Although the lot is adjacent to a tidal pond, all proposed fill is outside the CAMA 75' AEC. The proposal to fill such a small area of these moderate to low value wetlands should have minimal impacts to water quality. (Rating Sheet Attached) The project will require a 401 Certification and that Certification should include the following conditions for the filling of wetlands. 1. That all fill material be from a clean upland source, free from toxic material. 2. That silt fences and other erosion controls be in place prior to any construction in the area of the wetlands. 3. That the filled area be stabilized with vegetation as soon as possible to prevent erosion. 4. That the project be done in such a manner so as to not cause turbidity outside the immediate construction area to exceed 25 NTU. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 12,600 sq. ft. lot located in the Beaufort Landing Subdivision, which is located between Front Street and Lennoxville Road, in the Town of Beaufort, Carteret County. This specific lot is bordered on the north by the Lennoxville Road, on the west by a tidal pond which enters Taylors Creek, and on the south by an existing single-family residential dwelling. The lot is characterized by having an approximately 6-15' wide border of coastal wetlands vegetated with Spartina alterniflora and waterward of that, an approximately 20-40' wide area of highground. The remaining portion of the applicant's property has been classified by the U.S. Army Corps of Engineers as 1404' wetlands. Vegetation on the property includes sweet gum, red bay, sweet bay, cedar, yaupon, etc. Adjacent waters are classified as 'SC' and are closed to the harvesting of shellfish. The applicant is requesting a permit to fill an approximately 4,800 sq. ft. area of 1404' wetlands in order to develop the property with the construction of a single-family residence. The residence and garage will have a footprint of approximately 2,380 sq. ft. with the majority of the residential structure being constructed on pilings and elevated above 1404' wetlands. The residential structure will be located approximately 50' landward of the MHW line. The majority of the wetland filling will be in conjunction with the driveway and garage. The applicant has reduced the amount of wetland filling from an earlier permit application by approximately 54%. 10. ANTICIPATED IMPACTS: The project, as proposed, will result in the filling in of approximately 4,800 sq. ft. of 1404' wetlands in conjunction with the development of a lot for a single-family residence. Approximately 180 cu. yds. of upland fill would be placed in wetlands. The residential structure will be elevated on pilings and the majority of it will be located over undisturbed wetlands. The proposed house will be located approximately 50' landward of the MHW line with the proposed fill being located approximately 85' away from the MHW. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 12,600 sq. ft. lot located in the Beaufort Landing Subdivision, which is located between Front Street and Lennoxville Road, in the Town of Beaufort, Carteret County. This specific lot is bordered on the north by the Lennoxville Road, on the west by a tidal pond which enters Taylors Creek, and on the south by an existing single-family residential dwelling. The lot is characterized by having an approximately 6-15' wide border of coastal wetlands vegetated with Spartina alterniflora and waterward of that, an approximately 20-40' wide area of highground. The remaining portion of the applicant's property has been classified by the U.S. Army Corps of Engineers as 1404' wetlands. Vegetation on the property includes sweet gum, red bay, sweet bay, cedar, yaupon, etc. Adjacent waters are classified as 'SC' and are closed to the harvesting of shellfish. The applicant is requesting a permit to fill an approximately 4,800 sq. ft. area of 1404' wetlands in order to develop the property with the construction of a single-family residence. The residence and garage will have a footprint of approximately 2,380 sq. ft. with the majority of the residential structure being constructed on pilings and elevated above 1404' wetlands. The residential structure will be located approximately 50' landward of the MHW line. The majority of the wetland filling will be in conjunction with the driveway and garage. The applicant has reduced the amount of wetland filling from an earlier permit application by approximately 540. 10. Health, and Natural Resources Post Office Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Parker: Reference the State/Department of the Army permit, issued to Mr. Pat Springle and Mr. Joe Christian, which authorized the placement of fill material in 0.11 acre of wetlands adjacent to Taylors Creek, Beaufort, Carteret County, North Carolina. Also, reference the July 14, 1992 letter, from Mr. Christian, Beaufort Realty, to Mr. Charles Jones, on behalf of Dr. William Talley, whereby he requests transfer of authorization to Dr. Talley, present owner of the affected property, and modification of authorization to reflect a realignment of fill material. Additionally, reference the memorandum of Mr. Charles Jones, dated July 21, 1992. The revised alignment reflects a slight decrease in the area of Section 404, Clean Water Act, wetlands to be filled. We have completed review of the requested transfer and modification and have no objections provided all conditions of the original permit remain valid and in full effect.
