subdivision is an approximately 43 lot residential subdivision with an average lot size of 1/2 acre. The applicant has started construction on approximately 2200 sq. ft. house approximately 80' from Myrtle Bay. The applicant proposes to construct a concrete sheet-pile bulkhead along the waterward edge of his property. A 1-5' border of Spartina patens is presently growing along the entire waterward edge of the property. This marsh fringe is eroding. The applicant is proposing to construct a bulkhead on the waterward side of the coastal wetlands and backfill with suitable material. Myrtle Bay is a tidal creek off "The Straits" and its waters are classified as 'SA' by the Division of Environmental Management, and are open to shellfishing. 10. ANTICIPATED IMPACTS: The applicant proposes to construct a 56' long bulkhead and backfill behind the bulkhead. The bulkhead will be positioned an average of 7' beyond MHW. This would impact approximately 168 sq. ft. of Spartina patens and approximately 392 sq. ft. of shallow water habitat. Approximately 14 cu. yds. of suitable fill material would be placed below MHW. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to cant' out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 write paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. March 10, 1992 A further description of the site of the purposed bulk- head is provided for your information. The tidal zone is a flat sandy area void of any vegatation. The bank along the area is from 12" to 16" high and is very irregular due to erosion. On the bank there is a variety of native species to include marsh grass,pine trees and southern bay(myrtle). The larger species of vegatation are fairly dense and form natural habitate and offer erosion control. The upland alternative for the bulkhead was considered but was rejected for the following reasons; a. The construction would require the removal of almost all of the larger native species in an area large enough to accomadate a backhoe. b. After the completion of the project the bank would continue to erode back to th- bulkhead. The area we are concerned about would be lost anyway. The purposed site was chosen for the following reasons; a. The bulkhead will. be placed In the tirlal zone close enough to the bank that the work area is above low tide. The excavation will. be done vith a water pressure pump. This will alleviate the need for larpe equipment except to lift and place the condret_e panels. -2- b. This technique will allow most of the larger native species not to be distirbed. c. All tidal erosion will be stopped and further lose of property will be eliminated, d.The quality of water run-off from the upland area will not be affected. The backfilled area behind the bulkhead will be seeded to eliminate any erosion into the waters of Myrtle Bay. Haines Copies furnished: Mr. John Dorney Division of Environmental Management r NOTICE OF FILING OF APPLICATION IJR CAMA MAJOR DEVELOPMENT PERMIT AND WATER QUALITY CERTIFICATION The Department of Environment, Health and Natural Resources hereby gives public notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Joseph Haines of Carteret County, filed an application on February 3, 1992, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material 'in project wetlands will not violate applicable water quality standards. According to said application, the applicant proposes to construct a bulkhead and backfill at Lot #1, Harbor Point Subdivision, off SR1340 and on Myrtle Bay, in the community of Straits, Carteret County. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Charles Pigott, Division of Coastal Management, located in the Division of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the office of Preston Howard, Division of Environmental Management, DEHNR Regional Field Office, Wilmington, N.C., (919) 395-3900. The Division of Environmental Management proposes to take final action on this water quality certification on or before March 29, 1992. Harbor Point Subdivision is an approximately 43 lot residential subdivision with an average lot size of 1/2 acre. The applicant has started construction on approximately 2200 sq. ft. house approximately 80' from Myrtle Bay. The applicant proposes to construct a concrete sheet-pile bulkhead along the waterward edge of his property. A 1-5' border of Spartina patens is presently growing along the entire waterward edge of the property. This marsh fringe is eroding. The applicant is proposing to construct a bulkhead on the waterward side of the coastal wetlands and backfill with suitable material.
