The Application provides adequate assurance that the discharge of fill material into the waters of Core Sound in conjunction with the proposed development in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. CAMA Permit Application for Evergreen Marina Atlantic, NC Dear Mr. Noble: Pursuant to our conversations on August 10 and 11, 1992, we are submitting this correspondence in an effort to clarify remaining questions associated with this proposed marina development. A letter dated August 12, 1992 has been submitted to Alexis Finn, DEM - Water Quality Section, Wilmington, requesting an exemption from a Stormwater Management Plan. Our permit application originally submitted to you in November 1991 stated in Section 5d that 1.75 acres of site area were to be graded or disturbed and that Erosion and Sedimentation Control and Stormwater Management Plans were pending. This figure is apparently incorrect. Our latest calculations of disturbed areas based on permit Drawing No. 2, Revised July 16, 1992, results in only 0.94 acres being disturbed. This number includes the marina basin, access channel, spoil areas and impervious surfaces. It is our understanding that the requirement for a Stormwater Management Plan and an Erosion and Sedimentation Control Plan are based on total impervious surfaces only. The total impervious surfaces resulting from this proposed development is only 0.60 acre. It is our understanding that this fact should result in the project being exempt from both an Erosion and Sedimentation Control Plan and a Stormwater Management Plan. We have also incorporated the mean high water line as shown on the Powell Survey in our latest determination of the AEC located on the site. The new total acreage of the AEC located 75 feet landward of the mean high water line is 1.40 acres. The total impervious area located within the AEC is 0.39 acre. This results in only a 28 percent impervious area within the AEC (see attached exhibit). The last item that we would like to discuss concerns the locations and dimension of the travel lift and crane hoist. The proposed sheet pile quay location was placed directly above a portion of the existing rubble jetty. This location was chosen in an effort to minimize new environmental impacts in Core Sound. David Noble August 12, 1992 Page 2 allow safe operation of the lift and hoist. Both of these machines are mounted on pneumatic tires and are designed to lift; boats out of the water and transport them to the paved areas of the site. The 20-foot width of the quay is necessary to allow the crane hoist to pass by the travel lift during boat transport operations. It was also necessary to locate the quay sufficiently seaward of the mean high water line to afford a water depth adequate to facilitate boat access and to allow the hoist adequate room to swing vessels around prior to transporting them past the travel lift. As for alternative locations and designs for the hoist and lift, it is our opinion that the location and dimensions shown are the most viable for this site. These items can not be located above the mean high water line elsewhere on the site due to the lack of water depth necessary for boat access. They can not be incorporated into the marina access channel because they would im ede ingress and egress to the boat basin. Finally, they can not be located in the boat basin proper without interfering with the use of the boat slips. The structural engineering requirements necessary for safe operation of the travel lift; and crane hoist are best met in the configuration and locations shown on the current Sheet 2 of the permit drawings. We hope that this correspondence has sufficiently addressed DEM's remaining concerns to allow the finalization of the permit application. After further review of the project, I realize that there are two other activites which will require Certification from the Division. A Certification (Number 2668) is attached for return water discharge from the upland diked disposal area. This Certification contains several important conditions which should be followed to protect water quality. In addition, Certification will be necessary for your plans to install a travel lift and crane hoist at the existing jetty since additional fill will be required. The Division will have to issue a Public Notice for this activity since the Division of Coastal Management's Public Notice did not cover the need for Certification of this work. 'In addition we have serious reservations about the water quality impact of constructing and operating this lift and hoist over open water especially since Core Sound is proposed to be reclassified as SA, ORW (commercial shellfi*phing, Outstanding Resource Waters). A possible way to avoid the need for an additional Public Notice and lenghty review would be to move the travel lift and crane hoist to the edge of the water or further inland. Please address the feasibility of redesigning this portion of the project to avoid additional fill which would require Public Notice. Until I hear from you on this issue, I will not prepare the Public Notice. FIELD INVESTIGATION REPORT - EVERGREEN MARINA (TED RAUFMAN), CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property consist of two (2) tracts totalling approximately 22 acres located at the end of U.S. Highway 70 East, at Atlantic Harbor, on Core Sound, in Atlantic, Carteret County. The property has an existing house and an old boat basin. The old boat basin was dug prior to permit requirements, but, Dredge and Fill Permit #211 was issued in 1970 for maintenance of the basin. The mouth of the basin has closed due to shoaling. Coastal wetlands consisting of Spartina patens, Distichlis spicata and Spartina alterniflora are present at the old basin mouth and around areas of the old basin. The applicant proposes. to maintain and expand the basin to 100' x 70' x -6' with an 80' x 35' x -6' entrance canal, and to excavate a 115' x 70' x -6' offshore basin (inside the old jetties) with a 130' x 50' x -6' access channel. The basin and channel will be constructed to serve a proposed 48 unit drystack storage marina with 6 wetslips in the proposed basin. The proposed dredging will be performed with a hydraulic dredge and an estimated 2,500 cu. yds. of dredge material will be pumped to a 25,000 sq. ft. diked highground spoil area to be located around the existing house. In addition to the hydraulic dredging, the applicant also proposes to excavate approximately 2,266 cu. yds. of material from highground. The applicant proposes to construct 540 ln. ft. of bulkhead within the basin and entrance channel and along the shoreline. Within the bulkheaded basin, the applicant proposes to construct 6 wetslips for temporary boat storage. Offshore of the basin, the applicant proposes to construct an 80' x 20' sheet pile quay partially covering an old stone jetty. This proposed wharf will be for a travel lift and crane hoist. On the opposite site of the travel lift basin, a 45' x 10' tract for the lift is proposed. On the highground property, the applicant proposes to remove the existing house and to construct a 60' x 40' workshop with a second-story apartment. In addition to the shop/apartment, there is a 120' x 26' forty-eight (48) space boat storage area and a 105' x 15' concrete pad work area. The applicant is proposing asphalt parking. A total of approximately 1.75 acres will be graded. Within the Estuarine Shoreline AEC, there is approximately 24% of impervious coverage. The proposed marina will be served by a proposed onsite septic tank system. There is an existing septic system for the house now on the property. ANTICIPATED IMPACTS: The waters of Core Sound adjacent to the property are closed to shellfishing by the Division of Environmental Health and Division of Marine Fisheries, and are classified as 'SC' by the Division of Environmental Management. Farther offshore from the project, the waters of Core Sound are designated as 'SA-ORW'. A public hearing is scheduled in March of 1992, for considering the designation of the waters in Atlantic Harbor to 'SA-ORW' which would include the project site. The proposed dredging/excavation will remove approximately 500 sq. ft. of mixed coastal wetlands, primarily Spartina patens, Distichlis spicata and Spartina alterniflora, and approximately 400 sq. ft. of coastal wetlands will be filled during the bulkheading of the basin. Approximately 2,514 cu. yds. of sand and silt will be removed from below MHW, and approximately 2,266 cu. yds. of highground will be excavated. The proposed bulkheading will place approximately 86 cu. yds. of sand backfill below MHW, and, the proposed quay/lift will require approximately 108 cu. yds. of fill material below MHW. Approximately 15,000 sq. ft. of shallow estuarine bottom will be excavated and approximately 450 sq. ft. will be filled for the travel lift tract.
