Also, reference your application for a modification to install a 1150-foot-long wastewater line and diffuser with marker buoys on the Pungo River. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. C. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practical measures. -2- This information is essential to our expeditious processing of your application and it should be forwarded to us by January 29, 1993. For the purposes of the U. S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act, was provided for construction of outfall structures where the effluent from the outfall is authorized, conditionally authorized, or specifically exempted, or is otherwise in compliance with regulations issued under the National Pollutant Discharge Elimination System (NPDES) program. We understand that your work has been permitted by the North Carolina Division of Environmental Management under NPDFES Permit No. NC0069426. Therefore, your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management. PROJECT SUMMARY: The applicant is proposing to place a 1,150, long effluent line into the Pungo River to discharge treated wastewater from the Upper Dowry Creek subdivision. w MAJOR MODIFICATION HARBOUR POINTE ASSOCIATES 15 December 1992 Environmental setting on 10 August 1987 the North Carolina Division of Coastal Management issued to Harbour Pointe Associates CAMA Major Development Permit No. 163-87 for the development of the Upper Dowry Creek Subdivision. The Subdivision is a 105.2 acre tract of land in eastern Beaufort County bordering both Upper Dowry Creek and the Pungo River off of SR 1710. The subdivision consists of 99 single family lots which are approximately 0.5 acres in size. Fifty-four (54) of these lots are bordering either Upper Dowry Creek or the Pungo River, the other lots are on a second row and to the north of the road system which is presently being constructed. This time a considerable amount of land disturbance is ongoing as a result of road construction, pond excavation and wastewater treatment plant site preparation. A 72 slip marina has been constructed within Upper Dowry Creek along with channel markers which show'access to the marina from the AIWW which is located within this section of the Pungo River. At this time an access walkway is being constructed across an unnamed gut off of Upper Dowry Creek. This walkway will provide access from the marina to other amenities such as the clubhouse, tennis courts, swimming pool, etc. The majority of the property on which the subdivision is being developed has been historically utilized for agricultural row crops. Some wooded areas are present which are mainly vegetated with loblolly pines. Wetlands are also present on the property and were delineated by both the Division of Coastal Management and Corps of Engineers in 1987. Project proposal When the applicant submitted the application for state permits in 1987, few details were submitted in regards to the wastewater treatment plant because it was unclear at that time what the exact and final proposal may be. Since that time plans have been finalized, thus the need for the permit modification that is being requested at this time. In regards to the wastewater treatment facilities, the applicant is proposing the following: (1) To construct an 80,000 gallons per day extended aeration wastewater treatment plant to treat wastewater generated from the single family residences, marina, and other amenities. (2) To construct a force main effluent pipe from the treatment plant site to the Pungo River. The buried pipe will approach the river on a 10' wide utility easement between Lots 24 and 25. This lot is vegetated with various upland grasses, and no wetland vegetation is present. There is a ±3' high erosion scarp present near the NWL. 0 • MAJOR MODIFICATION HARBOUR POINTE ASSOCIATES The 3" effluent pipe will then be extended 1,150' into the Pungo River to achieve a water depth of 6' at normal water. The final 50' of the pipe will be - a diffuser at which the treated wastewater will be discharged. The entire pipe beginning at 'the NWL will be hydraulically jetted to 3' below the river substrate. It is anticipated that no more than a 1' wide trench will be excavated by the jet system. The diffuser will be anchored on the substrate surface by concrete ballast blocks 5' on center. The location of the diffuser will be marked by 2 warning buoys indicating underwater pipe. Environmental impacts Potential environmental impacts area as follows: (1) Short term turbidity will occur during the hydraulic jetting of the pipe. (2) Approximately 1,150 sq. ft. of Pungo River substrate will be disturbed by the jetting. (3) No wetland vegetation will be excavated or filled. (4) A malfunction of the treatment facility may result in improperly treated wastewater being discharged into the Pungo River which will result in various water quality concerns and the effects that might have on marine organisms. (5) Another potential impact which is not so much environmentally related is the unknown of what impacts, if any, the diffuser pipe will have on commercial fishery gear mainly trawling in the vicinity of the diffuser. How many slips are now available? 72 s MODIFICATION REQUEST TO CAMMA PFILIVITT 163787 December 14, 1992 Modified to include the dredge and fill of the sewerage effluent line in the Pungo River This modification request to existing CAMA Permit No. 163-87 is made in order to include the dredge and fill of a 3 inch sewerage effluent line 1150 feet into the Pungo River. The original permit issued August 10, 1987 illustrated the discharge line and referenced NPDES - authorization #NC 0069426 which was issued by the Division of Environmental Management for the discharge of treated wastewater effluent into the Pungo River. This project contains 105 acres of development of a portion of a tract of land known as Bible Shores. The development provides 99 single family lots of approximately 0.5 acres in size. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The development features several amenities which include a 72 slip marina, a marina store , a clubhouse, tennis courts , croquet lawn, and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with aggregate base course in phase one. The marina is completed with the exception of the marina building and adjacent facilities and grading has begun on the amenities area The marina building will be completed in 1993 and the amenities areas are expected to be completed in 1994. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek will be served by a dual path 50,000gpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. The entire plant will be constructed without any phasing . It is designed to meet the limits of NPDES Permit No. NC0069426 and construction plans are currently being reviewed in order to receive Authorization to Construct. Upon receipt of this authorization it is anticipated that the plant construction will begin immediately. Wastewater is transported to the treatment plant by a pressure sewer system. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. n December 14, 1992 Modification request - CAMA Permit No. 163-87 Narrative `Page 2 After the wastewater is treated the effluent is discharged into a force main . The treated effluent will be discharged into the Pungo River at a minimum depth of 6 feet below the water surface. Based on a actual field survey the discharge line will have to extend 1150 feet into the Pungo River to achieve a water depth of 6 feet. The effluent will be transported to a 50 foot diffuser by a 3 inch HDPE farce main that will be hydraulically jetted to 3 feet below the river substrate. The diffuser will be anchored on the substrate surface by concrete ballast blocks 5 feet on center. The location of the diffuser will be marked by 2 warning bout's indicating "Underwater Pipe". The buoys will be located at either end of the 50 foot diffuser. The purpose for this modification request is to obtain a State Dredge and Fill Permit for the installation of a 3 inch effluent discharge line in the Pungo River. The Dowry Creek Development has all other permits required to construct this project. As previously described a considerable amount of construction has taken place and will be on going through the winter. PROJECT SUMMARY: The applicant is proposing to place a 1,150, long effluent line into the Pungo River to discharge treated wastewater from the Upper Dowry Creek subdivision. 41 MAJOR MODIFICATION HARBOUR POINTE ASSOCIATES 15 December 1992 Environmental setting on 10 August 1987 the North Carolina Division of Coastal Management issued to Harbour Pointe Associates CAMA Major Development Permit No. 153-87 for the development of the Upper Dowry Creek Subdivision. The Subdivision is a 105.2 acre tract of land in eastern Beaufort County bordering both Upper Dowry Creek and the Pungo River off of SR 1710. The subdivision consists of 99 single family lots which are approximately 0.5 acres in size. Fifty-four (54) of these lots are bordering either Upper Dowry Creek or the Pungo River, the other lots are on a second row and to the north of the road system which is presently being constructed. This time a considerable amount of land disturbance is ongoing as a result of road construction, pond excavation and wastewater treatment plant site preparation. A 72 slip marina has been constructed within Upper Dowry Creek along with channel markers which show access to the marina from the AIWW which is located within this section of the Pungo River. At this time an access walkway is being constructed across an unnamed gut off of Upper Dowry Creek. This walkway will provide access from the marina to other amenities such as the clubhouse, tennis courts, swimming pool, etc. The majority of the property on which the subdivision is being developed has been historically utilized for agricultural row crops. Some wooded areas are present which are mainly vegetated with loblolly pines. Wetlands are also present on the property and were delineated by both the Division of Coastal Management and Corps of Engineers in 1987. Project proposal When the applicant submitted the application for state permits in 1987, few details were submitted in regards to the wastewater treatment plant because it was unclear at that time what the exact and final proposal may be. Since that time plans have been finalized, thus the need for the permit modification that is being requested at this time. In regards to the wastewater treatment facilities, the applicant is proposing the following: (1) To construct an 80,000 gallons per day extended aeration wastewater treatment plant to treat wastewater generated from the single family residences, marina, and other amenities. (2) To construct a force main effluent pipe from the treatment plant site to the Pungo River. The buried pipe will approach the river on a 10' wide utility easement between Lots 24 and 25. This lot is vegetated with various upland grasses, and no wetland vegetation is present. There is a ±3' high erosion scarp present near the NWL. I b MAJOR MODIFICATION HARBOUR POINTE ASSOCIATES The 3" effluent pipe will then be extended 1,150' into the Pungo River to achieve a water depth of 6' at normal water. The final 50' of the pipe will be - a diffuser at which the treated wastewater will be discharged. The entire pipe beginning at *the NWL will be hydraulically jetted to 3' below the river substrate. It is anticipated that no more than a 1' wide trench will be excavated by the jet system. The diffuser will be anchored on the substrate surface by concrete ballast blocks 5' on center. The location of the diffuser will be marked by 2 warning buoys indicating underwater pipe. Environmental impacts Potential environmental impacts area as follows: (1) Short term turbidity will occur during the hydraulic jetting of the pipe. (2) Approximately 1,150 sq. ft. of Pungo River substrate will be disturbed by the jetting. (3) No wetland vegetation will be excavated or filled. (4) A malfunction of the treatment facility may result in improperly treated wastewater being discharged into the Pungo River which will result in various water quality concerns and the effects that might have on marine organisms. (5) Another potential impact which is not so much environmentally related is the unknown of what impacts, if any, the diffuser pipe will have on commercial fishery gear mainly trawling in the vicinity of the diffuser. The original permit issued August 10, 1987 illustrated the discharge line and referenced NPDES - authorization #NC 0069426 which was issued by the Division of Environmental Management for the discharge of treated wastewater effluent into the Pungo River. This project contains 105 acres of development of a portion of a tract of land known as Bible Shores. The development provides 99 single family lots of approximately 0.5 acres in size. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The development features several amenities which include a 72 slip marina, a marina store , a clubhouse, tennis courts , croquet lawn, and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with aggregate base course in phase one. The marina is completed with the exception of the marina building and adjacent facilities and grading has begun on the amenities area. The marina building will be completed in 1993 and the amenities areas are expected to be completed in 1994. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek will be served by a dual path 50,000gpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. The entire plant will be constructed without any phasing . It is designed to meet the limits of NPDES Permit No. NC0069426 and construction plans are currently being reviewed in order to receive Authorization to Construct. Upon receipt of this authorization it is anticipated that the plant construction will begin immediately. Wastewater is transported to the treatment plant by a pressure sewer system. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. h r ". A.r- +e MAJOR MODIFICATION HARBOUR POINTE ASSOCIATES 15 December 1992 Environmental setting On 10 August 1987 the North Carolina Division of Coastal Management issued to Harbour Pointe Associates CAMA Major Development Permit No. 163-87 for the development of the Upper Dowry Creek Subdivision. The Subdivision is a 105.2 acre tract of land in eastern Beaufort County bordering both Upper Dowry Creek and the Pungo River off of SR 1710. The subdivision consists of 99 single family lots which are approximately 0.5 acres in size. Fifty-four (54) of these lots are bordering either Upper Dowry Creek or the Pungo River, the other lots are on a second row and to the north of the road system which is presently being constructed. This time a considerable amount of land disturbance is ongoing as a result of road construction, pond excavation and wastewater treatment plant site preparation. A 72 slip marina has been constructed within Upper Dowry Creek along with channel markers which show access to the marina from the AIWW which is located within this section of the Pungo River. At this time an access walkway is being constructed across an unnamed gut off of Upper Dowry Creek. This walkway will provide access from the marina to other amenities such as the clubhouse, tennis courts, swimming pool, etc. The majority of the property on which the subdivision is being developed has been historically utilized for agricultural row crops. Some wooded areas are present whica are mainly vecetated with loblolly pines. Wetlands ars also present on the property and were delineated by both the Division of Coastal Management and Corps of Engineers in 1987. Project proposal When the applicant submitted the application for state permits in 1987, few details were submitted in regards to the wastewater treatment plant because it was unclear at that time what the exact and final proposal may be. Since that time plans have been finalized, thus the need for the permit modification that is being requested at this time. In regards to the wastewater treatment facilities, the applicant is proposing the following: (1) To construct an 80,000 gallons per day extended aeration wastewater treatment plant to treat wastewater generated from the single family residences, marina, and other amenities. (2) To construct a force main effluent pipe from the treatment plant site to the Pungo River. The buried pipe will approach the river on a 10' wide utility easement between Lots 24 and 25. This lot is vegetated with various upland grasses, and no wetland vegetation is present. There is a ±3' high erosion scarp present near the NWL.
