THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Pat Springle pursuant to an application filed on the 6 day of
March 1992 to fill 0.11 acres of wetlands on lot # 11, Beaufort
Landing Subdivision.
The Application provides adequate assurance that the
discharge of fill material into the waters of wetlands adjacent
to Taylors Creek in conjunction with the proposed lot fill in
Carteret County will riot result in a violation of applicable
Water Quality Standards and discharge guidelines. Therefore, the
State of North Carolina certifies that this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-
217 if conducted in accordance with the application and
conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are
not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS:
This lot is located within the Town of Beaufort, in a
existing subdivision and is bordered on three sides by developed
land. Although the lot is adjacent to a tidal pond, all proposed
fill is outside the CAMA 75' AEC. The proposal to fill such a
small area of these moderate to low value wetlands should have
minimal impacts to water quality. (Rating Sheet Attached)
The project will require a 401 Certification and that
Certification should include the following conditions for the
filling of wetlands.
1. That all fill material be from a clean upland source,
free from toxic material.
2. That silt fences and other erosion controls be in place
prior to any construction in the area of the wetlands.
3. That the filled area be stabilized with vegetation as
soon as possible to prevent erosion.
4. That the project be done in such a manner so as to not
cause turbidity outside the immediate construction area
to exceed 25 NTU.

Dear Mr. Parker:
Reference the application of Mr. Pat Springle and Mr. Joe Christianson for
a Department of the Army permit to place fill material in 0.11 acre of
wetlands adjacent to Taylors Creek, Beaufort, ftiaaret County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. The placement of fill material in wetlands will be restricted to 0.11
acre, the area necessary for construction of the driveway and garage. See
Land Management Group Plan revised February 1992.
b. All fill materials will be obtained from a high ground source and
confined within the 0.11 acre area.
C. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
d. Appropriate erosion and sedimentation control measures will be
employed.

9. NARRATIVE DESCRIPTION: The applicant's property consists of
an approximately 12,600 sq. ft. lot located in the Beaufort
Landing Subdivision, which is located between Front Street
and Lennoxville Road, in the Town of Beaufort, Carteret
County. This specific lot is bordered on the north by the
Lennoxville Road, on the west by a tidal pond which enters
Taylors Creek, and on the south by an existing single-family
residential dwelling. The lot is characterized by having an
approximately 6-15' wide border of coastal wetlands
vegetated with Spartina alterniflora and waterward of that,
an approximately 20-40' wide area of highground. The
remaining portion of the applicant's property has been
classified by the U.S. Army Corps of Engineers as 1404'
wetlands. Vegetation on the property includes sweet gum,
red bay, sweet bay, cedar, yaupon, etc. Adjacent waters are
classified as 'SC' and are closed to the harvesting of
shellfish.
The applicant is requesting a permit to fill an
approximately 4,800 sq. ft. area of 1404' wetlands in order
to develop the property with the construction of a
single-family residence. The residence and garage will have
a footprint of approximately 2,380 sq. ft. with the majority
of the residential structure being constructed on pilings
and elevated above 1404' wetlands. The residential
structure will be located approximately 50' landward of the
MHW line. The majority of the wetland filling will be in
conjunction with the driveway and garage. The applicant has
reduced the amount of wetland filling from an earlier permit
application by approximately 54%.
10. ANTICIPATED IMPACTS: The project, as proposed, will result
in the filling in of approximately 4,800 sq. ft. of 1404'
wetlands in conjunction with the development of a lot for a
single-family residence. Approximately 180 cu. yds. of
upland fill would be placed in wetlands. The residential
structure will be elevated on pilings and the majority of it
will be located over undisturbed wetlands. The proposed
house will be located approximately 50' landward of the MHW
line with the proposed fill being located approximately 85'
away from the MHW. Impermeable surfaces within the
Estuarine Shoreline AEC will be approximately 11%.

WE RECEIVED YOUR LETTER OF FEBRUARY 3, 1992 CONCERNING THE PRO-
POSED FILL PERMIT APPLICATION WITHIN THE 404 WETLANDS OF LOT #11
BEAUFORT LANDING SUBDIVISION, BEAUFORT, CARTERET COUNTY, NORTH
CAROLINA. THE CONCERNS WERE CENTERED AROUND THE MEMORANDUM OF
AGREEMENT BETWEEN THE CORPS/EPA AND ACTIONS REGARDING AVOIDANCE,
MINIMIZATION, AND MITIGATION OF THE PROPOSED FILL ACTIVITY.
THE ENTIRE LOT UNDER OWNERSHIP IS -0.29 Acres WITHIN AN ESTAB-
LISHED SUBDIVISION WITH NO OTHER OWNERSHIP OF PROPERTY IN CLOSE
PROXIMITY. PRESENTLY, THE ENTIRE LOT IS CONSIDERED AS 404 WET-
LANDS, BUT IN 1989 JUST THE CENTRAL PORTION WAS CONSIDERED AS 404
WETLANDS. IN ORDER TO UTILIZE THE LOT FOR ANY SIZED SINGLE
FAMILY HOME RESIDENCE IT IS NOT POSSIBLE TO AVOID THE 404 WET-
LANDS. THUS AVOIDANCE OF THE 404 WETLANDS IS NOT AN ALTERNATIVE.
AFTER DISCUSSING THE SITUATION WITH THE PROPERTY OWNERS, IT WAS
DECIDED WE CAN MINIMIZE THE IMPACT ON THE 404 WETLANDS. WE ARE
ENCLOSING A REVISED PERMIT WHICH MINIMIZES IMPACT. THE REVISIONS
ARE AS FOLLOWS:
---Original permit applied for 0.24 Acres of fill, we are now
applying for 0.11 Acres of fill (54% reduction) for just the
driveway/garage construction (See Map).
---The fill improvements will now be 85 Ft from tidal waters,
rather than 20 Ft, and will still be grassed for stabilization
and erosion control after grading is completed.
---The proposed residential house will be built upon typical 8 Ft
spaced pilings to elevate the structure above the 404 wetlands.

The Department of Environment, Health and Natural Resources
hereby gives public notice as required by NCGS 113A-119(b) and
143-215 3(a)(1)(c) that Pat Springle (L. F. Baldwin, Land
Management Group/Agent) of Carteret County, filed an application
on February 21, 1992, for a permit from the Division of Coastal
Management to develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management that
a discharge of fill material in project wetlands will not violate
applicable water quality standards.
According to said application, the applicant is proposing to
fill a wooden wetland area in conjunction with the construction
of a single-family residence at Lot 11, Beaufort Landing
subdivision, adjacent to Lennoxville Road and a tidal pond which
enters Taylors Creek, Town of Beaufort, Carteret County.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
Charles Jones, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C.,
[phone], and/or the office of Preston Howard, Division of
Environmental Management, DEHNR Regional Field Office,
Wilmington, N.C., [phone].
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
April 5, 1992. The issuance of the CAMA Major Development permit
and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and
subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Roger N. Schecter, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
March 31, 1992 for consideration in the LAMA permit decision, and

8. PROJECT SUMMARY: The applicant is proposing to fill a wooden wet-
land area in conjunction with the construction of a single-family
residence at Lot 11, Beaufort Landing S/D, adjacent to Lennoxville

9. NARRATIVE DESCRIPTION: The applicant's property consists of
an approximately 12,600 sq. ft. lot located in the Beaufort
Landing Subdivision, which is located between Front Street
and Lennoxville Road, in the Town of Beaufort, Carteret
County. This specific lot is bordered on the north by the
Lennoxville Road, on the west by a tidal pond which enters
Taylors Creek, and on the south by an existing single-family
residential dwelling. The lot is characterized by having an
approximately 6-15' wide border of coastal wetlands
vegetated with Spartina alterniflora and waterward of that,
an approximately 20-40' wide area of highground. The
remaining portion of the applicant's property has been
classified by the U.S. Army Corps of Engineers as 1404'
wetlands. Vegetation on the property includes sweet gum,
red bay, sweet bay, cedar, yaupon, etc. Adjacent waters are
classified as 'SC' and are closed to the harvesting of
shellfish.
The applicant is requesting a permit to fill an
approximately 4,800 sq. ft. area of 1404' wetlands in order
to develop the property with the construction of a
single-family residence. The residence and garage will have
a footprint of approximately 2,380 sq. ft. with the majority
of the residential structure being constructed on pilings
and elevated above 1404' wetlands. The residential
structure will be located approximately 50' landward of the
MHW line. The majority of the wetland filling will be in
conjunction with the driveway and garage. The applicant has
reduced the amount of wetland filling from an earlier permit
application by approximately 540.
10. ANTICIPATED IMPACTS: The project, as proposed, will result
in the filling in of approximately 4,800 sq. ft. of '404'
wetlands in conjunction with the development of a lot for a
single-family residence. Approximately 180 cu. yds. of
upland fill would be placed in wetlands. The residential
structure will be elevated on pilings and the majority of it
will be located over undisturbed wetlands. The proposed
house will be located approximately 50' landward of the MHW
line with the proposed fill being located approximately 85'
away from the MHW. Impermeable surfaces within the
Estuarine Shoreline AEC will be approximately 11%.

WE RECEIVED YOUR LETTER OF FEBRUARY 3, 1992 CONCERNING THE PRO-
POSED FILL PERMIT APPLICATION WITHIN THE 404 WETLANDS OF LOT #11
BEAUFORT LANDING SUBDIVISION, BEAUFORT, CARTERET COUNTY, NORTH
CAROLINA. THE CONCERNS WERE CENTERED AROUND THE MEMORANDUM OF
AGREEMENT BETWEEN THE CORPS/EPA AND ACTIONS REGARDING AVOIDANCE,
MINIMIZATION, AND MITIGATION OF THE PROPOSED FILL ACTIVITY.
THE ENTIRE LOT UNDER OWNERSHIP IS -0.29 Acres WITHIN AN ESTAB-
LISHED SUBDIVISION WITH NO OTHER OWNERSHIP OF PROPERTY IN CLOSE
PROXIMITY. PRESENTLY, THE ENTIRE LOT IS CONSIDERED AS 404 WET-
LANDS, BUT IN 1989 JUST THE CENTRAL PORTION WAS CONSIDERED AS 404
WETLANDS. IN ORDER TO UTILIZE THE LOT FOR ANY SIZED SINGLE
FAMILY HOME RESIDENCE IT IS NOT POSSIBLE TO AVOID THE 404 WET-
LANDS. THUS AVOIDANCE OF THE 404 WETLANDS IS NOT AN ALTERNATIVE.
AFTER DISCUSSING THE SITUATION WITH THE PROPERTY OWNERS, IT WAS
DECIDED WE CAN MINIMIZE THE IMPACT ON THE 404 WETLANDS. WE ARE
ENCLOSING A REVISED PERMIT WHICH MINIMIZES IMPACT. THE REVISIONS
ARE AS FOLLOWS:
---Original permit applied for 0.24 Acres of fill, we are now
applying for 0.11 Acres of fill (54% reduction) for just the
driveway/garage construction (See Map).
---The fill improvements will now be 85 Ft from tidal waters,
rather than 20 Ft, and will still be grassed for stabilization
and erosion control after grading is completed.
---The proposed residential house will be built upon typical 8 Ft
spaced pilings to elevate the structure above the 404 wetlands.

POSED FILL IMPROVEMENTS THE GREATEST DISTANCE FROM ANY TIDAL
WATERS 85 Ft; (2) TO BE MOSTLY WITHIN TRANSITIONAL WETLAND AREAS
NOT CONSIDERED AS 404 WETLANDS WHEN EVALUATED IN MARCH, 1989;
(3) BY REDUCING THE PROPOSED FILL REQUEST 54%; (4) TO CONSTRUCT
THE HOME ON PILINGS ABOVE WETLANDS. WE HAVE MINIMIZED WETLAND
IMPACTS TO THEIR SMALLEST DEGREE, WHILE STILL TRYING TO RETAIN
SOME USAGE OF THE 0.29 Acre LOT.

(NCSR 1312) WITHIN BEAUFORT, CARTERET COUNTY, NORTH CAROLINA.
THE LOT IS TO BE USED FOR A SINGLE FAMILY HOME. MS. JEAN BENTON
AND MR. HUGH HEINE (Corps Of Eng Representatives) HAVE EVALUATED
THE LOT FOR 404 WETLANDS.
THE LOT HAS DEFINITIVE 404 WETLANDS WITHIN ITS CENTRAL PORTION,
AND QUESTIONABLE/TRANSITIONAL WETLANDS AROUND ITS' PERIMETER (See
Maps). THE LOT IS CLOSE TO A TIDAL POND WHICH FLOWS UNDER FRONT
STREET VIA A CULVERT TO TAYLOR'S CREEK, THUS THE 404 WETLANDS
WERE CLASSIFIED AS "ADJACENT", AND NWP PERMITS ARE NOT AVAILABLE
AT THIS TIME. THE NEW INTERPRETATIONS OF "ADJACENCY" MAY HAVE AN
EFFECT UPON THE CLASSIFICATION OF THESE 404 WETLANDS.
THE PRESENT ELEVATION OF THE LOT IS BETWEEN 5-8 Ft. THE PROPOSED
FILL. WILL BE KEPT ON-SITE BY LEAVING A +20 Ft VEGETATED BUFFER
BETWEEN THE TIDAL POND'S HIGH TIDE MARK AND THE FILL. IF NECES-
SARY SILT FENCING WITH X-FILTER CLOTH/BALED MULCH CAN BE PLACED
AROUND THE PERIMETER OF THE PROPOSED FILL. THE SITE WILL PERMA-
NENTLY GRASSED AFTER THE FINAL GRADE IS ATTAINED TO STABILIZE THE
FILL AND PREVENT EROSION/SEDIMENTATION.

Enclosed is the application of Mr. Pat Springle and Mr. Joe Christianson
for Department of the Army authorization and a State Water Quality
Certification to place fill material in 0.24 acre of wetlands adjacent to
Taylors Creek, Beaufort, Carteret County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
District Engineer will deem that waiver has occurred.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.

Dear Mr. Parker:
Reference the State/Department of the Army permit, issued to Mr. Pat
Springle and Mr. Joe Christian, which authorized the placement of fill
material in 0.11 acre of wetlands adjacent to Taylors Creek, Beaufort,
Carteret County, North Carolina. Also, reference the July 14, 1992 letter,
from Mr. Christian, Beaufort Realty, to Mr. Charles Jones, on behalf of
Dr. William Talley, whereby he requests transfer of authorization to Dr.
Talley, present owner of the affected property, and modification of
authorization to reflect a realignment of fill material. Additionally,
reference the memorandum of Mr. Charles Jones, dated July 21, 1992. The
revised alignment reflects a slight decrease in the area of Section 404, Clean
Water Act, wetlands to be filled.
We have completed review of the requested transfer and modification and
have no objections provided all conditions of the original permit remain valid
and in full effect.
